Thanks everyone, and Wow!
I guess I haven't understood the Advanced Parole concept as well as needed.
My wife has no emergency other than needing to return to
Bogota to finish her last semester of teaching in order to qualify for her pension.
All along we thought that AP would permit this.
It's really a collision of circumstances in that we met, bacame engaged, and her K-1 came through right as she was nearing the end of her teaching career.
Our visa interview was last October in Bogota, I had applied for it earlier in 2008 but looking back now we might have chosen to delay the process 6 more months in order for her to squeeze in the last semester (she arrived with her two kids on Feb. 4, 2009, we got married two weeks ago, March 23, and are now redying the 485 packet to mail out this week.)
Do you guys think AP and/or Infopass is the only chance we have of getting her back into the U.S. next December or January??

Definately ask for the advavced parole. My wife asked for it on the basis of helping her mother on her farm in nicaragua and assistimg a very sick aunt. She spent 4 months there, we had to delay the aos interview until she returned. All went well returning at the LAX immigration and the imterview a month later.

Hi VJ People,
My wife and I are in the process of putting together our AOS packet, and everything looks pretty good so far, except for the medical portion, between the Civil surgeons and some of the advice we've been reading, it's not really clear to us exactly what is required of us in our state. So, we were just going to send in the DS-3025 vaccination supplement, as is, and hope for the best, we figure the worst that can happen is that we'd just have to take an RFE, but at least that would tell us exactly what is required of us . Since I already have my girl, the delay won't be as difficult as it was when we were apart. Can anyone out there tell us if this would be a good approach to take on this? Any advice is greatly appreciated.

Yea we crossed this bridge also, we went to a gov approved dr and only had the suppliment medical form signed with not even another vaccination and all was approved at AOS interview. Mike

On Jan 6, 2009, after 148 days since receiving our NOA1, in desperation I wrote both Senator Claire McKaskil (D) and Senator Kit Bond ®. I sent the letters, which where similar (the only difference is in that to Bond, I mentioned being from the same small Missouri town), by both fax and snail mail.
Jan 7, 2009, I came home from teaching night school to an NOA2 email in my inbox, woohoo!! I felt a little silly for my letters to the senators and made a note to follow up concerning our new status.
But of couse in the new world of "After NOA2 Approval," I forgot. About a week later, I got an email from McKaskil's office saying they would look into it in 30-60 days.
On Saturday, Jan 24, 2009, I received two pieces of mail. 1) Letter from NVC and 2) Letter from Kit Bond's office.
The letter from Bond's office stated that they were happy to inquire about our case and included was the hard copy response sent by CSC USCIS. It was dated, Jan 7, 2009, and stated that our case will be with an adjudicated in 30-45 days and Happy New Year!
If I made this story too long and drawn out, sorry, I still find it intriguing. Not only did the senator's constituent office act, they acted FAST, within 24 hours of my fax, and as far as I'm concerned it worked!
We were approved 149 days after our NOA1, 1 day after sending a letter to the senator's constituent offices, and the same day as Senator Bond's office contacted USCIS.
and to think I almost didn't write a letter...

I'm new here.....but i think that this site will help me a lot with the documents my boyfriend and I need for the K-1 Visa.
He is a U.S. citizen and I'm from Peru. We have a difference in our ages...about 19 years. We just want to be together, that's all that really matter to us..but I'd read in some web pages, that a lot of times, Embassy denies the K-1 visa, because of the age difference..and I'm crazy about that because that really shouldn't matter.
We are trying to know whta is better to us.... if the K-1 visa or the K-3...
We want to make this work, but we need some good advice from you guys.
I hope you can help us.
P.S: ooohhh I forget to tell, that we met for the first time on December 31.. and it's says that we should see us at least for 2 years..so that means that we can not apply for that kind of visa??
I wpuld not worry about the age difference, my fiancee(now wife) is over 30yrs younger. We did not meet any road blocks because of that( maybe some curious looks). If you are sincere and have good documentation you will be fine.

My fiance got so excited that she opened the envelope that we weren't supposed to open. I think it was supposed to be opened by a member of US immigration at the airport..... Any advice on how we can fix this?

My fiancee opened it also and at the airport in managua she was refused a seat on her flight.she had it resealed in managua. Yes get it resealed.

So I thought that sending via Fedex was too expensive, so I used this company that delivers to all of eastern Europe, and mailed off all the papers my Fiancee needs for his interview on 1-25-07. I sent them on 1-3 and thought that 3 weeks was plenty of time... guess what, they are not there yet, even though they should have been.
My question is that what happens if they dont get to my fiance in time for the interview. I have copies of everything I sent and can email them to him to print & take to interview. Since the I-134 was notarized, will the Consulate accept a copy of it? Along with a copy of the letter from my employer & bank?
Will they accept a copy of the I-134 & supporting info? Or should we reschedule the interview and start on paperwork again?
Help, I'm freaking out!
You will need an original I134...I just went through that,,notarized and everything.

Thanks, my lawyer said I did send the original, but, i just got an email from the embassy and they said it wasn't and I have to mail a new one. There goes $60 more for express mail

My fiancee just had her interview this morning. All went well except the interviewer did not accept the I-134, and I have to send another one. The one at the interview was typed by my lawyer and notarized, as far as I know it is an original. The embassy official says that I need to send an original, in blue ink, no copies. This seems a little strange to me, just because the lawyer typed it. So, beware. One more hoop to jump through and we have our visa.

Her interview is next week in Managua, we are not sure if they require divorce papers at the interview. I sent them into USCIS to be approved...certified copies, now I wonder if I have to get another set of certified copies. Anyone have any experiences from other interviews?

Do not feel alone, I have exact same dates and responses from CSC. I feel like it always takes the longest time possible, but it is getting there........ Also, your file is probably already on its way to Managua. They have no record of my file being received at NVC using the automated service, but I called on Friday and spoke to a person and they said it is being sent to Managua soon, very good news. Yours and mine are probably in the same mail going to Nica.

Similar thing with my case, it must be that the E-mail part of the operation was down for a while and finally caught up. But, I would like to know which date is the official approval date.

Something odd. Approved on Oct12 by regular mail. Then another approval Nov.2 via Email. Snail mail has one approval date, and the Email another official date, go figure. Still no NVC file, but I figure this should kick it over there.

I was visiting my fiancee in Nicaragua this week. On Teusday I just happened to leave my cell fone on while driving with her. Phone rang..my lawyer. Approved!! And my fiancee was sitting right next to me........what a nice way to find out. Thanks for VJ forum. 5/19 to 10/12.with 2 RFE's , one was IMBRA and the other just a missing paper. Wow..finally!

Can you fill me in on the timeframe of the way things happened for you?! My fiance is from Nicaragua, also...this is the first time I see a post from someone with a Nicaraguan fiance... I'm still waiting on the NOA1...kinda sad...but happy for you guys!
It always takes about a week for them to respond to your initial application. Don't worry, I am sure your approval will take about 1/4 the time mine took. For some reason approvals before June/July or so, took a very long time, now, they are much a faster. Feel lucky. By the way, search VJ site for info on Nica. and other Nica fiancee's. There are a few of us. Talk later.or anytime.

Also May here. May 19. Waiting. I did have an extra RFE recently, which was answered 3 weeks ago. Seems chaotic at USCIS, nothing to do but wait.

Same boat here.......an RFE in Sept about a divorce paper, sent info back to them, then they sent email and website update that they received it on Oct 1. Now, silence......for 2 weeks. I think after an RFE other cases leapfrog yours. Trying to be patient here as I am sure you are.

Thank God it was only requesting copy of my divorce papers. I am so happy now. I feel much better knowing this is all it was.
Now maybe the NOA-2 will come very fast.
HI....same thing just happened to me, my lawyer forgot to put the divorce judgement into the application. On top of that, my ex had legally changed her first name, so I went yesterday to the court to get a Certified copy of the divorce decree and a copy of her name change decree. Faxed to the lawyer and hopefully they sent it to CSC today. The lawyer told me to fax him the entire divorce papers just to be sure. I am like you, hoping to get a quick approval after this.

My fiancee is in Nicaragua also, been waiting since May19, RFE July7. about 110 days. my lawyer sent off an inquiry.......lets see if anyting happens after that.

I am ready to send the I-751 form in with all the evidence I could gather. Mainly anything with both our names on bank statements etc. But, I am worried about sending our joint tax return with a below poverty amount for 2008. Does anyone know if they look at this carefully at this stage of the process? I have other evidence such as a lot of photos and affidavits from people, mutual vacations together credit card statements. I could send the taxes but crop off the dollar amounts........just a thought, Thanks
