  1. except by the OPs profile, the foreign half of the equation is in Toronto Canada, which would mean the K3 would be processed in Montreal, which is incredibly slow and the CR1 would be the quickest least expensive route.

    IMO, don't bother with the I-129F/K3, just go with the I-130 for CR1.

    But, will I still be able to come to the US on a tourist visa waiver during the process?

  2. I am understanding that we need to file our I-130 to the Chicago address. Does that include the G-325A? Send both of them there?

    Like many organizations, USCIS uses internal jargon in many of their instructions instead of plain language. By "stand alone" they mean not in tandem with an I-485 to adjust status.

    I would also recommend careful consideration before filing an I-129F to go down the K3 route. If you decide to do so, then file both petitions in the same envelope. Make sure each filing is entirely and independantly complete but put them in the same envelope.

    Thanks for clearing that up. Why would we file an I-129? Isnt' that a fiance visa form? I'm so confused... maybe we are not ready to send this out afterall. I read on this site until my head spins, but still it is confusing to me. I would hate to think how hard it would be withouth this site! I'd be totally lost!

  3. I have a couple of questions about filing for the I-130 (K-3). My wife and I married in September and we are planning on getting this out in the mail before I go back to Canada next week if possible.

    1). For proof of a bona fide marriage, do we need to submit an affidavit statement from some friends and family? We thought they might just write a letter, but I found this sample form in the Guides section (although it was in the “lifting of conditions” section) and it seems pretty formal. Does it have to be notarized?

    Or… is our marriage certificate and wedding photos enough? We don’t have any mingled resources as of yet, either. If we need the affadavits, then we’ll get them (tons of friends and family), but we’d like to get it filed ASAP. Of course getting things filed correctly is the most important thing, but we were hoping to get this paperwork filed before I have to go back to Canada.

    2) I already had my birth certificate translated and now I see that it was crossed off the assembly checklist. So should I leave it out, or send it anyway?

    3) My wife has taken my last name and has updated her name on her Social Security card, bank account, driver’s license… but not her checks and her passport. Is it ok to send a check with her previous last name on it? Should she go ahead and update her passport now?

    Item 14 - If your relative is currently in the US, complete the following...

    I am going back and forth - US-CAnada... about once a month...it is not that far... but my main adress is still in Canada... I am coming for visit on visa waiver... What sould I say???

    Item 15 - Present employer???? Should I say trhat I am self-employed or leave it blank???

    What about evidence of bona fide marriage??? we don't have joint ownership of anythng yet...

    Are affidavit from family members OK??? friends???? how many??? should we attach wedding pictures????

    Maybe someone could give me an answer??...

    I a French citizen.. living in Canada for a long time...

    I got married with a american lady on Sept. 1st 2007...

    more than 2 years relationship...

    I am going back to the US next week.... to start the immigration process... but will come back in Canada... I have an apt. in Toronto and make my money in Canada....

    At the airport immigration, I used to say "I'm going to see my girlfriend for a couple of week"... What should I say now????

    I don't want to lie to an immigration officer... but am I going to be suspected to try to stay in the US if I am saying now that I am visiting my wife???
