  1. A-6 is the temp 90 day EAD that expires 90 days after entry, it allows work only during that period, and cannot be renewed, it costs $340

    C-9 is the 1 year EAD issued based on AOS filing, and is included in AOS fee.

    K-1 should not file for A-6 EAD it results in a useless $340 EAD card because it takes nearly 90 days to get.

  2. I think the officer was a CBP or Homeland security guy. It was at a different location to the airport but still somewhere near it. I had an appointment there because they wanted to pull me up about an old student visa I had in 2005. Anyway, I know he was trying to intimidate me but I just can't help being concerned. He said something along the lines of "I don't know why the US embassy always sends people here with expired petitions because they get left in limbo when they arrive & sometimes have to wait 5 months or so till they can get married".

    I just worry because they really have it in for me there. Last time I went to see my fiance they kept me for 7 hours. I'm sure it'll be ok but I really want to make sure I've taken all precautions before entering. I think I'll take Yodrak's advice & contact the embassy.

  3. I really need some advice about something. Well, I've recieved my fiancee visa & everything is cool. However, on my last trip to the States I was informed of a technicality by a USCIS officer. He told me that because my visa process has taken so long, when I enter the States on my fiancee visa I wont be able to get married because the approval expired before I got my visa. So basically, he said that K1 beneficiaries are supposed to go to their visa interview within the 4 month approval period. This is old news, but the problem is not everyone can do that & those who don't manage it are screwed when they arrive in the States.

    So he said that (even though I already have my visa now) because my interview took place AFTER the approval period my US fiance should apply to the national visa center for another 4 month approval. This sounds ridiculous to me but anyway, he wrote the letter & they wrote back saying that it was out of there hands & that we should get the US enbassy who interviewed me to write a letter. I havn't asked them yet but I'm sure they won't do it because its not their policy.

    I called the USCIS & they don't know anything about it (surprise surprise). Has this happened to anyone else? What should I do? :unsure:

  4. Hello Folks.

    Neither my fiance or I were not told by the USCIS that we had been approved but I eventually received packet 3 & therefore realised that this must be the case. So, the question is do I need to have the actual NOA2 for any reason? Perhaps at the interview? I don't see why they would want it but I just want to make sure.

    I called the USCIS & asked them if we had indeed been approved & they just repeated the same info that was on the website about our case, which was nothing different. & I emailed CSC & they emailed back saying that they do not reply to emails (which is weird coz they replied to my last one) & to contact them via the USCIS customer service line.

  5. Well, I just received a fax of the letter & low & behold it is from the US emabassy in London! Although according to the USCIS website we still havn't been approved yet. But this is what the letter says:

    So, this may be package 3 after all? I think we're allowed to get excited :dancing:

  6. We already received a letter from them acknowledging the address change, this is something different. The problem is I'm in the US visiting my fiance & won't get home till the end of August. But my Mum, who read the letter to me, told me it said it was from the USCIS & they didn't say anything about an approval, just that processing is now commencing. All the stuff that's in package 3 is what they've asked me to start gathering now. Apparently there's loads & loads of forms to fill out & they told me to book my medical. They said to fill in the forms & send them back ASAP. Does this sound like packet 3? I'm sure it is.

    Its so weird, I don't know whether to be happy or not. We contacted my Fiance's senator a couple of weeks ago to see what's taking so long & he sent us a letter saying he's contacted CSC so I'm assuming he's helped the process along.

  7. I am in the USA at the moment visiting my fiance for 90 days. This is my 3rd visit to the States while our K1 visa is pending. On each visit I was given a really hard time but they always let me through. I think this is because I can show ties to the UK (eg. a letter from my university stating that I am in the middle of a course). Also, I am always very honest & I think they can see from my track record that I always leave when I say I will.

    If your fiancee can show relevent ties to her home country she should be ok. From my experience I've found that it is beneficial to me that I have a K1 visa pending because the officers feel that we've made the effort to do things properly & it wouldn't make sense to jeopardise that by overstaying or getting married whilst visiting my fiance.
