  1. To the OP - if relations between you and your husband are cordial and civil (as I see nothing in your post indicating otherwise), he could perhaps assist you with evidence that BOTH entered into marriage in good faith.

    Their relations must be cordial and civil, based on the fact that her husband waited until after she got her CGC to propose the divorce, not before.

    People DO fall out of love and it's better that you guys end it NOW, than struggle on unhappily. I do wish both of you the best in the future.

    While it is true that people DO fall out of love, the husband still must've had some feelings of love left towards his wife if he helped her get the GC anyway and did not propose divorcing before their AOS interview.

    if you actually read her post it does not state that the husband waited until she received the green card until he initiated divorce proceedings or even the suggestion thereof - it stated that she received her green card and that now the husband is presently seeking a divorce... nothing more...

    you know the issue of a green card (it would appear to mean a lot more to you than people who actually hold or want one), is your own suggestion and a construct of your own imagination - nowhere did the OP state or suggest that the divorce was put on hold until the conditional status was obtained -

    the OP does not need nor want snide comments and perhaps your energy would be best spent elsewhere - a suggestion might be a board entitled 'i'm paranoid, insecure and most of all unfulfilled - plese help me!' i doubt that they would suggest that the cure was to become a cyber/virtual bully (aka a coward) so maybe don't bother because the answers might hurt....

    I am afraid I do not understand what you mean. The sentence is incomplete and it makes precious little sense.

    i think it refers, on the one hand, to immigrants trumpeting up their origins (i.e. I'm white and western) so as to legitimise their right to be in the US and on the other, how this practice by logic suggests that Other migrants (i.e. non-white, non-western) have less of a right to be in the US -

    as the reply futher suggests - if a country of origin is so wonderful, why doesn't the person and his/her spouse settle there - but anyways read the OP and the replies and you can easily figure out the motivations of this post.

  3. apologies if i misread your post but just to note that more than likely from what i know (so its not gospel), you need to have a photocopy of the I94W to send in with your application and also in terms of the actual interview they will need to see the original or at the least a certifiable copy - if you no longer have this i think that you need to get a copy - i am unsure as to how exactly to go about this but i am sure that someone else will be able to tell you - all the very best for the rest of the process - niall

  4. Im just trying to get my vaccination supplement form done - I need 2 vaccinations and the designated civil surgeon I just called wants between $400 and $600 dollars for this ! OMG !

    America is expensive ! I just dont feel this is justified !

    I am not entirely sure if this is possible but when we were going through the medical we had a lot of the tests etc. done in our own local hospital through our own doctor - so we could claim this back through our insurance. we then passed on the medical files as proof of the vaccinations and test results to the civil surgeon for her to check - they were all in order and we received our medical package shortly thereafter. the only role our civil surgeon performed was the general medical which i believe is a requirement. by the way i had the full medical done here in the US as i am not a k-1 applicant.

    i think that once you have a legitimate record of receiving the vacciniation, no matter where it is from the civil surgeon must accept this and make the necessary ticks on your application. maybe someone here could confirm this?

  5. i think that the actual issue on expiration has to do with the time between the document being notarised and it being sent to USCIS - the time between them receiving it and then the actual interview is not an issue. so for example we had the sponser form notarised but by the time we got around to sending it in 30 days had elapsed and the attorny we were dealing told us to do it again as the USCIS when they intially receive a document do not want something that is alrealy 30 days or more old. For example, they wouldn't accept a letter from your bank that was two years or even one year old, although such letters probably will be by the time some of us get to the AOS interview!!

  6. Anyone on here request their bank letter from Bank of America? If yes, can you elaborate more on your request? Were there any fees for the letter?

    Trying to do this while living in Vietnam. My father is my power of attorney, but I wanted to see what I could find here before I sent him to the bank. Thanks in advance!

    hi we bank with bank of america and over the course of the submittal of our paperwork we received four letters from them (they cant be more than 30 days old when submitted to the USCIS i think so we had to request an updated letter for sponser and cosponser) and there were no charges whatsoever - in fact they were super nice about it.

    i suggest that you phone your local branch in person and explain to them the exact outline of the letter required (email it to them if possible - we did and they just filled in the gaps) and they should send it out to you for no charge and promptly at that. this might avoid the hassles of your Father having to go in and explain the situation. niall

  7. I don't have my RFE with me to cite the relevant sections, but it is clearly stated on the RFE that you can not apply for an interim EAD until 90 days after they receive your RFE response.

    find it and scan it please.

    well i have my RFE (I-485) in front of me but alas no scanner. but for those of you who believe without seeing it states,

    "You are ineligble for interim employment authorisation pursuant to Title 8, Code of Federal Regulatuons, Section 103.2 (B) (10) (ii) until ninety (90) days after the initial evidence is received."

I just dont understand it, its not like i am coming from a third world country and seeking asylum, the process is long and stupid and only filters the genuine people and not those who do it the wrong way. I mean Im from one of the financial capitals of the world and part of one of the worlds strongest past empire, yet i have to wait six months while millions of illegals now flood the borders and get to stay whilst filing for their papers. Its not fair.

    PS: He may have been pulling my leg, but the facts still remain, i have known him for a year, and he is illegal (I have my sources) and he has been in the US for 8 years. So something wrong is happening their but i dont know what.

    just to add my two cents as i am quite annoyed as to the nature of this post - i think that the story is obviously rubbish and plays upon people's fears and prejudices in an effort to whip up anti-immigrant sentiment at the very least....

    at the same time and apologies as i do not intend to insult the character of the OP who obviously is a decent person trying to make sense of why he is caught up in a bureaucratic hell but rather express a pet peeve of mine- it greatly annoys me to think that because of a persons particular nationality they should feel privilaged over other and by implication less "worthy" nationalities. after all the empire referred to above was a key reason in the forced dispalacement to give one example, of millions of irish people - many of whom landed here in the US. i had thought/wished that this sense of imperialism was becoming a thing of the past so it frustrates to see it here and i feel forced to drag up history as i hold no grudges for past actions - if anything i sometimes abhor nationalism and its violent manifestations.

    now if anything is unfair it is not the fact that there are illegal migrants but rather it is the reasons that they became illegal in the first instance - as in the case of Ireland it was to a great extent the historical consequnces of the famine and colonisation - perhaps in mexico this might be the impact of economic globalisation, a phenomenon no doubt integral to the success of your home city, which is by the way an inspiring model of how many different cultures can live together - so i just ask that we broaden this debate a little and realise that people migrate for reasons other than love as in the case of the majority of us here - we should also not forget the mark that mass emigration leaves on the home country - it is a scar ireland is only just coming to terms with - the same could be said about mexico in the future

    now the way i see it is that if people are frustrated with the USCIS then they should complain about them to their representatives etc and not suggest that illegal migrants who aren't even in the system in the first place are the reason for USCIS's inefficiency. we are essentially talking about something that has not even begun and it will be interesting if it actually does begin to see how many such individuals will use this great community or will feel inclined to use a forum where they will not be villified.

    sorry for the monday morning rant but for me being illegal is not that different from the process of becoming legal whcih as we all know sucks -

  9. thanks for replying... so he can work but he's not going be able to report taxes until he gets his EAD..i'm correct??... this is very confusing situation because i don't want my cousing to get in trouble ... :(

    especially now that he started his AOS :unsure:

    if he works without his EAD he is working illegally and as such if found out this may jepordise his AOS process, which given the importance of same, is a huge risk to take

    One more question -

    Does this also mean that they have found my response acceptable and I should not expect any further RFE's?

    we received a similar email about a six weeks ago after we sent in our RFE and one week after this email the case was touched and no further evidence requests were sent to us - fingers crossed i think when your case is touched after the date they receive your further evididence it means that they are fine with your response and you will not receive another RFE.
