  1. Things have changed.

    I got this really good job offer in Europe. My fiancé is flexible so we decided to start our lives together in Austria. We want to get married in April in the USA and travel back to Europe together. As far as I know it is legal to travel there for marriage if you go back to your home country right afterwards, right?

    Yes, nothing wrong with getting married and returning home on a tourist visa.

    Does anyone know how long it takes to receive the certified copy of the marriage certificate - if you need that information, we are in Marion county, OR. To be officially married in Europe, we need to bring a certified copy of the marriage certificate with us (with an apostille).. that's why we are worried.

    Also we have started the K1.. so we want to withdraw the K1 as we do not want to have any negative consequences from not responding after the NOA2. Is there an example letter we can use or what would you recommend us to write?

    I think we should write the reason as we one day we perhaps want to file for K3 or I-130 and then we do not want to have any problems or questions coming up.

    Do we have to send the letter to USCIS in Texas or to the California Service Center?

  2. Hi VJ Family! I have a quick, very specific question. My Australian fiancé and I have applied for a K1 visa and are in Texas Service Center purgatory. She's currently in the U.S. visiting me having entered via the Visa Waiver Program. We have lightly toyed with the idea of getting married while she's already here and adjusting for status later. I know people have strong emotions and feelings towards this, but my question is this-- if we get in that interview room and have to defend the fact that she did not enter the country under false pretenses, will the fact that we had a K1 visa application pending be held against us? Does anyone have any specific experience or insights into this? Thank you so much for your help!

    It's a route to getting a GC that is legal as others have pointed out.

    The words I highlighted in red make me concerned though. If that's your motivation then it might appear to others you are trying to fast-track the system.

    BUT - as I said, it's legal.
