All this is saying is that it is being returned to USCIS and then you can submit more proof to them. For whatever reason, the CO doesnt think USCIS should have found you eligible to begin with, USCIS will say yes. it still stands with us and return it again to Kingston or they will agree with the consulate, but it does say that you will have a chance to submit additional documents to USCIS so all hope is not lost, I'm praying for you.
I know it isn't what you were hoping for but, you still have a chance so don't give up!!

He's done nothing but regular life, work, had 2 children, raises them etc. all in Jamaica, where he was born. Nothing out of the ordinary.

I haven't told you because we don't know. None of them seem to fit. And, it doesn't specify it on the paper they gave him. He overstayed by more than 1 yr, he left on his own 15 yrs ago, he hasn't tried to enter the US at all since then unless applying for the K1 visa now is considered "trying to reenter" Im getting the impression they mean made it to the border and got caught kind of trying to re-enter but i could be wrong

So, for the ones who have said something is wrong, do you mean that they don't think he has served his whole ban? I guess employment records and what not from Jamaica would cover that. Or is it something that I'm not understanding?

I'm very confused, I understand what you are saying but, I don't think there is anything I don't know. I've known him since way back then, I know when he left, why he left etc. We are both confused. When we look up that 212(a)(9) it has (A) (B) or © also...B and C don't apply at all. A could possibly?? If you look at it sideways and use your imagination?? Don't understand why it isn't clarified on the letter they gave him.

Please don't be rude, he was never deported, he left the US on his own. We are assuming maybe they had started deportation proceedings that he didn't know about? and he was only in the US once. The CO wasn't helpful and neither was the consulate when we emailed them. The only thing they say is to refer to the letter he was given or check the USCIS website for how to apply for a waiver. I'm not trying to withhold info and any advice is appreciated.

the box checked says says 212 (a) (9) which prohibits the issuance of a visa to any alien previously removed from the US who was unlawfully present in the US or who was present in the US after a previous immigration violation.
Then at the bottom there are 2 choices, a waiver may be available thru USCIS ( this is checked) the other says no waiver

My fiance's K1 visa was denied for 212(A)(9) which is regarding a previous overstay. He would have received a 10 yr ban. He has been outside of the US for 15 yrs so the ban has been served. Do we need to show extreme hardship when filing the 601 waiver form and is there a time limit to do so? He received the denial letter on Aug 11, it is dated June 19th. (initial interview was during the time when the system was down.) The consulate was very vague and the instructions are a bit confusing. Any help would be greatly appreciated!

try changing your password to log into uscis...it automatically locks you out every so many months and you have to create a new password.

US Court records from a previous stay. They went over them during the interview but didn't keep them.

We got packet 3 via email with a sort of cover letter from the embassy. Nothing else.

My fiance had his appointment on June 19. He was told that some info couldn't be verified and they would call him to schedule another appointment when the system came back up. They kept most of his documents including passports for him and his 2 sons. They have since called and requested an additional document. We sent it and it was received. I called to ask what we do next and was told they don't need anything else right now and he doesn't need another appointment. The lady I spoke to said it needs to finish processing. Our status has been updated on 7/6 to Administrative processing. Does anyone know how to tell if it is being further reviewed or if it's been approved, how will we know? Any idea? Anyone?

Yes, you have to fill out the DS160 for each and pay the fee for each.

We scheduled our own interview when we filled out the DS160. It was done thru the embassy in Jamaica.

Mine got called back to pick up his refusal letter and passport.
