Hi there
I recently recieved an RFE in the post. However it went to my old address (that of my in-laws) rather than my new one. My father-in-law scanned me me a copy of the letter and he's been collecting all the required evidence since (he's my co-sponsor and needs to supply more earnings info). However he thinks he may of since misplaced the original RFE request. My question is this - if I print out a copy of the scanned RFE and return that with the extra evidence, will that suffice? Or do they really need the original RFE?
Anyone any ideas?

We moved from Mississippi to New Mexico a few weeks ago and I'm just now trying to file for advance parole for Christmas (hopefully before the fees go up!) Anyway I see from the top of the I-131 form that as I'm now in New Mexico I must go in person to the El Paso office and hand in my I-131, rather than send it to the usual address where I've sent everything else. Does anyone know if this is correct as it's not clear from the El Paso office site - it just says this in regards to the I-485:
"This procedure will become mandatory at the El Paso Sub-Office on November 20, 2006 and will end on September 21, 2007. You should bring all applicable documents, including Forms I-131 and I-765, if you choose to file these applications with Form I-485. You should be prepared to answer interview questions on the day of your appointment and if approved you will receive an appointment notice for biometrics."
However I've already filed my I-485 and had my biometrics and the site gives no more info on I-131's. Im thouroughly confused - anyone any suggestions on this?
Also I guess I should change my address with the USCIS office - I seem to remember that you can do it over the phone, but that some people said that it was best to do it in writing. Any opinions?

Hey there
I've searched the forums and can't find anything to clarify this so here goes - my wife is my primary sponsor. We are both currently living in the same house as her father, who is my co-sponsor. Therefore as I understand it he fills in a I-864A. He must also supply a 2006 tax return, W-2 (and preferabley letter from employer and earning statement). So far so good.
However the I-864A also asks for 'proof of relationship' between the sponsor and co-sponsor, and proof that they share the same principal residence. I take it that a copy of the co-sponsors birth certificate should give proof of relationship, but what proof of the same pricipal residence? Alls that I can think of is a photocopy of a bank statement from each of them that has their names and address on. Do you think this would suffice?

Ok guys - I had a quick word with an immigration lawyer that is a friend of my wife's preacher. He said that while this wasn't his area of expertise, he strongly suggested not to go out of status. So I'm going to send everything in I have and wait for my RFE requesting the tax returns.
So my question is - will I recieve my new NOA1 which says I'm authorised to in the US for "a period of stay [pending a decision (though I'm not sure of this exact text) authorized by the Attorney General" first, or will I recieve the RFE first and hence still be out of status?

Ok - cheers guys. I'll leave the AP until August and take it from there. One less form to worry about at the moment at least.

Hey guys
Im just compiling all the paper work for AOS and was wondering if I should include the I-131 (and the $70 for it). My wife and I want to go back to the UK for New Year for a few weeks. Should I apply for AP now, or leave it for a few months and hope I have my greencard by then?
I don't want to waste the $70 on AP if I don't need too, but somehow think it's kind of hopeful that I'll have greencard in hand in less than 7 months!
What do you guys think?

Leaving the filing of the AOS for 7 weeks would certainly help as I still need to get alot of the evidence together. But besides not being able to work for that much longer, what are the disadvantages of becoming out of status when my I-94 expires? Does this make me an ilegal alien or something?!
I really appreciate the help - Ive tried calling the USCIS 'help' number and all they said was to send of the I-485 and I-130 forms. I-130? Isn't that for K3 visas? And when I asked what would happen if I went out of status she told me to just send in those forms. Would that prevent from me becoming out of status? Now Im more confused than ever!

Me and the new wife (!) are currently trying to fill in all the I-864 and all the paperwork to adjust my status, and hope to send it all off this week or next. However we're moving from Mississippi to New Mexico in 7 weeks (as she starts University). Does anyone know how this will affect our application process? Should I just file a change of address form with USCIS a week or so before we leave? Or just note it on my AOS cover letter? I'm kind of worried that I'll be assigned an interview here in Mississippi for when we'll be in New Mexico. Sorry if this is a dumb question but I'm a bit ignorant as to what sort of wait
i should be expecting between filing and getting an interview.
If I could I'd leave the entire process until we're in New Mexico but my K1 expires in a week so thats not really an option. Any help would be much appreciated.

Cheers guys. So if I was to go out of status, would I need to notify anyone about it? Would there be any repercussions later on or anything? This entire process is mad enough without USCIS having a black mark against my name!
And to clarify the whole tax thing - my wife and father-in-law will need the 1040 forms (?) and W-2 forms from the last year but preferabley from the last 3 years? And thats it? Or do they need the actual tax returns?

Am hoping someone can help me with this asap - we got married a week ago and am now trying to fill in all the paperwork for adjustment of status. My American wife is currently trying to fill in the I-864 but she doesn't have a tax return for the last year. Even though she doesn't earn enough to support me, I take it she still needs these to prove this? Or would a W2 be enough proof, as she already has one of these?
My joint sponsor is my father-in-law who does earn enough to support us, but also only has W2's and no tax returns (he hasn't got round to filing them!) Again, does the evidence have to be a tax return?
My K1 visa expires in a weeks time so am really not sure what to do. How long does it take to get a tax return? Would I be better off just sending in all the paperwork this week with just the W2's or would I be better off becoming out-of-status?
I'm sorry if this doesnt make perfect sense but I've been trying to sort this out all day and my brain is kind of frazzled.

I've been in Mississippi a little over a month now, and seeing as I now have a bit of spare time and we're getting married in just under 5 weeks time, I thought I should start applying for my social security number. So I printed out all the forms as per the guide on this site and went to the office. as this is Mississippi, the lady behind the counter had never processed a SSN for a K1 fiance visa holder, but she assured me that she knew what she was doing..... Anyway instead of being told that I'd recieve a SSN card in 2 weeks, she gave me a sheet saying that ' we cannot issue you a social security card until we check the documents you gave to show your citzenship or alien status
. We will check with the agency that issued them. This will take about 4 weeks.'
Has anyone else had this? I tried to show her the form saying that I was entitled to a SSN number but she said that 'the computer says no', or something alongs those lines!
I'm not sure if I should be worried or not - I thought i'd got done with all the tricky stuff! Any advice much appreciated.

Cheers for all the replys guys - especially the BBC America one! Now I know, Im going to load up on DVDs ( Ive already bought David Attenbourughs Planet Earth, and Michael Palins travel DVDs so I can check that my accent is still English and 'proper' against them!)
We've already put a kettle on our wedding list so thats sorted, though I had no idea about the dearth of duvets in the States!

I've just got my K1 visa in the post today (hooray) and am now looking at trying to rearrange my life over to the good ole U S of A. I know I've obviously got to sort out moving money over there along with all my possesions, but I was wondering if anyone from th UK had any other hints or ideas as to what I need to sort out before I leave? What do you wish you'd done when you were still over here that would have made your move over to the States that much easier?
Any hints much appreciated as I've been so busy worrying about the whole visa process that I havent really thought about what comes next!

The medical results are sent directly to the London embassy (at least thats what I was told?!), and Ive got 2 copies of the DS-156 in my packet 3 folder - forget to mention that!
Anyone think of anything else?

Hi folks,
I've got my interview with the London embassy this wednesday and just wanted to confirm that I have everything I need. I can just see me getting there after all these months of paperwork, only to be sent home for having forgotten a form or something!
So far I have:
Interview letter
Passport
Birth certificate
Police record check (for UK and other countries)
2 colour photos
Evidence of support (which includes forms filled out by fiancee, and my co-sponsor and evidence of his earnings)
I-129F packet (which includes evidence of relationship)
I-797 NOA approval notice
Duplicate packet 3
Is that everything? And can someone please specify whay needs photocopying and what doesnt out of this lot?!
Luckily my fiancee will be attending the interview with me so that should make things a little easier, but still, better to be safe....

Why is it I get the feeling that the helpline don't know what their talking about? They were the ones that told me that they no longer supply payslips and it would be fine to pay by credit card on the day!
I guess Im paying at the embassy anyhow - I've spent enough money ringing that 'help'line!

hmmmm - well i spoke to the helpline last night and they said that you now pay on the day of the interview and no longer send out payslips! This can get so confusing.....

The dollar is now even weaker at the moment compared to the pound, so I want to convert a large sum of my money over to dollars whiles the goings good. Has anyone any idea what the best way is to do this? I don't have an American bank account yet, though I could send it to my fiancee.
Just interested how everyone else transfered their money over to the US? I've not really a clue where to start!

Has anyone recently had an interview at the embassy in London? I didn't recieve a payment slip in my package 4, and seeing as it is nigh on impossible to actually contact the embassy, was wondering if you could pay for the visa on the day of the interview? Or do you need to have a payed prior to that? Im getting conflicting information from the helpline and the internet, so any clarification would be much appreciated.

Cheers - I know Im getting impatient. i guess its because I work on a government helpdesk and we manage to reply to emails within a few days. It boggles my mind how it can take them 9 days (so far) just to write a few sentences.
Oh and just to confirm with anyone who has had their interview recently - you do need to pay in advance right? I haven't got a slip yet so was wondering if worst comes to the worst, if I can just pay on the day?

Ok - this is starting to get a bit ridiculous. I've still not had a reply to my first email sent on the 3rd. I sent a chaseup email on the 7th my case number in the title, and still nothing. I've since spoken to the helpdesk and they advised me to put some code in the title of the email and resend it and I should get a response straight away, so I did yesterday. Ive still not had a reply to any of the 3 emails I've sent, and have no idea if I'm even sending them to the correct place!
Im just getting annoyed as my interview is/was/may be in 3 weeks time! Has anyone any ideas how to get a response from the embassy one way or the other? A different email address to the 'londonconsular@state.gov', maybe?

Well I just called USCIS 'information' line and the lady there told me that I would need the original and that they couldn't resend another copy. So that has helpful - if my father-in-law can't find the original copy then thats the end of my application process??! Of course you shouldn't believe everything that USCIS tells you so if we can't find it then I'm going to send the copy with the evidence and they can takie it from there.
Anyone else ever done that - send a copy of the RFE instead of the original?
