  1. Case Number.

You can only adjust status when you CN is current.

For February for Europe is 19,100. If you're below that number you can AOS.

    My Case Number is 18,XXX.

I'm using an immigration lawyer, so my every action goes through her.

I assumer that providing an information that I am using an immigration lawyer, tells enough that I do everything within the deadlines, timeframes, the documents are updated, etc.

I should include this info. I apologize for not doing so.

  2. Any ideas when I can expect:

    • to be authorized to work legally until becoming a resident?
    • to have an interview with an Immigration Officer?
    • to receive a green card?

If anyone has any idea, experience, or could asked someone, I would appreciate the help.

I will start applying for jobs in 1-2 weeks and this information will be very helpful.

    My info:

    • Male, 29 years old. Never married. No kids.
    • Parents are the U.S. citizens.
    • Currently a student on F-1 visa. Graduating Spring 2016.
    • I applied for the Adjustment of Status (I-485) based on the fact I was selected in the DV2016.
    • I'm using an immigration lawyer.
    • My process is different than usual Diversity Visa Lottery winners go through.
Here is explained how "Diversity Visa Winners Legally Residing In the United States" can apply through I-485.

    Timeline:

    • 2016.02.25 - Biometrics Appointment for Employment Authorization (I-765)
    • 2016.01.29 - USCIS received the application for Employment Authorization (I-765)
    • 2016.01.23 - Biometrics Appointment for Status Adjustment (I-485)
    • 2016.01.05 - USCIS received the application for Status Adjustment (I-485)
    • 2015.05.08 - DV2016 Selection Confirmation
    • 2014.09.03 - Entry for DV2016

    Thanks a lot!

  3. 2016EU000XXXXX

Would be based on the bolded two numbers which you conveniently didn't list.

For Europe, in May they're interviewing DV2015 folks with EUROPE 30,300 with numbers below 30,300. In June they'll interview EUROPE 34,125 and below.

Oh my.. As you see I don't know how does it work. There is no single guide to all of this. Now I will know but, I couldn't figure out what these numbers (EUROPE 30,300 etc.) mean before. So thanks.

My case # is 2016EU00018XXX. So what does it mean? I would get an interview immediately?

  4. @milimelo, Thank you. Thank you. Thank you.

What is your case number? People normally write it as EUR09XXX or whatever their number is so you can guesstimate when your number will be up based on old visa bulletins http://travel.state.gov/content/visas/english/law-and-policy/bulletin.html

    My case number is 2016EU000XXXXX

How do I (gu)estimate it? Which number I look at?

  5. 1. AOS based on parents, who are now both citizens, and you are 25 years old, with an approved I-130 that mom filed?

    2. You really should study priority dates (yes, they apply to visas) as the priority date calendar applies to your exact type of AOS.

    3. Unless, of course, you married a USCitizen recently, then that's a different thing in its entirety.

    1. Yes. Approved for the Adjustment of Status and the form I-485 (http://s5.postimg.org/d071pt5jb/I_797_Notice_of_Action.jpg)

    2. Which scenario are you're talking? Priority date on the notice is May 31, 2013. The cut off date for me is Sep 2007.

    3. Never married. Currently on F-1 visa. Excluding myself, all family members are citizens.

  6. WHY would you be confused? Clearly says for Diversity Visa lottery winners who are legally in the US they can do AOS. You're in the US legally, right? F1 visa? Stay that way.

It's a lot of new info. I am not familiar with it and I find, what seems for me, contradicting information.

Most of the users say, I don't have to provide Police Records, because if I'm in the US, I can do AOS, since I'm legally here.

    But, why it says here:

"If the Applicant is in the United States:
Application should be sent to one of the four Polish diplomatic missions in the U.S.: Washington, New York, Chicago, or Los Angeles. Applications may also be sent directly from overseas to the Ministry of Justice address listed above."

    ?

So that is why it is confusing for me. I feel like I'm missing the point.

    Thanks for your patience.

  7. @Starkilla09, you're an amazing person. Thank you so much. I'm mailing it right away.

A note: I'm the only one who's applying. All my family members are citizens (parents and older brother).

    One 2 quick questions:

Hey like I said forget totally about a police record as it won't be applicable to you.

Could you determine why or provide a link where I can learn more about that? I just want to know everything possible on it. Hope you're understand, since this is a most significant process for my whole future.

    2nd question:

Does the information on this site apply to my situation as well, or only if as I was under 21? I am very confused about this. I know I'm not a usual case for this process.

  8. You're not under 21 so you don't qualify for adjustment of status as an immediate relative of a U.S citizen sorry. You'll be under a preference category even though your I-130 is approved at the moment and it will be years down the road for your visa number to become current so you can adjust status (provided you're still on lawful status at that time) or do consular processing overseas If you wanna follow that particular road. Your best bet is adjusting as a DV selectee so forget about the approved I-130 from your parent and concentrate on this one. Let that one sit at NVC at the moment to be your backup plan in case you don't get an immigrant visa from this process which can happen if you've not yet completed it once the fiscal year window closes. Pay your processing fees to the State department and begin this one ASAP for your own good so you don't get to be the unfortunate ones in the end. ( Yes it does happen frequently to those who delay their processing).

The problem is, I have no possibility, regardless some people can claim here, to obtain one of the required documents for DV2016 processing, Police Records.

If I am currently living in the US, and have been here since January 2011 (on F-1 visa since August 2011), am I still under the same application process as I would live in the country of my citizenship?

    Thank you a lot,

    James

  9. But, if you have read the stuff then you should understand from the links that you can do AOS from DV and that as long as your case number is current and you can submit the paperwork that is required for AOS (which in some instances differs from consular processing*, like police records as starkilla has clarified) that proves your eligibility for DV, then you will have your interview sometime between October 2015 and September 2016. Numerous people successfully adjust from F1 status having won DV. If you would rather wait 7 years that's up to you of course.

*Not that it's relevant to AOS but as I said before, if the "reciprocity by country" pages state that a police record is unavailable for those residing outside the relevant country then you don't need to get one. So even if you needed police records it wouldn't matter. But you don't.

OK, thanks for your time. I appreciate it.

I'm glad you're patient with me, since all of it it's new for me.

  10. You can read it here:

    http://s5.postimg.org/d071pt5jb/I_797_Notice_of_Action.jpg

    I-797 Notice of Action
Case Type: I130 IMMIGRANT PETITION FOR RELATIVE
    Notice Date: July 11, 2014
    Priority Date: May 31, 2013
Notice Type: Approval Notice - Section: Unmarried son or daughter (21 or older) of USC, 203(a) (1) INA
"The above petition has been approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain form I-485 Application for permanent residence. A copy of this notice should be submitted with the application."
What does it mean for me?
    I'm 25, on F-1 visa, and I was selected for DV2016.
Is it possible to combine DV2016 and I-485, to submit only documents required for I-485, but change the status quicker than that (7 years in my category).
  11. Starkilla quite plainly told you that police records are not required for AOS.

As for question 3, can I make a polite suggestion, that you read the information that is linked from your DV selection letter? It explains how to proceed with the case, you have a case number that needs to be current for you to be interviewed, etc. Most of this information is there, if you take the time to read it.

    Thanks for your polite suggestion.

I have read everything not only once, and it's not clear for me, that is why I am asking.

I do not see what you are referring to exactly.

Here, under the required documents section there says, "Police Records."

A link would be much more of a use right now than politeness.

You are referring to the DV, where I thought I was clear I cannot submit the documents they require, but I was approved for the I-485 (got the notice).

However the wait in my group is like 7 years. I'm just looking for the options I have. No need to be too polite.

    Thank you.

  12. Police certificate...what you were asking about...

Anyway starkilla gave you good advice from someone who did AOS. Perhaps you need to read it again because your last sentence in your reply to him didn't make sense, to me anyway. Why wouldn't you want to do DV processing which is a much faster and easier route?

    @SusieQQQ

PC, Police Certificate... USCIS calls it Police Reports and got me confused, but ok, now I get it. Hard to wrap head around DV AOS PC PR F1 SV and more.

    @Starkilla09

    1. I cannot obtain the Police Records, unless I will go back to my country in person. It is impossible to do so, so as to obtain the Police Records.

    2. If I am doing DV2016 from within the US, am I not obligated to obtain the Police Records?

    3. What do you mean by, "so they can start treating for your case # to be current"?

  13. Actually, you can adjust status from DV so I think this was in the correct forum originally...nevertheless:

OP, if you read your DV selection letter properly, there is a link to the dvselectee website. It should explain exactly what you need for AoS. I can't remember if you need police certificates for AoS, as I did CP, but if you do, on that site there is a page that describes what civil documents you need and under the "reciprocity by country" link on it you can look up your country and find out how to get the PC if you are not present there. If it tells you how to do it then you do it, if it says not available to people residing outside the country then you don't. But first prize for you is to read the letter and associated instructions properly...

What is PC? I'm not familiar with all these abbreviations.

  14. So you won the DV2016 but you're not using it, you're having your mum petition you instead? As far as I know, adjustment of status starts with a petition being filed on your behalf, like your mum have. Immediate relatives of a USC can also file the I-485 at the same time. See link below:

    http://www.uscis.gov/green-card/green-card-processes-and-procedures/adjustment-status

You are considered an immediate relative to your mum if you are under 21.

Hopefully, an admin will come along soon and move your thread to the adjustment of status forum, where people will have more information for you. Good luck!

I-130 (1st stage) filed 2 months ago, but just the fees. Later turns out I was selected for the DV2016. Decided I'm not proceeding with I-130 and I'll do I-485 instead.

    I'm not under 21. I'm 25 now.

Just to avoid a question about "why they didn't apply sooner" -- My parents became citizens already after I turned 25.

  15. You posted in the diversity lottery forum but your profile says you're filing for adjustment of status? I know that for the diversity lottery, you do need police certs. Don't know about adjustment of status but I would think so.

How about your parents, can maybe one of them get it for you?

I got chosen in DV2016, that's why I'm posting here. Possibly some admin will fix my mistake.

The parents are citizens. My mom applied for me through I-130, but we just paid the fees, never have sent the application. Wouldn't be better to apply through I-485?

  16. You mean your police certs/records from your home country? Can't you just apply for them online and have them sent to you?

It is impossible to apply for them online in the country I am from.

But since I've been in the US, legally since 2011, I can apply through Adjustment of Status, and then I don't have to go back to my country just to get this one piece of paper?

  17. I am on F-1 visa, but after 2 years of waiting, finally it's going to happen!

I want the interview for the adjustment of status (aka "green card") to go as smooth as possible.

I would also feel much more comfortable, if I would keep my medical history private.

I am prescribed amphetamine salts for ADHD. I have never abused drugs, but I have a history of mental illness, like depression, anxiety, etc.

When I looked at the form I-639 and read some topics on this forum, it seems it is a very wise idea to not provoke the doctor to do the drug test.

Regardless, I will stop taking my medication for a few days before the medical exam, just in case.

    Questions:

    1. Will they be checking my insurance? (the insurance doesn't cover the exam, paid out of pocket)

    2. Will they require any previous medical records?

I know some of you might disagree about hiding any medical history or keeping in a secret a medication someone's taking.

But, this is my private thing and I don't feel comfortable to reveal anywhere, but this forum, that I have suffered from any mental disorder, nor I take any medication.

    Thanks for the help,

    James
