    Hi, I have been searching for instructions on the actual filling out of form I-485 in connection with a K-1 visa...can anyone point to guidance similar to "This number comes from X"?

    For instance, page 1 asks for A # (if any). Where would this A# come from specifically? Which document, and when would I have received it? Of course it says if any, but if it's something I have, I'd like to include it.

  2. yes, I have done that...the problem is that it doesn't tell you where the numbers actually come from.

    As I said above, the I-94 number I have is in a slightly different format than what is on the sample form (instead of three followed by eight, I have nine followed by two. This puts me in doubt.

    I do not know what form the A# comes from. At all.

    The visa number in the sample is 8 digits, which leads me to believe the red number, also 8 digits, is correct, but I do not know for certain....

    So the sample form, which I did review prior to posting, doesn't really help much...I think I need a hand-holder :(

  4. No true..... once her temp EAD expires she is not authorised to work.... the application for EAD that is filed with AOS is not for a renewal it is for a totaly new EAD not linked in anyway to the temp 90 day one given at POE....

Why would the rule say that a K-1 has the right to work without an EAD, but force you to apply for EAD anyway?????

    Nope doesn't matter at all, she can enter whever she pleases :yes:

    Sorry if this sounds like I'm being really dense, but....

    I was looking for a list of POEs and couldn't seem to come up with one.

    Does this mean any ole airport will do? Or is there a list somewhere of designated POEs?

  6. Here's the oddity. :huh: When she got the superpacket, she read which forms they required and which they provided to her. I went to the website for the USIS in Cuba, and they posted PDF documents of those forms which I filled out on her behalf. They were the most current versions of the form.

    Even though we made sure that the USIS knew she was ready for the interview, it took about 6 weeks to schedule it....then they postponed the appointment a week. FINALLY, she had the interview just today (9/28) and when she arrived, they told her that the forms were NOT correct, and that she needed to fill out the ones they gave her... Mind you, the forms they gave her to fill out were practically illegible, having been photocopied dozens and dozens of times, and were ANTIQUATED and DATED versions of the ones I pulled of the website and filled out! So, there she sat for the next couple of hours filling out the OLD forms because the current ones were rejected. Go figure. :thumbs:

    This was our experience as well. My SO thought of going to those people that help you fill out forms, but then realized that it is a scam to get you to pay the people that help you fill out forms. He figured them out himself, and they (the interests section) were satisfied.

    Yes, mindboggling, but es Cuba. :wacko:

  7. Hey, J, hang in there...we're all in the same boat, so to speak...

    As for my SO's experience at the interview, he didn't meet with a woman at all, he met with a man who asked him about a (small!!!) physical disability my SO has, which led to a looong conversation about sports. At the end of the "interview" the man asked him why he wanted to go to the US, he answered, For love! and the man said he was approved. On his way out some woman told him that he was interviewed by the big boss. Pretty funny ;-)

    The whole salida definitiva process has been a drag, he says he's being treated like an animal, and I am constantly wondering if we should have done the indefinida thing, but we're too afraid to change now, that may raise some cuban-red-flags (more opportunities to ask for propinas lol). In any case, this has been a learning and bonding experience for us, that's for sure...he's finally getting the to point where even *his* patience is wearing thin.

    One thing I was thinking is if they are allowed to fly to Cancun, can they then use JFK as POE and therefore get their working papers right away (didn't someone say JFK does that still)?

    Hang in there, I think we are on similar timelines, it will all work out, I am certain of it (at least for this moment lol).

  8. Not instead... in addition to. It probably works best if and is much easier you are there but they said it is possible by fax.

    once my fiance was granted his K-1 visa (day after the interview) went to local cuban immigration office where he was asked if he was soliciting to leave temporarily (letter of invitation for a visit) or permanently. Since a K-1 is a non immigrant visa good for 90 days unless married within he was given that option.

    So what we decided to do was get the letter of invitation and solicite permisso de salida (temporary) not carta blanca (permanent). It saved us money (not paying for the medical exam.... you pay when you get the tarjeta blanca not when you get the exam) and gives him the option to retain his rights as a Cuban citizen if he so choses (then there is a whole set of rule for that, for example he cannot reside outside of Cuba for more than 11 consecutive months ect...). Basicly through the eyes of the Cuban government he left temporarily and can return without losing Cuban citizenship.

    Does that explain it better or confuse you more!!!!?????

    Awesome info, 1/2Cuban...I am envious of those of you who seem to go through this stuff so quickly....

    When my SO went to the emigration office he wasn't sure what to ask for so we ended up with a salida definida, and now it's taking forever to get the carta blanca. However, we didn't get charged (at least not yet) for an additional medical. I'm kinda afraid now to switch to the indefinida because they might start asking questions, but in any case, if Cubans can only go to Cuba once every 3 years per US law, how can they keep up an indefinida if they can't be there every 11 months?

    I've also read that it costs something like $70 per month to retain Cuban citizenship, which could get expensive. I suppose it makes sense if you anticipate issues with getting married in 90 days, but as a long term option, unless you've got money to burn (who does these days?), it doesn't make much sense to me....

  9. The petition has no bearing on when one must enter the US. An approved petition is needed in order for a visa to be granted, thats it. It is the date of issuance of the visa that dictates the time you have to enter the US. On issuance of the visa, one has 6 months to enter the US.

    Excellent! Thank you so much for the information. That would give him about 6 more months to work on his release papers, even if they granted a visa (fingers crossed ;-) this week, which probably won't happen right away anyway.

  10. Hi All,

    I am not sure how this works for other countries, but for Cuba, the fiance must apply for a release before they can leave the country.

    We are in the situation where my application for k-1 was sent in in February and finally--at long last--received by the US interests section in June 2006. My fiance's interview is scheduled for this week (yay!!!). Our k-1 application apparently expires on August 28. Therefore, he must enter the US before that date, according to our papers.

    After the k-1 is approved (said with crossed fingers ;-), he must go to get a release, a Carta blanca or PRE. In order to get these papers, he must somehow get his employers to agree. This process is *not* easy at all. He has started the preliminary work on this (he cannot file until he is approved by US interests section), but he is worried that it will take him several weeks before it is actually accomplished.

    Does anyone know what to do in the event that it takes past August 28 before he can leave the country? Is there some process whereby we can request an extension? How do we request the extension?

    My apologies if this has been asked before, as I am pressed for time...a link to relevant information would be most helpful.

  12. Beisbol101 - the NOA dates I use are the actual letters if that date is given - if not I use whatever date is posted.

    This list does NOT form a part of any of the stats on this website btw - those are done from people filling in their timelines. And when you say NOA2 in your post you do actually mean NOA1 if your timeline is accurate ;) I've added you.

    Okay, so you added me using 2/22/06...but the actual letter was dated 2/27/06, and it said in the letter "we received <bla bla bla> on 2/22/06" Maybe I'm further into the future than I thought *grin*

    Can I ask a question regarding these dates? Is the NOA2 the date from the website, or is it the date from the letter?

    For example, my NOA2 letter is dated 2/27/2006, but on the website my case was last updated on 2/28/2006, and the letter in the website (when you click on it) says that my petition was received 2/22/2006. Which date do you use? Which date is everyone using?

    I am thinking that all of these dates can create mass confusion and slightly-off statistics. There is even a timeline in the system that shows a <b>sent date from last November with the NOA1 dated in February</b>. 3 months to receive it? It may be possible, but how do we know it's accurate...? Sorry, I'm just a type-A statistics junkie :blush:

    BTW, you can add me to the CSC list. Maybe the "Unite" thoughts will help with the waiting, waiting, waiting... :whistle:

    I do love this thread, so fun.

    My hubby is taking GED classes, and we were working on the reading comprehension one. Well, it was going over punctuation, which he already knew, but I was making darn sure of it. Anyhow, we went over comma's, question marks, exclamation points, then we came to what I grew up in the United States calling a period.

    Well we came to that one, and he said "full stop". I had bandied the "period" term about in various ways since he has been here, but didnt have a clue he didnt know what it meant when it came to punctuation! lol I asked "you call them full stops?" He replies "yes", I asked, you never grew up calling them anything else? "no"...I then replied...the light going on...."ohhhhhh. In our country we call them periods". He..with perfectly straight face..says..."I thought periods were something else!". I was dying...cuz I know when I was showing him how to use the computer, and he needed to do a dot.com...I kept using the term ..period..so lookin back no WONDER he acted confused... :lol:

    If it makes you feel any better, I have a residence in the VSC area where I lived most of my life, but was advised to file in CSC because it's my full-time residence, and where my current job is located. Congrats :thumbs: to the winners of this lottery, but because of this my patience is not very happy :(

    Perhaps that's why many of the basic principles of running a multimillion dollar, high-tech effort were ignored. The bureau didn't bother with an overall assessment of its technology needs. Instead, IT managers made assumptions about what Trilogy should contain. Simple requirements documents, meant to lay out the system's basic functions (like searching multiple phrases at once), became detailed descriptions of logos and look-and-feel. Commercial software was eschewed in favor of complicated, hand-coded alternatives.

    In typical gov't form, this probably became a big p-ing contest between their different divisions and sections, with everyone wanting *their* version of the seal and *their* favorite color on the reports and *their* department listed first lol Nothing will ever get done. First hand experience, I do db/interface design for a gov't agency, what a riot it can be. A 6-month project is easily stretched to 5 years (or more).

  18. anyone used the milwaukee service centre for their K-1 visa applications? any idea on how fast it is or how it compares to others? any ideas on the quickest centre to use if from wisconsin?

    Hi! I read this "Fact Sheet" http://uscis.gov/graphics/publicaffairs/fa...1_24Mar06FS.pdf which indicates that All I-129 applications after April 1 (today's the 6th) are now sent to Vermont. From Vermont, they are redistributed between Vermont & California. It doesn't seem to indicate what criteria are used to determine where they're routed, although it says they'll give you a notice indicating where it ends up. No mention of NSC with regards to I-129s (that I noticed).

    If this is true, maybe VJ should be updated for this new info? If it's wrong, forgive me, I know nothing :blush:

  19. Go to the top of this page and click on "Processing Times". I believe all these dates are all estimates and Im not sure escatly which one is uptodate either but the AILA ones seem to be closer to my NOA1 date so im sticking with that LOL :)

    Thanks! That is quite funny, apparently the Lawyer's Association (that's what I was missing!) knows the processing time update before USCIS does!

    Across the top of the site, there is a blue menu--not as dark blue as the one with tabs (home, forums, etc) but darker than the one where it says Logged in as, it starts with Gallery, Downloads, Example Forms, Processing Times (ugggh!), Immigration Timelines.

    If you click Immigration Timelines, there is a category that says Visa Display Options, and I generally click "Advanced View" of the K1 display options. From there, I choose California (from the bottom of the page), I add a hundred or so lines so I can see enuf, and then I sort, alternately, by clicking the down arrow on I-129F Sent (to see how many new timelines have been started), and then I-129F NOA2 (to see how many NOA2's have been sent to timeline users).
