  1. My wife , CR citizen, were married in the US while she was here on a travel visa. We moved to Costa Rica lived there for 7 years before beginning the process. I-130 approved in 2013 filed for the Visa but due to her overstaying her travel visa we had to file for the I-601 waiver which was approved in April of 2015. Interview was set for June 10th but they advised her she had to get an updated physical,criminal back ground check etc. Online status was adjusted to Ready (ready for interview). Checked the status throughout the week and noticed allot of activity this week ie changing of last update "dates." Last night checked the status again and the status had been changed to "Administrative Process." My heart sank. I had moved to the US in advance of her to set up a home and find work etc. I dont understand how they could do this. This isnt a situation where I met and married a local during a wild summer vacation we have been married for 8 years. She has a masters degree in systems engineering and speaks 3 languages. This was all done two weeks before her interview was set to take place. If anyone can give us some insight I would greatly appreciate it.

  2. I believe when approaching the I 601 waiver is to not base the appeal on only one topic. My wife's was approved on April 20 on our first attempt and she was subject to a 10 year ban. Look at how this affects your life in total not just one aspect ie.."financial." Look at things such as social alienation , lack of religious freedom,access to affordable and reliable health care and separation anxiety if you are away from your spouse. If you give the USCIS only one thing to focus on , they will do so in depth and that factor alone may not be enough to warrant an approval. I can not stress how important it is to organize your documents. Send them anything and everything. My wife sent copies of her degrees voluntarily had a police report run on herself to prove she was no criminal. IF you speak english state so in your application. When attaching your supporting documents, create an index and clearly mark the beginning of each section. The easier you make their job the more quickly they can determine in one shot, if additional supporting documents are needed.

  3. My wife's I130 was approved in April of 2013 visa denied as she over stayed while when we were first married in the US. We relocated to Costa Rica but now ready to move back to the states(Im already here went ahead of her). I 601 approved April 20th of this year. We applied on Dec. 26th , 2014. Received the approval letter but there were no instructions included. It only indicated that they had notified the consulate in San Jose. Now just for the "heck," of it I went to the state dept. web site https://ceac.state.gov/CEACStatTracker/ and punched in her consular case number SNJ@@@@@@@@ , and a pop up appears that says status updated April 30th and a big fat "refused," notation is at the top. Im thinking that was just the status from her first attempt as the case number is the same but that didnt stop me from dwelling on this ALL WEEKEND. It's tough to go from such a positive mind set to all out panic in a week. Anyone who has dealt with the SJO office knows they are impossible to get through to on the phone. My wife is going to prepare an email and attach the approval letter(scanned copy) and request that the instruction letter be emailed. Has anyone been through this process and if so what generally is the time line? They wouldnt summarily deny her again without the benefit of an interview would they. Nothing has changed from the first attempt other then her receiving a waiver for over staying her travel visa. Any help would be greatly appreciated. We can assist anyone with the waiver if needed as we did this all on our own no attys. and she was subject to a 10 year ban.
