  1. Hi, I have a question. I am now going to send in the AOS package for my husband and for the Form I-864 supporting documents they are asking for the past 3 years IRS - Tax Return copies and such. Before this year I lived in Brazil for 5 years and had no income in the US for those 5 years living there. Does anyone have any advice on what I should or could send in to avoid any issues in filing the AOS for him? Can I send in an explanation letter signed and maybe some pay stubs from Brazil?

You should have been filing your taxes from your employment in Brazil unless you made less than the minimum. If you made less than the minimum, provide a letter stating that is the reason you were not required to file for those years. If you were required to file, then you need to do ASAP. Being overseas does not excuse a US Citizen from filing taxes.
