  1. My wife filed for me earlier this year and now our case is at the NVC. Everything was paid for and we sent the documents. However my wife is unable to work while living with me outside of the country so our source of income comes from me and my foreign business. We filled out the I-864 for her and the I-864A for me. We also included bank statements and supporting evidence for my business. But I received an email telling me that the I-864 for me the beneficiary is missing. So am I supposed to fill out the form similarly to how my wife filled hers out but instead put that I am the joint sponsor? I see in bold text on the first page that I am to submit proof to prove my citizenship if I am the sponsor which I cannot. 

    This is what the email said:

I am a successful self employed web developer and due to the nature of my work (all online), my income is not going to stop nor be interrupted once we move to the US.  Therefore we feel it is important to emphasize that my income will continue uninterrupted.

    6) We understand that at some stage, we need to provide proof that I have no criminal record in the countries I have lived in.  I have obtained these documents from the three countries I have lived in.  At what stage do we send them?

    7) Are there any other documents that we need to send to NVC apart from the printed forms and Affidavit(s) of Support?

    8) Finally, on the subject of re-establishing domicile, due to our situation where I am the one working and my wife does not work, our plan has been to return to the US together once my green card is approved, stay in an AirBNB for 2 weeks and then during those 2 weeks, rent a house etc etc etc.  We understand that in most cases, they like that the US citizen goes back ahead of the partner to sort all this out, but that just won't work for us. In lieu of that, my wife completed her voted registration in 2016, voted in the election, opened a bank account in the US, obtained authorization from her university to transfer her bachelors degree to the United States and complete her degree there. Furthermore, we have made arrangements with a local shipping company to ship our belongings to the US, have already made moves to sell both our vehicles and start selling the thigns we will not bring to the US, and have made arrangements with a Pet Travel Agent to fly our 2 cats to the US.  Would all of this be enough to show that we both intend to establish domicile?

    You sound like you are in a situation just like mine. I am 23 and my wife is 21. I own a web services company in The Bahamas and some of the services I offer are web design and development. My wife lives with me here in The Bahamas. She is an American citizen but unable to work here in The Bahamas.  We are using a joint sponsor to help us when the time comes. My business is starting to take off and I make enough to provide for us both. But even though my currency is equal to that of the U.S and that I have a job that can be done remotely, it doesn't matter... We have been married for 2 years now and it has been 8 months since she sent in the I-130 petition. However I am not at your stage yet. I can send you a link to a CR1/IR1 visa guide. It tells you everything that you need. I need to understand the domicile thing too. We do plan to move back to the U.S together. We already have things in storage including our vehicle. And at the time we would have filled out the paperwork for a home.

  3. Help Please.

    According to the uscis app, almost all of the forms sent in around the time of mine had their status updated. My filing date is May 10th. In August I requested an address change. 2 weeks later on September 12th, I got a notification saying

    "Notice Was Returned To USCIS Because The Post Office Could Not Deliver It"

    So I requested to change the address again. This time it worked. I got a notification in the mail today and it was a notice for an AR-11 form. I am confused as to what to do because my status remains the same. Yet USCIS sent me a form for AR-11. Do I have to fill this out even though I am an American citizen living abroad? Plus do I need to fill this it even though the current address is correct? I'm confused please help.

  4. My wife talked to a tier 2 officer earlier this week and explained to them the situation we are in. She requested an expedite and the Tier 2 officer even said he hoped something happened soon because of our situation. It is a lot and we do fall into about 3 of the main categories and other things as well. But we are not clear on what steps to take next. The tier 2 officer basically said that hopefully we hear something back soon. So I would like to know:
    1- How long does that usually take?
    2- We do have evidence to support the situation but who do we give it to? Right now we are waiting on the NOA2 at Nebraska and we filed to the chicago lockbox because there is no local USCIS here.
    3- If I need to send the evidence how do I go about doing this? Is there a form that should be attached to a letter including documents?

    If anyone can answer please help

  5. I see that cases that were received between March 28th - April 4th are being heavily accepted. Count the days from April 1st until the time you sent yours and you should have an idea as to when yours will be more likely to be accepted. Of course it is not 100% accurate but it gives you an idea as to when to start looking forward to hearing the good news and hopefully sooner.

  6. It's true that the people who answer the phone see what we see on the website. They give standard responses, such as the January 2nd response and 5-6 months etc. Call them back and ask them to speak to a Tier 2 supervisor - from what I've read here, they have access to a lot more information and may be able to help. Good luck!

    My wife did speak to a Tier 2 supervisor 3 times and they told her the same thing. To this day I still cannot check my online status. Tier 2 supervisors are those that schedule a time to call you, and then they would call later on to speak with you right?

  7. I truly hope so.. I was hopin the entire process would take 1 year.. Really want my husband here for Christmas.. fingers crossed.. I just worries me that people are still waiting for noa2 from last year..

    Yeah I know how you feel. My wife and I are going through the same. She is here with me outside of the U.S though. What is difficult is that she is unable to work here and cannot find employment in America without me being there to help her. I can't travel so we are stuck here and I have to provide for us. She is unable to work here and if she was able to it would only be for a few months. Nothing permanent or help her in the future.

    That is a long time when people are getting theirs in 2 weeks. There is honestly no excuse for the vast difference in time.

  8. I called them unfortunately I was told that the are still working on January 2nd files.. I was told to wait another 45 days then I can file an inquiry..

    No that is a terrible excuse. That would total about 9 months waiting just for an NOA2. You should make that request here https://egov.uscis.gov/e-request/Intro.do . If it were me I would also email a state senator to try and get that expedited. Normal processing time is only 5 months.

  9. You will notice that almost all of those approved very quickly are for beneficiaries from the Philippines. That's just how it is, I'm afraid.

    Regarding expedites for hardship, they are rarely granted but it doesn't hurt to try. If you feel your situation is causing extreme hardship, then there's nothing to stop you from asking for an expedite. But be advised that the cost of storage will not be a reason to expedite. For those of us living in different countries from our spouses we are maintaining two households - 2 rents, 2 light bills, 2 vehicles, 2 internet bills, and so on. But that is not a reason for an expedite to be granted.

    Be thankful you can spend this time with your spouse. I'd wait years for Nebraska to approve me if I could wait with my husband.

    We're both young. I actually just came back from college. I couldn't finish because of that but it is worth the time with my wife. I do love her very much :). She does miss her home country and she would love to spend that time with me there. It is terrible to be restricted like I am right now. It is not like I can go with her for the fun of it. I do not have any visa period right now. Everyone is different. I met her over 9 years ago and we first moved in 3 years ago. We have been out of the US for over 2 years now. My wife is only 21 right now so over the past 3 years it was kind of a hold on our plans for the future. It is not like we are at the age where we have that financial stability or job security yet.

  10. Hard copy isnt needed. You have the receipt number. Case tracker doesnt always update either even if you do see it online.

    Make sure the USCIS has your correct name and address. If you're still worried after your 5 months, do a service request, contact your congressman amd ombudsman.

    I have heard about that. Is the service request only available after 5 months? I cannot seem to see it anywhere. I was thinking I could do that after 3 or 4 months.

    You're within normal timeframes. The online case tracker doesnt always work. Did you speak to a tier 2?

    By Tier 2 do you mean a Tier 2 officer that will call us at a scheduled time to speak with us? That is what we did 3 times now. But why would I not be able to have any update period, no hard copy, and an invalid receipt?

    by checking the status , you're not referring to the online case check tool. are you?

  12. Unfortunately you still have quite a ways to go until this process is over. They say the entire process takes a year to complete, and that if you don't run into any problems.

    To give you some perspective, I received my NOA1 on April 13 and still haven't heard anything. There are still many cases from March and even some from February that are still waiting as well. Sadly there is no way to speed things up. It's a game of patience.

    I understand that but everyone is different. There are people that got accepted within weeks and they applied well after I did. There are also ways to expedite that I have read about.

Since then we received the email update letting us know that it was accepted. It was sent to Nebraska and we received a receipt number. We were told that the physical NOA1 would come in 7-10 days. And we would be able to check the status online between that time frame. It never worked. So we called the USCIS and they told us to wait up to 45 days. We did that. It is still not updated. So she called again and they just said it was pending. We called another time and they said that there is a lot of files being sent to Nebraska and to wait. Today is August 4th and we have been waiting ever since and it still does not work. It has almost been 3 months and it is still unable to check the status of the case. We have things in storage in America right now that we are paying for every month that we cannot use until we both go back to the U.S including a vehicle. It is ridiculous. How can we get through to someone to get his process over with already because we both know the NOA2 takes the most amount of time.
