  1. We are still waiting on our 485 in Boston. There have been no updates to our case since 12/30/2015 when they received our response to the RFE. We have been working with a congressman since the summer and he told us our case was transferred to NJ and they should 'hopefully' have an update by MAY. 

     

    We had to renew the EAD/AP because they expired March 10th.  

  2. Today we hit day 76, so I decided to call USCIS to see what's the EAD/AP status and if they can send it to me already cause I'm getting crazy over here (or maybe I said expedite? never mind...)

    When they asked me what was my reason to expedite it I told the truth - we are on day 76 and I was approached by recruiters on linkedin regarding job opportunities.

    At first I thought nothing is going to happen because the woman on the phone was very robotic in her answers and questions and sounded like she's reading off of a page.

    To my surprise, about two and a half hours later I got 2 texts, one for each case - EAD/AP approved and the EAD card is being produced!

  3. My husband doesn't have his drivers license yet, but I did bring him to get a learner's permit this past Monday. I believe all he needed was his original birth certificate, I-94, proof of residency (he switched his UK bank statements to our US mailing address and this worked) his social security card and his passport. There are no restrictions on the permit other than that it will expire in 2 years. He won't be able to get his license until he passes a roadtest and the earliest available date is in January. I won't know until then if there are any restrictions.

  4. It does not really matter for the USC. You can use your maiden or married name on the AOS paperwork. If you would rather use the maiden name now and change your name over to your married name at your own pace, then do that. When you need to file for ROC in a couple years, if you have changed your name, then use the married name on the form at that time. It will be ok that way. I did exactly just that. It WAS/IS perfectly normal to do so. There is no requirement to even change your name through marriage at all, and certainly not a requirement to change it, and begin using it immediately if you do.

    I think i might do that. Just change it after we receive the greencard. It seems like it would be additional paperwork added to the package that could be avoided. thank you :-)

  5. Do you mean a name change at Social Security for the USC? I guess less hassle because it is not further complicated by having to find your proper immigration status and name entry in a database which could have a hiccup. And workers are very used to changing USC names. They are not all experienced with K1s. Name changing on everything is a general hassle when you start thinking of all the places. So I decided not to do it.

    For an immigrant, Social Security actually wants you to keep your status current with them. I don't think everybody knows that. You are first a visa holder. Then a permanent resident. Then (if you want) a U.S. citizen. My husband updated for those changes. You don't have to go after EAD, but it will get the 'Not valid for work' wording removed from the card. Or you can wait and get that removed after the greencard is issued.

    Yes, I'm the USC and would be taking my Fiance's last name after we get married. I was thinking to keep things as simple as they could be, I should just wait to change my last name that way all of my documents, tax information, etc. has the same last name. Would you agree that it's just a potential issue that could be avoided while we are going through the AOS process?

    So ideally Social Security would like the immigrant to update their status each step of the way. After he enters the US on the K-1, then when he receives his EAD/AP card, then again when he receives the green card... but we could just go after he enters on the K-1 and then again once the green card is issued.

    It's not a quick process I know, but we just want to get everything done the most efficient way possible. I'm most concerned we could do something out of order that could delay the process in some way.

    If my fiance enters the US, we apply for the marriage license, get married 3 days later, then submit the whole AOS package once we receive the marriage certificate, getting the SSN after the AOS package is submitted wouldn't be a problem, would it?

  6. Our schedule

    Day 0 - POE late afternoon

    Day 1 - Wednesday. Marriage license. (3 day wait required before marriage)

    Day 5 - Sunday. Marriage.

    Day 6 - Monday. Registered marriage. Got certified marriage certificate.

    Day 9 - Thursday. Mailed AOS/EAD/AP. Went to bank to add him to my account.

    Day 10- Friday. Social Security office.

    Day 72- EAD/AP approved. Went to get driver license once card arrived.

    Because your I-94 will be fully automated (unlike 2008) you do not have to wait two weeks for your POE entry to hit the system. You can apply for SSN sooner. Doesn't mean your local SSA office will have a clue but ask for a supervisor if they give you any grief.

    Our state would not allow DL until EAD. Drove on UK license until then. If your state will give a license based on the I-94 arrival document, the DL will expire same day as I-94 (90 days). It is because that is the only thing a K1 has with a date showing legal presence. The EAD card will show a date of one year legal presence, so most will get a license good until the EAD expiration date.     As the US Citizen, is it less of a hassle/less time consuming to change your last name after the AOS process?

    I plan to do the same type of schedule next month.

    3. Marriage

    4. submit the AOS/EAD/AP package.

    If we apply for a SSN right after we submit the AOS/EAD/AP package, obviously we would leave the SSN # blank on the applications. Would we need to go back to the Social Security office AFTER we receive the EAD/AP at all?

  7. I was actually wondering the same. I'm thinking to keep things simple & to get the AOS process started as quick as possible, it might be best to change my last name after the AOS process is completed? I say simple because all documents that I'll need to submit (tax transcripts, evidence, etc.) will all have my maiden name and it could take time until my name is actually change, right? I honestly have no idea.
