  1. It depends on your circumstances. If you do not have 125% of the poverty guideline you should send a co-sponsor. That's the only way you'll get approval. It's well known that they are more stringent with the AOS vs. the K-1.

    If you do meet the poverty guidelines you need to show more proof. Some things you should do:

    1. Get your tax transcripts from the last three years plus your 1040's for any year you were self employed.
    2. If you or your spouse are self employed show them each and every 2015 invoice + past 3-6 months of bank statements proving payment of some of the invoices + if you've declared small business to the state submit those documents
    3. If you or your spouse are employed by a company get a letter of employment with your annual income included + send copies of your pay stubs.
    4. Get official letters from each of your bank accounts proving your assets (have them write the current balance, average balance over the past year, and that it is your account).

    I'm not sure what you included in your initial application, but above is all that I included in mine. If you included all of the above than it's likely they simply lost parts of your application and you need to resubmit. If not, then they just need more proof.

  3. My husband and I filed AOS from K1 on October 23rd, he had his biometrics done the end of November.

    Today his I-485 case status changed to "New Card Is Being Produced. On December 20, 2015, we ordered your new card, and will mail it to the address you gave us."

    Does this mean that we were approved without an interview? Is it possible there is a glitch in the system? Our other applications, advanced parol and employment authorization aren't updated and have had the same status since biometrics.

    Thanks for your input, trying not to be too excited.

  4. Every case is unique, but it sounds like you are in a long term committed relationship. If you had only been in a relationship for a short amount of time you would be more likely to have problems. My fiancé and I have known each other for nearly five years, two years less than you, but for our recent interview at the consulate they stopped asking us any questions as soon as we told them we have been living together for the past two years.

  5. Just thought I'd give everyone here an update since I'm only a month or so behind your case.

    The Paris Consulate emailed me (didn't send anything in the mail) with instructions. They're completely different than what can be found online.

    Step One: Complete DS-160 Form (Will need case number from NVC, I had to call for mine)

    Step Two: Gather all documents (Passport, 2 Photographs, Birth Certificates for France less than 3 months old, Divorce Judgements, Death Certificates if Widowed, Police Certificates: Casier Judicaiaire Bulletin n3 less than 3 months old and from any country you lived for more than 6 months, Court and Prison Records, Deportation Papers, Statement Letter from the Petitioner and Beneficiary stating that they can and continue to intend to marry within 90 days of entering the United States, (18 and Younger) Letter of Parental Consent and Photo ID, Military Records.

    Step Three: After all the items in Step Two have been gathered fill out and sign a DS-2001 then mail it to the consulate at the address in the email they send.

    Step Four: They'll send instructions on payment and scheduling interview and the medical exam.

    The email doesn't mention anything about Form I-864 Affidavit of Support, relationship supporting evidence or proof of employment, but I'm going to assume that will come when they contact us in Step Four.

  6. The whole process isn't clear — if we have to wait for the Packet 3 or not. Since receiving my NOA2 in May, NVC hasn't contacted me once. All the information I've gathered was from calling them directly and getting my case number. Now that I have that information nothing has been said about waiting or not waiting for the next step.

    Seems like I'll by giving a call to the Paris Embassy tomorrow to find out what they want me to do. They've had our case in hand for nearly a month now.

    Good luck with the rescheduled interview Chantuff9! I'm glad that the rescheduling process went smoothly (if I don't hear anything about my package 3 I might end up following in your footsteps).

    I hope it gets resolved for you both quickly! I'm waiting to schedule my appointment at the Paris Consulate too. They got my package June 18 — we're waiting for the packet from them in the mail. How long did it take for you to get your letter in the mail to schedule your appointments and fill out the DS-160?
