  1. 1) A K1 is not authorized to use an I-864 if you research the extensive details on the I-864 in the Foreign Affairs Manual, which is the instruction manual for the person evaluating your case http://www.state.gov/documents/organization/86988.pdf

See page 15 for I-134 info

    c. If you determine that any of the following types of applicants need an Affidavit of Support to meet the public charge requirement, they may use Form I-134, as they are not authorized to use Form I-864 or I-864W:

    (1) Returning resident aliens (SBs);

    (2) Diversity visa applicants (DVs); and

    (3) Fiancé(e)s (K1s or K3s)

    2) yes they will accept an I-134 from your father as sponsor in place of you. You do not even have to do one since you have no income. This has been the procedure in London for others like yourself. No problems if you have no income.

    3) The process will take however long it takes you to get the documentation they want sent back to London via the courier. Then allow perhaps two weeks for them to get back to your case and issue the visa. They don't work on it the day it arrives is what I am saying. You might have to wait a few weeks to have the visa in hand once you submit what they require.

    4) Look in the menu bar for "Reviews" and click the word "Embassy". Then in the drop down for consulate find United Kingdom. Click "find Entries". You will find hundreds of experiences. Be sure and read the K1s because the spouse visas are slightly different...they use I-864 for example and are required to have tax returns, whereas a K1 does not need a tax return if there is another suitable proof.

Thank you for your reply, I'm just hoping that since i've submitted tax return information etc. tht it wont be much of a problem. if anything i suppose we will just have to send in more paperwork.

  2. From the London Embassy website

''K and Diversity visa applicants are not required to provide an I-864 Form. However, they must show evidence that they are not likely to become public charges while in the United States. There is no set for that this evidence must take but use of the form I-134 is an efficient way to provide this information to the Consular Officer.''

I really don't know if they will deny your fiancé outright for having the wrong form, but they could put a hold on it until the correct form is sent. You might want to prepare yourself for anything - the least of which would be to get it mailed out to your fiancé asap if they request it.

Hmmm, I suppose all we can do at this point is wait and see, thanks for your help .

  3. Actually I-864 is not for K-1s, you would need your co-sponsor to fill out the I-134. Since the interview is on Monday... you're going to have some issues unless you haven't sent that and the evidence that goes with it.

I would suggest you head on over to the UK forum and have a big look over this handy guide for UK specific information and what your co-sponsor needs to send with the I-134. http://www.visajourney.com/forums/topic/474161-london-k1-a-complete-guide/

You will need the I-864s only for when your fiancé arrives in the US, you marry, and then you file to adjust status.

Thanks for your quick reply. I went to the london website and they said that they require the i-864 and that the 143 is just an efficient way to show it, ... It wasnt really explicitely stated that its needed (I hope it goes well :( ) If anything the supporting documetns are all the same!! fingers crossed

  4. Hello, I am currently a U.S. citizen and my fiance lives in England. Our visa interview is this Monday!! Needless to say I am extremely anxious and a million different things that could be possible complication run through my mind, so I'm hoping that some of you might be able to answer a few of my questions (And I yours if you are at the beginning of your K-1 journey!)

    1) I am a full-time student and have no income. My fiance works, but we are only relying on my father's income as my co-sponser to allow my fiance entrance into the U.S.--I filled out form I-864 myself and my father completed form I-864A. I then found out some people fill out the I-134 instead, however either option is fine apparently. My question is....Is it a problem that I as the main sponser have absolutely no income? My father's income is well over what the minimum requirement would be.

    2) Does the consulate in London allow this? (affidavit of support co-sponser who will basically be sponsering in place of me.(even though i filled out my own affidavit too))

    3) If we were to get denied a K1 visa, and were asked for additional documents for example, how much longer would that process be extended for.

    4) Could you share your overall experience with the interview in London (Approved/denied.....questions etc. )

Thank You all so much in advance!!!!
