Yes i have my annotated marriage contract from PSA and i have my cemar from PSA.. what worries me is i read a lot of forums saying their k1 visa was denied becauae of no divorce in the philippines.. but my concern is both me and my ex were converted to islam before we took divorce.. donyou think embassy will honor my papers??

Embassy will honor it but as long as you're a Muslim married in a shariah law you will be fine . The biggest problem in the denial for shariah is both parties married in Catholic Church and then converted to Islam .

My issue is different from this but hoping someone can help me.  Does it need to be annotated marriage certificate before filing the I129F? The reason I am asking is because we only sent the approved annulment from the court documents (at that time not registered yet at LCR and not annoated yet due to delays with processing) and we were approved and at NVC and soon will have the interview at US embassy Manila. Will this be a problem?

You should be fine since the paper for Finality is with you . Bring it in during the interview .

  3. Hello, I just wanna ask about my status, i had my interview November 23,2016. But got 221g because they're asking for NBI with AKA. So I went to NBI the same day of my interview then sent it to 2GO. I've tracked the documents in 2GO website. It's been delivered on November 25,2016. How long do I have to wait for my visa?

Your visa might arrive in 2 weeks. My sis have that issue before and waited for 2 weeks before she got hers Congrats and good luck!

  4. I am legally married here in Philippines and we have been separated for like 8 years but annulment is really expensive.I'm planning to stay in Hongkong to get divorce..someone would help me please..

I know someone who got divorce there and how in Texas with her kids .. But she left last year . It would have been a different law this year that the embassy imposed.

  5. If you did the Sharia divorce and are not muslim then it may be a good idea to wait for the annulment to be completed and start over. Your fiance (petitioner) and you should contact USEM regarding this.

My ex and I converted to Islam 2 years ago . But if it's not honored at all I will just go to another 2-3 years of annulment process . No idea how it would appear on my MC both sides have annotation?

  6. 1. Yes. If she is a resident of Thailand she can look into the requirements for completing a divorce there. The divorce, of course, would not be accepted in the Philippines, BUT it would be accepted everywhere else in the world... and will work just fine for being free to marry in the USA if you pursue a fiancee visa, or free to marry in Thailand and complete a spousal visa to enter the USA.

    2. Answered above.

    3. Annulment in the Philippines is roughly a two year process, costing upwards of P200,000. I know of a 4-5 Filipinas, ( processing through the embassy in Manila), that had a divorce from a foreign country (where they filed for the divorce) and easily completed the visa process. Even though the divorce was not accepted in the Philippines, thus in the eyes of the government there they were still married, they had no issues with CFO either.

    4. The family visa would take upwards of 20 years.

    5. see above.

    6. Check into the divorce requirements in Thailand. ;)

I agree with the sender . I know someone cost 70k only . 200k is questionable amount .

  7. Hello,

I am writing on behalf of a friend - she is seeking visa advice and options.

My friend is a Filipina with three children (21, 18, 16). She was married in the Philippines in 1999 but separated from her husband three years ago - she has been living in Thailand since the separation. She has since moved on and has found love with an American citizen. They plan on starting their life together in the US. Unfortunately they have found that getting an annulment is proving to be a problem. She doesn't have the funds to move forward with an annulment and her ex will not agree to it.

    Her questions are:

    1. Is there any other way to get the annulment? Since she's been in Thailand, could she petition for a divorce there? And possibly get married there before moving forward with the US visa process?

    2. She read that she could get a divorce in Mexico and this is recognised. Is there any truth to this?

    3. Do you know of any success stories involving marriage annulments? Is there something she needs to do?

    4. My friend also has a sister in America - she lives a few hours from her bf. Would she have better success getting her sister to petition for her? Is there a family visa she could go to the US on?

    5. Her sister has been late on paying taxes - she is paying regularly now, but will that affect her petition?

    6. Is there anything she should do now to help her out with the visa process later on?

Thank you so much for reading. We look forward to reading your responses xxxx

Annulment will take 2 years some a year . Expensive in other lawyers but in small cities it's cheaper compared to Manila . You can pm me if you want to know .

  8. First timer here.

My interview date October 18 and was asked to provide a new CENOMAR, was then under AP.

October 28 it was then changed to ISSUED. Since then i've been calling the Embassy and the courier as well but they just kept on saying to call them back and to wait. It's been 7 working days since the day it was ISSUED but i am still waiting for it. I just want to know if there's applicant's here who experienced the same as mine.

Be patient . It takes 2-3 weeks for some to deliver the visa .
  9. Did you start the petition, I-129F process at USCIS already? If yes, you will have to do the I-129F again also, as you were not free to marry when you filed.

Our petition is already in Manila embassy and haven't paid my visa fee or do my ds-160? Should we just let it expired or have interview and then reapply ? I should have listen to my sis advice .

  10. Hey there. Were you married here in the PI or not yet? U see my situation is really complicated as i consulted with a lawyer here and they said, what is there to annul when my previous marriage has already been cancelled/terminated/annotated by the civil registrar. Going through annulment will only worsen my status because my married with my husband now will be deemed null and void. Unless and until, after the annulment we can opt to petition a court here to register our marriage.

Im still confused. USCIS should have just denied us in the first place. What hurts is, weve spent so much for the petition process as we are four beneficiaries. My husband did write the congressman and the case assistance ombudsman; but im not really sure how it would go.

I know the decision lf the consular officer is irreversible. Am wondering if its possible to get a refund? Lol...

Hi. No I never remarried in PH after divorce . Why approved and deny in the end . My ex has few kids with 3 different while were together . So shariah court is null and void and restart the petition? That sucks !

  11. Guys, my interview is in less than 24 hours. I keep reading visa denial posts... Take my advice and don't do that to yourself! I'm praying for a good outcome. I've covered all of my bases and they would have no grounds to deny us on, that I know of.. lol

Good luck ! You will be fine and be approved.

HI Seriouslady, he sent me the full docs now. but the copy from the courthouse is just a photocopy. according to some, photocopy is enough. i am so confused now and worrying coz which is which? and my fiance is confused now too coz the courthouse copy is just a photocopy.

Ask for a certified true copy with seal in it.. You're ok if you have photocopy only but in the actual interview certified true copy will do .

  12. DIVORCE DECREE FOR AS SUPPORTING DOC:

Hi guys! anyone here with same situation? Kasi ang binigay sa akin na copy ng fiance ko is photocopy lang and then 1st and last page lang ng court order.. will those docs enough? kasi diba dito sa Philippines kelangan NSO certified ang annullment decree... pls help!!! :) i will be lodging my application soon! Thank you so much!!1 :)

He should have sent the whole divorce papers . A photocopy is fine . But in the interview you should have the original copy .

  13. Hi sender . Sorry for the denial and tormenting months just to have an interview and medical . I went through same route as you . I haven't set up my interview yet at the US Embassy. Now, I'm thinking to start my annulment and maybe by the time j have an interview next year March , it's all done ? What do you think ? I have 4 kids and plan to bring the eldest but now I'm in doubt to do an interview with my daughter due to this visa denial on shariah divorce .

  14. It's 1:30 in the morning and my fiancée is in my bed! My joy can't be expressed. She flew in without any problems. I'll have her write a small blurb about POE later, but it was quick and painless at JFK airport in New York. She then flew in to San Francisco and we made it home safely. I'm exstatic!

I realize we need to do AOS after our weeding, which is very soon, but that seems like small potatoes compared to getting the K1 visa. It seems like our "visa journey" is over.

    Congrats !

  15. If your employed gross income 21K You are fine.

If your self emloyed - total income 21K You are fine.

Dont stress your self. If someone needs to stress that should be me. I dont have good tax return form 2015. I am waiting the 01/2017 to do my tax return. Since it is November I will need to wait the docs. to send them over my embassy.

Fiance will be self employed at the end of December . So just like you interview might be February .
