  1. If you are doing F2A, are you currently mantaning your h1b status? Since you are workng, I am assuming you are.

    Now it all comes to your priority date. What is your priority date? If your PD is current, yes you can file for I-485. If your PD is months or years away, you need to wait and at that time in future, to adjust status, you still need to be in a valid status in the US. If you become out of status before your PD is current, then you need to go for consular processing through NVC.

    Is your I-130 already approved? Have you indicated on the I-130 if the beneficiary will adjust status or go for consular processing? Whatever you have indicated, they will do it accordingly. If you have chosen consular processing, then the petition will be shipped to NVC a few days after approval. If you have chosen AOS, the service center which adjudicated your case will hold the approved petition till an I-485 is filed.

    My PD is 04/2014. I-130 was approved 05/2014. I have indicated on I-130 that I am in the US and would like to go to the field office to have interview and file adjustment of Status. I hold an H1B visa and work in the US. However, they still transferred my case to NVC. I have recently received welcome letter from NVC asked to pay AOS and IV fee. This is really strange to me. I called NVC, they say if my PD is current, my interview will be scheduled in my home country.

    This is really odd to me. Please advice

    I filled mine yesterday and then got the welcome email from NVC today

    I called NVC yesterday night, asking about the welcome letter. What confused me is that he said "we are not issuing welcome letter, but immigration XXX", I forgot the exact name. But I remember I saw all the post from friends here saying that they got welcome letters from NVC. What's going on

    I logged in with my case number, it says "Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please contact the National Visa Center if you believe that you have received this message in error. "

    my PD is 2014, April. I-130 was approved by in 2014 May. I just called NVC today to ask for my case number and invoice number, but when I go to this link to check it https://ceac.state.gov/CTRAC/Invoice/Signon.aspx?node=Signin

    It says

    "This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately."

    Is it normal??

  5. Sorry, I am very confused now. Can some one explain to me what is NOA2? I have received a Action of Notice for Approval and priority date of 4/29/2014 also from California Center.

    I only have a receipt number from this I - 797, is this the same as case number? I see people are also talking about invoice number. When shall I have it?

    I see ritbiv has a later PD than me, but already got case completed. Am I missing something here?

    Shall I expect anything more now? Thanks a lot!
