I thought that this website was created to share our experience with others who ask for it ! Saying ''' Ignore the other poster who talks about return of petitions to USCIS'' doesn't have any sense ! we didn't say that they'll send her case to USCIS or whatever . i was only talking about my situation ! that's all !
I am quite sure you're an active member on this website but your way of commenting still needs to be developed !
The lady was asking for help, we aren't going to tell her only nice speech to make her live a sweet dream ! she has to be ready for bad and good news! I did read her post carefully before i posted my experience here !

Can anyone explain why my Moroccan fiance male beneficiary who was given a 221g administrative review letter on October 1,2015 what this means? his k1 petition expires November 24 2015. He had everything I flew to Morocco to make sure he had every paper imaginable he had it all and answered all their questions correct he even knew dates and years of prior marriage of mine. The consular officer didn't say anything just typed his answers into a computer nothing negative just told him he wasn't denied he said "I will call you" so what does that mean?????? The 221g form only ADMINISTRATIVE REVIEW IS HIGHLIGHTED. NO MISSING DOCUMENTS. PLEASE REPLY ANY ONE WITH THIS EXPERIENCE WHAT CAN I DO AS PETITIONER? ??
did they keep his passport ?
did they give him a paper talk about his immigration rights in USA ?

I guess that your fiancée and me were interviewed by the same consular, he was an old man, he was rude to me ! he kept asking me questions with his low voice. i couldn't hear him as much as possible even though i asked him to raise his voice so i could hear what he was saying but in vain.
Anyway, this isn't important for you now !
Concerning your case, the old man handed me a paper stating that i am on Administrative processing, i asked him why did he do that and he said to me that we'll call you soon ! Administrative review was highlighted too! i kept waiting for more than 60 days because they said that most of the cases solved in tow months. i kept waiting and waiting then my fiancee started to do some calls with no answers! they always keep saying your case on Administrative processing! after six months and a couple of days, i got a call from them saying that u should be in the embassy 01th Sept ! i asked them if i need to bring some papers with me, he only told me to bring my passport with me ! i went there on time, they treated me as an animal, i kept waiting and waiting in the big room without any care! they even know that i had an appointment !
they called me on a window 7, i came into the room, i found another consular ! i thought he is a good one but he wasn't ! he only handed me a white paper saying that my case will send back to USICS for more reconsideration and he told me to tell me my fiancee to contact them within one month and two months !
it has been one month now ! they called my fiancée yesterday saying that they'll answer her why the embassy sent our case back to the USICS in 17th Oct!
i really don't wish to your fiancé the same situation but i just want you to be ready for good news and bad ones !

by the way, we provided them with all evidence they ask for ! Morever, my fiancée visited me four times !!! we won't forgive them !!!!

This is when you get your Senator involved. This was an error on the consulate, and when the petition is returned to the embassy, it needs to be expedited for approval. There should not be a need for an additional interview, your petition should resume its status in AP.
Call your Senator!!!!
We called the senator, she said that she can't do anything for us because the embassy in Casablanca is independent. I just want to know if we should wait for it to be back in USCIS and wait for them to make a decision whether they will let it to be expired or send it back to consulate in Casablanca again????

I am really very confused about my petition, I was called by the consulate last Monday, the gentleman handed me a paper said that your fiancée should contact the immigration in USCIS within one or two months. I asked him whether my visa is denied or still worked , he told me NO. Your visa wasn't denied, he adds your visa still has to be on administrative processing for extra time.
My fiancée has called the USCIS the day before yesterday, A lady told her that the officer made a mistake to send your petition back to USCIS because you have all enough evidence and proofs. They said that they can't do anything to stop them sending it back . Moreover, they said that if they send it back , it will stay there for 6 months for more processing???
I only have two questions about this dramatic situation, is it good for us to keep waiting until they send our petition back to USCIS for more processing because they may schedule third interview? Or Should we forget about this petition and think about a spousal visa as it will be strong more than k1 visa ??

Yes you can apply for your cr1 in January,our petition was approved by uscis in 5 months, then it went to the nvc. With a cr1 visa there is many more papers and 2 fees that you have to pay, then they review them all before the schedule your interview, so that is why it has taken so long.
So we don't need to wait for that letter from USCIS about our expired visa, I guess that spousal visa take long time too. We have waited and waited for k1 visa to be scheduled. I don't think there is a way we can follow instead of this way . We should get married next month as my wife will come to visit me . So , it is better to get married then start our processing in January!?

We applied in august 2014, all we have left is the interview. We would have already been done, but we delayed it a month because my daughter and I went back to morocco for a visit after our uscis approval, and we wanted to include proof of that visit in with our nvc packet. And the the nvc had computer problems so that stopped us for another month. I suggest with your cr1 you front load it with as much proof as you can, the petition is the same no matter what country you come from, just different places required more proof, honestly the hardest part for me was obtaining the permission to marry in morocco. There is a lot of paperwork involved in that, we were so lucky tho and were granted permission in just 6 days!
Is it ok if we start our petitioner in January ?
You made your wedding in Morocco, then you start applying for the visa ?
I guess that you're luck you got your permission to get married only in six days as administrative procedures are very complicated in Morocco. You have waited one year for your petitioner to be accepted in USCIS?

chat logs ?calls ? letters ?
Yes , you can't imagine how many evidences we provide them but in vain. We gave them engagement party pictures, chats letters either on Facebook, what's app and fiber , letters and call bills.
I really don't know why they aren't convinced yet !?

The day that my now husband was told that the petition was being sent back, I bought my plane ticket to morocco, we applied 2 months after I returned home. About 1 weeks after oUr petition was accepted by uscis I received a letter from them state ing our k1 visa was expired, we never were told as to why it was denied. Some people say wait for that letter, but we didnt. Now we are just waiting for our interview to be scheduled for the cr1, and praying that this time they will grant the visa.
You waited only two months to apply for CR1 visa ? I guess that we will start our petitioner in January too, we can't wait anymore to be with each other.
How long time does it take for you to apply for CR1 visa ? Is it hard to do it in Morocco ?

We had this same thing happen to us, there is no way to stop them from sending it back to uscis, and once they do, it will not be looked at again, they will let is expire. So your best thing for you to do is to marry in morocco and file a cr1. That is what we have done
I totally agree with you on this point. My wife has called the senator in order to help us preventing them from sending back our petitioner to USCIS. He told her that he can't do anything as those officers are very educated and independent as well.
I am not going to care more about this visa. We have decided to apply for a spousal visa inshallah.
I only have one question for you please, how long time you have waited from k1 visa denied and start to apply for CR1visa ?

Are you married or is she your fiance? Sounds to me like you applied for the wrong visa as you're married and the K1 is for people who are engaged and not yet married. If you're married you need to apply for the CR1 visa.
She is my fiancée, I am used to call her my wife.

Well for starters you are saying your wife, but you applies for a K1 visa? Once you are married you are not eligible to apply for a K1. Could this possibly be the problem? If so you will need to file for a CR1 visa.

I don't have any idea how can I explain my situation,
My relationship with my wife starts in 2013 , we met each other on Facebook as many other couples. After many chats and corresponds , we discovered that we honestly fall in love with each other and we want to spend the rest of of our life together because we simply have many things in common. My wife decided to give me a first visa in January, she spent with me and my family ten days even though she wants to stay more days but she has to come back to her kids and job as well. My wife is 2 years than me.
We firstly applied for tourist visa in March 2014, the officer told me that you're denied because you may not come back to morocco as you don't have any properties.
After six months , we decided to apply for k1 visa . We prepared everything and send them our package. My interview was scheduled last March 19th 2015. I went to AP for 6 months. My wife tries to contact with the consulate to know what's going there since they didn't ask me for more evidence. She contacted with general inspectors , her doctor and a congressman.
After a long time , I got a called from the consulate saying that I should be in the consulate 10am, 31 August. I went there yesterday. I was waiting and waiting until the officer called on me . He didn't talk with me much , he only handed me a paper marked " section 221g which prohibits the issuance of a visa to anyone whose applications doesn't comply with the provisions of the immigration and nationality Act or regulations issued pursuant thereto. The following remarks apply in your case : Returned to USCIS for reconsideration "
I am asking you if there someone who has experienced this situation before , I want your help please. Is there any possibility to make them not to send it back to USCIS .

I had my interview back in March 19th, of 2015 in Casablanca. At the time of my interview, the gentlemen that interviewed me did not ask for any additional information or explain to me the next steps I should expect.
It was then informed to my fiancée that our case was going through “Administrative processing.” She has been emailing and calling the consulate every few weeks in hopes to get more answers.
This is what our case reads when we check our visa,
Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days. Under the U.S. Immigration and Nationality Act, Immigrant Visas for "Diversity Visas" cannot be issued after September 30th of the year in which you were selected to apply for a Diversity Visa. For example, entrants into the Diversity Visa Program in Fall of 2011 were selected for Diversity Visa 2012 Program, and selectees MUST apply and receive their visa prior to September 30, 2012 otherwise they lose eligibility to receive a Diversity Immigrant Visa, regardless of additional administrative processing. In addition, please note that some immigrant visas may not be able to be issued if the annual numerical limit for that category has been reached.
My purpose of this post is to find out where our case stands, it’s become very difficult for us waiting day after day not knowing if we could get a call at any moment or if we should plan to resume my life here in Morocco for some more length of time.
I am confused as to why our case would continue to need to be processed when we provided all this information that was needed.
The officer gave me a white paper under 221g, he remarked two things on the paper 1- Admin Review 2- give back passport.Could you please give me a more general idea of where my case ? How much more time are we looking at? It has been almost 6 weeks since our interview.
I'm really happy to get some useful answers from those who have experienced such adventure esppecially in Morocco .....I thank all of you in advance,
