  1. By the way, My newborn's passport was caught up this mess. I have spent 2 weeks with him since he was born because of this process. He is 9 weeks old. Today is Father's day and of course we are apart. I would love to be optimistic and get tickets for him and my fiance to come here for the fourth of July but I won't because god knows I could be waiting an additional month. I understand the anxiety and pain of eaiting but getting a ticket to time the government is not woth doing.

  2. my case was also updated today again for the third time this week only that now it says Administrative Processing now i am freaking out i am so nervous and worried what could this mean any of you guys have an answer i'm really losing it.

    Dont put too much stock in the page updating. It won't help you know when your visa is being issued. When I had access to the CEAC page it updated nearly every day. It doesn't mean they are working on your approval. When the page says ISSUED that is when everything is done.

  3. 1. You can get a SSN as soon as you arrive in the USA. If you get married before getting your SSN, then you have to wait until you receive your EAD (I think that's only the case if you're female and change your name, otherwise you can get a SSN until a couple weeks before your K-1 expires).

    2. In some states, you need more than just an ID and SSN for a DL. For instance in DC , you need to have proof you'll here beyond a certain amount of time (90 days? 6 months? I forget). The NOA1 for AOS is sufficient in that case.

    In any event, she certainly won't have to wait until she gets her GC to get a drivers license.

    If my fiance wants to change her last name to mine would it make sense to get a social before or after marriage?

  4. Hello, my husband and i had our green card interview in Oct/2014, the interview was not bad, the officer asked some questions and she said was not 100% sure. We didnt get approved but she didn't denied too. Since that i haven't heard nothing about the case, in Feb/2015 we had a Infopass and they just told us the case is pending. I was wondering if anybody had a similar case and wouldn't mind to share with me??

    why do you think they said they were unsure? were you not living with your spouse?

  5. you can file anytime, bear in mind there is a duration of processing time for the I-130 at USCIS and you control the pace at NVC for the Visa Application.

    for an I-864, you want to show a minimum of 1 year of w-2 income on a tax return above 125 percent of the poverty level for yer household size.

    Is the I-864 presented at the embassy stage? If so it would make sense for the OP to file as soon as he gets a job, because marriage visas generally take one year or longer from start to finish.

    those are just guidelines. The US Govt can use any information at its discretion as evidence by the request for a co-sponsor in the OP's case. If it were "legally" solid like you claim, there wouldn't be an issue right now, and the OP would have already been approved. Obviously they feel like it wasn't enough so I don't see how I am trolling by saying in an expensive state like NY, $40,000 for a family of 4 could be cutting it close especially if one of the dependents is a child. Remember, the guidelines demonstrate a poverty-level situation.

    That is why it is advisable to bring more than is asked. 3 year's worth of tax returns, bank statements, a letter from an employer etc. -- but despite that always have a plan B in case a sponsor is needed. Personally I didn't need one, but I asked my parents ahead of time so I wouldn't have to blindside them in case it were necessary.

    I filed 13th of June, 2104 and am still waiting for approval.

    How do you feel about this? Is it frustrating? I pretty much told my fiancee that she can come and relax and just work on English and getting acclimated to the US for the first year. I don't want her feeling stress about getting a greencard. What worries me is how she can get a license to drive while waiting.

  8. I have a question, but I'm not sure if anyone will have any insight (or that I'll be able to explain my question properly).... This backlog that's being created is probably going to be huge. But I'm wondering if its embassy specific. For example, since I think way more people apply from, say, the Philippines, will the backlog take longer to clear over there than in France? Just for example! Or is it all just one backlog regardless of embassy? Does that even make sense?

    The answer to your question is no one can accurately tell you how long your visa will be delayed.

    First, thanks to all people here in VJ, it is a really helpful resource.

    I am adjusting status from a K1 visa and I found a volunteer position at a NGO (very big in the city I live in). I go there once a week for a few hours and I translate some documents, but at the end I need to sign a paper as a "translator" stating I am fluent in both languages for each page I translate. A lot of US citizens volunteer in this NGO and with the translation task. I have signed many papers before starting in which I recognize that I am just a volunteer.

    I am not a professional translator, never worked with this before and I will never do it for a living.

    What do you guys think? Can I get in trouble with USCIS?

  10. Thank you so much for the kind words. It's comforting to hear someone else has been through the exact situation. There have been so many ups and downs, thinking he'd never be here for the birth, then thinking he would, and now we just don't know. You're absolutely right, he is still the father of our child no matter what. Yes, my family is here but of course I would prefer my fiance was here too. Thanks again.

    to be honest, I was stressed out more than my fiancee was. The fact that my fiancee was calm (whenever she felt that she was going into labor) really helped me relax. Throughout the pregnancy she told me not to worry, and to come when I can, and that her family will take care of her (which they did). Even if I were there I would have been very low on the priority list of needs lol, and my fiancee was way, way too focused on the baby to even notice anything else or care about anything else around her. I hope that your fiance is able to come, but assure him that it is not the end of the world if he is not there and that both of you will be waiting with loving arms to embrace him when he eventually does come.

We were told it would takes 2 weeks to get the visa. It's been over two weeks and now they are saying "2-3 weeks or longer due to international technical difficulties with our passport and visa systems." I have a friend of a friend who works in government and he says it could be due to the recent U.S. data security breaches and all of that. Has anyone interviewed around the same time as us and gotten their visa? Any idea on wait times or what we can do, if anything? The reason we're in a rush is because I am almost 9 months pregnant and we are trying to get my fiance here for the birth of our child. Please help!!!!

    congrats on the pregnancy. the more you stress out about this, the faster the baby will probably come before you would like him/her to. Just let things flow. You will be fine. Do you have family where you are? I missed out on the birth of first child due to this ridiculous immigration system but it was okay. 4 days after my son was born I got to see him. He is still my son and will always be. Trust me, when giving birth you will be focused on the baby and everything else. Congrats.

  13. You can apply every day if you have the money to waste!

    But if you get denied for the usual reason most are denied (214b - presumption of immigrant intent) then you're likely to get denied again if you reapply too soon if none of your circumstances are different.

    The only way to find out is to go for it.

    The refusal rate for Peru in 2013 was only 16% so you've got a reasonable chance.

    I wouldn't put much trust in the government's numbers. According to those figures only 3% of people from South Africa are denied. I know for a fact that isn't true...

  14. I feel just the same, so close to getting out of this rotten broken Immigration system, and the wave of awfulness chases you up the beach while you are desperately trying to get up the bank.

    Interview in three weeks, and stupidly I was expecting just a few days before Visa printed and can finally leave the UK, and now, who the heck knows how many weeks it will take to clear the backlog - I'm SO done with being patient, I lost all that going through the TSC and 2 RFEs for forms already sent...and now this....FFS.. I just want out of the system before anything else goes wrong with it !!

    My brother told me to get used to it. Until you have citizenship you will be dealing with immigration for one thing or another for the next 5-6 years! It sounds like torture because it is.

  15. I am SO angry about this. I have been waiting over 20 months to be with my family since I started this process. I was banking on getting my visa within the 2 weeks. Nope, I have to be out of my apartment before June and now I get to live on the street until I get my visa. Just perfect timing. AND this happened in July last year, almost exact same problem. They were back logged 200,000 visas.

    My brother works in IT and the fact that it's been down for a week now is just a serious joke. They need to get their asses in gear and hire some better people.

    You can never bank on receiving a visa until you actually have it in your hands.

    1. Electronic Visa Application Forms

    Please complete the DS-160 electronic visa application form - This confirmation page must be submitted to the Immigrant Visa Unit prior to your interview.

    What timeline window i have to submit this form i am looking for expiration date or as such guidelines ????????/

    2. Civil Documents

    The following civil documents are required. Please note that you will need to submit an English translation for all documents. You must also submit one photocopy of each original document.

    · Original birth certificates with English translation and one photocopy.

    Do i have to submit this original OR should I take During interview ?

    3. Affidavit of Support

    All K1 and K3 visa applicants must submit an Affidavit of Support (form I-134) along with the petitioner’s latest U.S. income federal tax returns. If the petitioner is unemployed or has a low income, the applicant should find an additional joint sponsor (form I-864) who will be willing to complete an I-864 Affidavit of Support. The joint sponsor will also need to submit proof of their U.S. residency status (such as a copy of their U.S. passport, naturalization certificate or green card) and their most recent federal income tax returns. The I-134 and I-864 forms can be downloaded from the USCIS website at www.uscis.gov.

    Do I have to submit this along with DS160 Confirmation page ?

    1. I assuming your are taking about the K1 visa? You need to fill ou the DS160 prior to the interview. Don't worry about deadlines. If your interview is tomorrow fill it out today. If it is in two weeks, fill it out tomorrow. There will be a confirmation page that you can print out and bring with you to the interview. Check with your embassy or a country-specific forum for details pertaining to your case.

    2. This is just a fancy way of saying bring your Original birth certificate to the interview with a copy. Check with your embassy or a country-specific forum for details pertaining to your case.

    3. Bring this to the interview. You don't have to submit a bank statement, but bring it anyways. Bring your last three year's of tax returns if you have them and a letter from your compan stating salary, position, and how long you have worked there.   17. Forms/process-wise, neither was overly difficult.

    I'd say AOS is easier. You're together, you've married your partner, and you're settling in together. It's always easier doing it together than thousands of miles apart.

    It depends on the person. Some people come to the US and have a VERY hard time adjusting to not working at all and not being able to drive at all. It depends on the personality. Personally, I think the second part would be hella easier, but there are quite a few people here that arrive and are exasperated.
