  1. So if we file for the AOS she can leave at any time after and just go home right? I mean she can just cancel the permanent resident and go back to Italy correct? Also what happens if the baby is born here in the U.S. and we both move to Italy after? Can she spend the pregnancy here as a permanent resident with my family and I and can we leave as a family to Italy after? Will the baby have Dual Citizenship as well or paperwork for Italy?

  2. I have no idea what to do in my situation right now but maybe somebody here does. My wife came here on the K1 and we married on December the 12th, 2015. We have both been fine and ready for our lives and started doing all the paperwork for the AOS. We have all the paperwork done and I haven't sent it in because of problems at home. My wife is pregnant after we both agreed we wanted a baby. Now that she is pregnant she just wants to go home back to Italy and leave the United States. She wants me to come with her and stay in Europe with her and our baby. After many arguments I am still undecided. I have told her that if she gives me a chance here to make her happy and show her that she can like it here, I will come to Italy if she is still unhappy here. This just happened after we found out she was pregnant. She is freaking out and wants her family. I may have convinced her to stay here with me for a year but I don't know if that will happen.

    What I want to know is do I have to file the I-485 AOS with the $1000 to allow her to try for a year or can we just not file anything anymore and see what happens? If I do file can we both just cancel everything and leave the U.S.? Any help is appreciated.

  3. So we were relaxed after reading these replies but just now we read this in the FAQ's of the http://www.visajourney.com/faq/k1k2visa-aos.html#6.1.

    6.1)...How soon after we get married should we apply for Adjustment of Status?
    A..Right away, or at least right after your honeymoon. You should make every effort to get the Adjustment application filed within 90 days of the fiance(e) entering the United States as indicated on the I-94.

    Filing for Adjustment of Status within the 90 days protects your legal status. Your legal status expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS within 90 days or arriving. On the practical side, it is often difficult to arrange for the marriage, and get all the paperwork ready in time to file for AOS within 90 days. Many couples have filed for AOS a few days or weeks after the 90 day limit with no problems. Thus far, many experiences have shown this is not a major issue with local USCIS (INS) offices.

    I thought we had a little breathing room...? We still have everything done but the cover page but what does this mean if not we need to send it ASAP or she is gone?

  4. So me and my Fiance were approved and our Interview date and Medical date are on Sep, 21 2015 - Sep, 22 2015. On the 21 she has the medical exam and we have questions about the blood test. Has anyone else ever had this done and had a major phobia to it? She is terrified about the blood test and is worried about how she will react with them. Are they kind when they do it or are they just in a hurry and try to be as quick as possible? If anyone could help us and reassure us about the situation that would be great. It is a really bad phobia she has and almost impossible to control. Do they care if you cry and get upset about it?

  5. Hi everybody! Thanks in advantage for your answers. I am from Naples, Italy, and my fiance and I applied for a k1 fiance visa in May. The Uscis approved our petition on June 12th.

    Is there anybody else from Italy that is doing or did the K1 visa?I would love to know more about their experiences and their timing process.

    Anyway, i have a few questions to ask.

    Should I have my birth certificate translated from italian to english? if yes, can I do it on my own?

    About the appointment to the hospital before the interview, i must admit i am quite terrified of needles, so that won't be a pleasant experience to me.

    Does anybody know if i can eat before getting my blood taken and what will they check? is that just a HIV test? Plus, after the shot what else they will ask me to do? Xrays and what else?

  6. To avoid any RFE, if I were you, all docs are should be in original. Including, G-325A and letter intent of marry. Italy is not far. I sent my docs from Indonesia and it only took about a week until my husband received. Better well-prepared rather than get RFE and delayed all the process.

    Thank you for your quick reply. I guess we will have to mail them ASAP. I am headed to Italy in a month and staying for a month so we need everything done and sent off before I go.

  7. So my Fiance and I are starting the K1 Process and I am wondering about the Signature of some forms she had to fill out. Does she really have to mail the copy with her real Signature or can she scan it and send it to me in a .pdf file? I tried to ask on the Immigration help center but the woman I got barely even spoke English and didn't want to help at all. All she said was sir read the instructions over and over and hung up on me... All of this is kind of chaotic and it would be amazing if I didn't have to wait for the mailed copies to reach me. Thank you in advance and sorry if this was posted elsewhere.
