Hi all,
I have another possible stupid question. My fiance (soon to be wife) is an EU citizen but her country does not have DCF. Is it possible to move to a country say Germany or the UK and file it from there? As she is an EU citizen once we marry it is my understanding that I will also have the ability to freely live in Europe. Am I ok in assuming that my fiance and me can file a DCF as long as we are simply residing in a country that allows DCF? She doesn't have to be German or British etc...?

Yea I couldn't find it on the website either. I might have to consider another country if not Austria. We are flexible but Austria would have been ideal.

Hi all,
I am planning on getting married in September. We decided not to pursue the fiance visa and wait the extra time for my soon to be wife to have more rights (traveling home, working, etc). What are the major differences between K3 and IR-1? It seems that K3 is somewhat of a safety net if the IR-1 drags on, please correct me if I'm wrong. Upon further research it seems the K3 visa is not popular at all and I can't understand why? Is the K3 something to consider or should we just file the IR-1 and hope it doesn't take forever? We have heard of the IR-1 taking up to a year easily so we don't know what to expect. The K3 seems to allow her to at least come sooner and have more rights (going home sometimes) than the fiance visa,just in case the IR-1 takes longer than expected. Hi everyone,
I am currently living abroad in Hungary, no DCF...!! I got a job back home in the states starting in April. I would like to file for the fiance visa upon arrival and of me starting work. My new job exceeds the 125%. My only concern is that it is a new job, so no tax returns besides from my job in Hungary. Is this something to be concerned with? Is it enough to put an official letter from my company stating my position and how much I make per year? All help and advice is appreciated.

But is the I-864 sent to my wife abroad or to me in the states? It says a packet is send with I-864. Doesn't make much sense to me that it would be sent to her.

I am somewhat confused as to what happens after the I-130 is approved. I understand that a packet will be sent to my wife abroad to fill out and send to the consulate and then an interview date will be set up. I know I have to fill out the I-864 but was wondering if it would be sent to my wife abroad or be sent to me in the states. It is probably a dumb question but the whole process after the approval of the I-130 was somewhat ambiguous for me on the guides here as to who recieves what and who sends what.

Hi everyone,
I am living and working abroad. My foreign fiance and me share an apartment, which she owns. If after we get married the apartment then is listed jointly under both of our names is it possible to use the apartment to meet requirenments of affidavit of support? Even if the property is located in a foreign country? I know how much the apartment is worth but I was also wondering what the magic number would be if I wanted to use it? I realize it's a strange question but I am trying to find out some way tio prevent me leaving and going back to America without my wife while the visa is processing simply to satisfy the I-864. I also can't get a joint sponsor because my family doesn't want to joint sponsor, so that's off the table. If anyone has any other ideas to get around me moving back to the USA for a job the filing and waiting almost a year for her visa to process I'm all ears. Also we live in Hungary so DCF isn't possible.

If she studied in another country for over a year is she also required to get a certificate from that country?

Hi everyone!
I am living outside the USA and planning on getting married overseas and then moving back home to start work and then immediatly apply for my future wife to come over. Before moving abroad I had two jobs, both of which were short term and basically for making money so I could move abroad. I have filed taxes for both years i worked. the most recent return I compleated from abroad and indicated that I have a job abroad. I did not make much money for these jobs and my foreign position doesn't qualify me to be a sponsor. I was just worried there would be red flags with my previous tax returns as they are both short term jobs and do not meet the poverty guidlines. I am planning on moving back to the USA and getting a job well above the guidlines and have been told that this is the correct approach. Thanks for any help or info!

I've been confused how the police certificates work. My gf lived in the USA while an intern. She stayed almost a year and a half. She is from Hungary. Does she need a police certificate from Hungary and the USA or only from Hungary? It's my understanding that she will only need a Hungarian one as the USA gets a certificate on its own. Anyone know anything about this? Thanks in advance!

Hi everyone! Me and my gf will be getting married next year and was wondering about any complications that could arise in the visa process from her DUI while she was working in the USA. She is Hungarian and other than the DUI has a spotless police record in Hungary and America. The case was resolved in the US and she had to do some community service and pay a fine but never had her visa taken away or limited after the incident. We are both now living in Hungary and planning on going back to America next year. As I understand it a DUI won't cause our marriage visa to be denied but I would like to be crystal clear on the issue. Also how do we get the police records from the US? Can they send them to hungary? Thanks for the information and advice!

It would be easier to have the option of direct consular filing but unfortunately Hungary doesn't have that option. I think I have all the information I need for this one! I know I'll have a lot more questions in the future and I really appreciate everyone's input! Thanks again!

Great! I want to get married here and not come back until I have a job lined up. I'm working here so I'd rather not give that up while going back and looking in person in the states for who knows how long. Thanks for all the help on this one it's clear to me now!

Just to be clear I can get married, move back to America and establish residence and get a job, and then start the process? It doesn't matter if I will be recently hired and haven't worked more than a month or two? I'm inder the impression with a letter from my work and some savings it would be fine to do this...am I wrong?

It seems that I'm getting some conflicting ideas. What I would like to do is get married next year, March or so, and the. Leave for the USA with a job starting in April or ASAP. Then once there I will file for her to come and when I have to fill out the I 864 hopefully my income and job will be enough. I don't have 60,000 in savings. Thanks for all the help!

That is great news thank everyone for the help with this one! From what I can gather I should apply as soon as I have a job and am back in America. We really did not want to have to get a joint sponsor for this and I was worried for a second that I would have had to get one or wait to file after working a year. Basically I get a residence and start a good job back home in the states and I should be ok

Thank you for the quick response. So basically I would have to move back and work for a year and then file for her to come? It doesn't matter if I work for a few months, get a letter from employer stating that I am employed and have a sufficient salary, and show pay stubs? From your response it seems that getting a joing sponsor might be the only realistic option...

Hi everyone! I am new to the site and thought I would ask my first question. me and my Hungarian girlfriend are planning on getting married sometime in 2016. I was lucky enough to land a job here in hungary so we could be together, unfortunatly I don't make enough to meet the standards for the I-864. Our plan is that I will leave Europe soon after we get married and start working back in the states. We do not want my family involved as a joint sponsor so I realize I will have to leave and start work in America soon after we get married. Can I file immediatly from America when I start my new job there? Is there some sort of time limit for working that I must reach before applying? Thanks for any information and help on the subject!
