  1. Hi folks,

    I started my process on a K1 visa. The time has now come for my AOS interview scheduled for early November. For my K1 visa i had to undertake a medical examination in London by a practice that was endorsed by the US embassy. My question is the following :

    Do I need a new medical done since it has been over a year since my last one or do I not need one? I have vaccination documents to hand.

    Any help is appreciated.

    I received my rescheduled 1-485 AOS interview for November and have a question regarding medicals. I started on a K1 visa and got married. For this visa I completed a full medical at Harvey street medical center which is the endorsed practice of the American Embassy in London. Will this medical do or do I need to get another medical done since I am now in the states?

    I had to reschedule my AOS interview due to family obligations abroad. I received a reschedule notice and am yet to be given a new interview date. I called USCIS for information and apparently I am now in some sort of gray zone where there are no timelines for rescheduling an interview. This has provided me with knock on consequences. My EAD and AP are expiring end of January 09 and i am, doubtful that i will be rescheduled before then. I need to get an extension/replacement of these two documents. I was mis-informed by people at USCIS regarding fees. Two agents said that i will have to pay the full filing fee again for a replacement for each application and two other agents said that if i filed my application after July 24th 07 which i did and paid $1010 i do not need to pay the fee's to get replacements. Is this true?

    Any help is appreciated,

  5. Hi folks,

    I received my EAD on February 2nd of this year. My I485 application is taking longer than usual because I had to reschedule my interview appointment for personal reasons which required me to travel abroad to see family. I still have not received an interview date and will call on Friday

    as I believe it will be 60 days.

    My question is the following : Can I apply for an extended/Renewed EAD card if my application has not been approved yet and EAD is expiring in 4 months?

    If so, is this the same case for Advanced Parole? How do I go about getting extensions or rather renewing them?

    I have a letter that i need to send to my service center regarding my interview and don't know where to send it to. When i was on the phone with USCIS i asked them if the address on the envelope that came to me was where i need to send it to and she said yes. It sounded like she was rushing me off the phone so i wanted to ask you guys :

    She said i should send it to :

    U.S. Department of Homeland Security

    National Benefits Center

    Post office Box 648005

    Lee's Summit Missouri 64002

    Would I not send this to the service center where i filed my AOS? i.e. CSC?

    Any help is appreciated.

  7. Hi Guys,

    I just received our AOS interview confirmation letter in the mail this afternoon. Our date is set for August 6th of this year and it couldnt be worse timing. I have been waiting for over 7 months and figured that the interview would take forever. With this in mind I booked a summer vacation to Europe to see some family and friends departing Aug 2nd -12th. Is there anyway i can postpone my interview date by a few weeks? I called the airline we are due to fly with and they confirmed that in order to change the reservation it would be a fee plus fare difference which works out to over $2000. I really don't want to have to change our travel dates. Has anyone had any success in moving their interview date?

  8. I did what you are doing for a whole year with some trips over 60 days to be with my fiance at the time. I am lucky enough to have a job that I can work from pretty much anywhere in the world so i decided to go over and be with her. The first two trips were fine but i started getting grief on the third trip onwards. My mistake was not handing in my I-94 departure record everytime i left the states. Because i didnt turn them in it looked like i didnt leave and they penalized me for that. It came to a point that everytime i landed at lax i just expected a 3 hour wait and interrogation. I told them the truth and said i was travelling around with my girlfriend from time to time too. It eventually got to the last trip when they said they would deport me if i came back really soon again.

    To sum up.

    1. They want to see that you live more in your own country than the USA.

    2. Bring paperwork of all your affiliation to your home country. House deeds, job letters etc.

    3. Fly into different airports and then onto your final destination.

  9. my wife will be returning to the usa in a few weeks. i did not send her with copies of her aos application or notice of actions. i'm surprised to hear that they ask for them. she only has her ap. (i don't see why she'd need anything else ... you don't get the ap unless you've applied to adjust status?? right???) i guess we'll have to see what happens. i hope they simply let her move along and i hope at one point ..... that things will be free of these endless curveballs!!!!!!!!!

    They probably won't ask for her AOS documents but it doesnt hurt to have them in case. Better to be prepared for anything one of these immigration officers come up with than not.

  10. We submitted out AOS/EAD/AP forms on Dec 13th, 2007

    We got the NOA on Jan 3, 2008

    Biometrics is scheduled for Jan 26th, 2008

    We got the RFE for I-485/I-765 on Jan 16th, 2008. USCIS needs the latest(2007) W2 forms . We wont be able to produce this until Feb 2008. The RFE states that processing of I-485 and I-765 will be stopped during this period.

    1) Will the I-131 processing also be stopped during this period?

    2) I have to travel out of the US by the end of April (not an emergency, but unavoidable). Should I go for an infopass appointment?

    Your thoughts will be helpful.

    I am suprised they are asking for W2's for 2007 as employers have until Jan 31st to issue them... are you sure it is asking for the 2007 W2's

    When you say you need to travel before April which is not an emergency but unavoidable how unavoidable is it? I got emergency AP via info pass and was grilled for a good 30 mins and my dad has Parkinsons. Unless you get a really nice info pass attendant your going to have to prove to them that your need to go abroad is valid.

    I posted soem threads a while ago about not being able to get a CA drivers license because my I-94 had expired and they needed proof of residency to allow me to take the written exam. I got advanced parole and went back to the UK for a week. I came back through LAX and they issued and stamped a new I-94 card in my passport.

    I have been to the DMV numerous times to try and get a DL and each time they said they couldn't do anything because my I-94 had expired. I would be amazed if anyone else has landed themselves in this situation however if there are I would love to here about it.

    My question is :

    Can I go and take my written driving exam and then the pratical now I have a new and valid I-94 as a result of coming back on AP?

    Any help is appreciated.

  12. Hi Guys,

    I posted a thread before about getting emergency advance parole via infopass and I guess I am one of the success stories. My father is ill and not being able to see him was something that hurt me everyday. I made an appointment with the Santa Ana infopass guys and got the advance parole within two hours. I left a few days later for the United Kingdom to see my dad.

    On the way back home i landed at LAX and presented my advance parole document along with customs form to immigration in the "US Citizen/Residents" line only to be quickly escorted to the interrogation room I like to call it at LAX. Inside the room were around 45-50 people who were also summoned to the room and I knew i would be in for a wait. Finally around 1 hour and 45 mins later the officer calls me to the desk and asked a few short questions :

    1. What was the purpose of your visit to the UK?

    2. Do you have a copy of your AOS application with you?

    3. Did you fill in a white I-94 departure record?

    I answered all the questions and she sat me down again while she attended to about 7 other people. 2 hours later she calls me back and says that she needs to take copies and 45 mins after that I was allowed to collect my lugage and leave. The waiting time was not to be desired, however i knew i would get some grief so I smiled and waited.

    I just wanted to give anyone who has advanced parole and is flying into LAX :

    1. Make sure you fill in an I-94 (White) form before you get to the immigration desk.

    2. Choose a flight that lands in the early afternoon and not early evening otherwise you will have a LONG LONG wait like i did. LAX is busiest between 3.00pm and 9.00pm every day as all the European flights land around this time along with some from Asia. I have been in this situation before and usually catch a connecting flight to a less busy airport like Phoenix or Boston and then on to LA.

    3. Take copies of your whole AOS application and approval notices with you.

    Hope this info helps anyone in the same predicament as me.

    SUCCESS! I got issued advance parole. The paperwork from the hospital worked and they issued me a travel document. I worked with the nicest lady who processed me in less than an hour an a half. I had to run out and get two passport photographs though and come back in so anyone applying for emergency parole DONT FORGET TO BRING PASSPORT PHOTOGRAPHS!

    I am ecstatic and happy there is a procedure for situations like my own. Ten points for the immigration service!

  14. I just got my family to send me all the paperwork he receieved from his doctor and neurologist which states that he had been admitted to A&E 4 times in a month along with other letters explaining the diagnosis of parkinson's, his dizziness and serve muscle pains.

    I made an info pass appointment for 7.45am tommorrow and will see what happens.

    I am currently waiting for AOS (I Filed on the 26th of Nov 2007) and looks like i wont get my AP for a while. My father back in London is hospitalized as he has parkinson's disease and the medication he was taking affects him so bad he cant even walk. My question is the following :

    Can i get AP early for an emergency such as this? If so how do I go about it? I really need to go back to London for a week or two and see him if something were to happen and dont know what to do.

    I doubt they will send you a letter. Just go to the arraignment and plead not guilty. Take a copy of the bloos acohol report with you and ask for a dismissal.

    If they decide to charge you with some traffic offense, these move out of the court system because they are no longer criminal. They are considered an infraction and are adjudicated by a walk-in traffic commissioner Not sure about your county, how it is done. Dont even think you would even need a lawyer for this aspect.

    I have some good news. My blood test came back and I had a BAC of 0.04% which as you all know is way under the limit confirming my initial thoughts. I am so happy as I was starting to doubt my own judgement. Now that i am under a 0.08% does anyone have any idea what the districy attorney may do with me?

    Any help is appreciated,

    DA will drop the charge...virtually no way to get a conviction without the .08 blood acohol. DA may try to plea bargin with you wanting y9ou to plead to reckless driving, if th4e police report can suport it. I would not even do that.

    I am guessing the ###**** of a cop that pulled me over is going to make up some stuff in the report and reckless driving could be in there. There is nothing much i can do about that except re-iterate that in order for me to drive recklessly i was either drunk or am insane, the first point dismissed because i was way under the 0.08% limit.

    If it gets messy i am going to hire a laywer to take care of this for me, however i am kind of waiting for a letter that dismisses the DUI charge. Without a doubt if they do not dismiss it i will be hiring a lawyer.

    First of all I have to extend my thanks to everyone that posted a comment. This has been the most valuable resource for me as i meander my way through California law. I have done everything correctly my whole life, the whole K1 visa process to AOS was done by the book. I feel as if this was just a spurt of bad luck and hopefully the DA will drop the charges against me regarding this matter. I am not too far way from getting my EAD and AP now so hopefully they will come just after christmas and i can apply for a California driving license.

    Again i would like to extend my sincerest thanks to you all!

    How do you know your EAD is not far off? When did you file AOS? Have you had an interview scheduled?

    I gotta ask -why are you not retaining a lawyer to answer these (VERY.IMPORTANT) questions?

    I forgot to mention that i received a date for Biometrics from USCIS and it is scheduled for tommorrow. Is this the interview you are referring to?

    No, I meant your AOS interview. It will likely be awhile.

    Good luck with your law stuff. VJ is no substitute for a lawyer, even this 'small' stuff - remember that. These could potentially affect your permanent residency, not something I'd take lightly.

    Agreed. Chances are I will hire a lawyer to take care of this for me.
