  1. Aloha,

    In 2008, I was married to a lovely soul from the Philippines. Unfortunately things

    did not work out and in 2012 she and I were divorced.

    In 2015, I petitioned for another filipina. The petition made it all the way to the

    embassy in Manila. It was only then I discovered she had created ad's on two

    sites offering her sexual services in exchange for someone to put her thru

    Med. school (she hooked up once). Needless to say, I was crushed and things

    came to an immediate halt.

    I began a frustrating (but successful) effort to have the embassy formally withdraw

    the petition. They eventually sent me an official form confirming the withdrawal.

    I did this for two reasons - 1. to open our slot for another couple and 2. if ever

    I decided to K1 again, I thought a formal withdrawal would look better than

    letting the petition languish in a slow death.

    In the present, I am considering another K1. I am concerned that on our NOA2

    (I believe - I'm too lazy to dig it out) it stated I was on some type 'watch list' due

    to submitting two K1's within a 10 year span I think.

    I have the withdrawal confirmation. I also have screen shots of her two ad's.

    If I include these, along with a detailed chronology of what happened, will

    there be problems with this K1?

  2. Ah. Maybe you should change your timeline-it appears as if the K1 process is underway already.

    So you have never met irl? Has she visited the States before? I would go with plan B -much less hassle IMO.

    No, we have not met as of yet. She was here in February as a guest of University

    of Hawai`i.

    Yeah, Plan B would be a DeAndre Jordan slam dunk. But... according to her, the interviewer

    was very focused on the funding aspect of the trip. She gleaned from that that if that could be 'fixed'

    she would have a chance, And our life will be here.. We'd prefer to make a life changing decision

    in the environment that we would exist... And 5 months together sounds a whole lot better than 2 - 3

    weeks.

    A couple weeks ago Soumanti interviewed a second time for a B2 visa. She was rejected again,

    but the interview lasted longer and she feels she was given more of a chance. She was told

    the main problem was proving she had adequate resources to finance her trip.

    I wrote an invitation letter stating my intention of covering her. I provided all the documents to prove

    she would be in good hands. But obviously that didn't carry a lot of weight.

    Soumanti had the feeling that the interviewer was trying to indirectly tell her that this was the only

    issue holding her back. That said, what are some possible strategies for a third interview? Two ideas

    I have are either sending her money to bank or opening a bank account here in her name.

    Any thoughts and ideas are very much appreciated.

    Soumanti and I were long time residents of Tourist Visa forum. That plan came to a crashing end last week

    when Soumanti's application was denied. So now this forum becomes our new address. Even if the B2 was

    approved, we would have ended up here in time. It's sad that we arrive under these circumstances, but nevertheless

    we will not be stopped in our quest for a life together.

    Plan B is for me to visit her, assemble 95% of the packet together then come home and file. I have a two concerns

    about the K1 and would appreciate opinions.

    1. Will the denial of the B2 have any impact on the K1??

    2. This is my third petition. The first was in 2007 which resulted in the marriage to a lovely person. Unfortunately problems

    developed and we divorced in 2012. The second petition was filed in February of this year. During the time that her

    paperwork made it's way to the embassy, she became very abusive to me. This caused me to want to end the process.

    The easy thing to do would have been to let it die on it's own. However I knew filing another petition at some point in the future

    was a possibility, so I wanted to terminate the process in a proper manner. I wrote to USCIS asking that the petition be withdrawn. They

    replied that all the paperwork has already been sent to the embassy and I would need to contact the embassy. I then sent the

    embassy a paper letter requesting the petition be withdrawn. A few weeks later I got a form letter back that clearly stated that the

    petition was withdrawn due to petitioner's request. In my mind, I handled everything in a responsible and appropriate manner.

    Assuming Soumanti and I submit a perfect packet, is it possible these two petitions (especially the recent one) will cause us

    problems??? I am thinking of adding to our packet a letter from me explaining the situation (similar to what I did here) and including

    my letter to the embassy and their reply. I am also considering asking Soumanti to included a letter stating she is aware of all this

    and harbors no reservations in perusing the K1 with me.

  5. Aloha all,

    She got her shiney new passport yesterday. Her schoolwork is done. We talked

    and came to the conclusion that she could be on a plane and make it to Honolulu

    before her first visa expires in a couple weeks. Of course, all that is contingent on

    the answer we seek (which seems pretty conclusive in our favor).

    Is there any advantage to getting a new visa? We are going to file for a K1 while she

    is here, so the B2 would no longer be of use. In using her current B2, we would save

    both time and money.

    I think we know the answer,, but we want to be sure. Soumanti has only a few weeks

    left on her multiple entry B2 visa. Does the expirey date on visa only have bearing on her entry date

    into the US? In other words, can she enter the US a few days before her visa expires

    and still be eligible for a full six months of time here??

    I can see the confusion - and I apologize to everyone for that. When I created our profile, I didn't

    see B2 as an option. So I listed K1 - as that will follow down the road. But for now, I changed it to "Other"..

    Yes, this is her second visa. But I wasn't involved in the first. The purpose of the first was only to

    visit UH. She was there for a week and left. Her parents took care of the finances.

    She has already applied for a tatkal passport renewal as her current passport is about to expire. She hopes

    to have that in a couple weeks. Her first B2 visa will expire second week of June. So once she receives

    her new passport, she will begin working on the second B2 visa. We will submit for the K1 while she is

    visiting..... Hope that clears things up a bit. Again, I apologize for the confusion.

    Back to the original question. Her parents do not consider this trip scholarly or professional in nature and

    will not provide financial help. So it's on Soumanti and I to make this happen. She has little finances so I need

    to help. Many sites we have seen suggest the host provide an invitation letter and financial information and all

    that. Now I am reading all the replies here. And what Nika said stopped me in my tracks.

    I just want Soumanti here with me for awhile so we can enjoy each other and make plans. We want to be fully

    above-board, legal and ethical about how we proceed. To have her stopped in Honolulu because of financial

    issues would be heart-breaking. I don't know what to do.
