Most people do what they have to do for love. I moved to Ecuador to be with my love. If you do not have the money, it is ok. Just do not be hostile to those that are willing and able to spend some extra money. Instead of bitter you can be creative. Besides, at the end it will help everybody, even the ones that did not pay the premium fee.

I was wondering if the fact that the marriage is over 2 years helps tremendously in the speed of process and if it increases the chances of approval at the consulate. I am only asking because immigration law has a lot of presumptions. Any input will be greatly appreciated. Miguel O

This is straight from IRS Publication 17:Single Your filing status is single if you are considered unmarried and you do not qualify for another filing status.You are considered unmarried on the last day of the tax year if you meet all the following tests. You file a separate return. A separate return includes a return claiming married filing separately, single, or head of household filing status.In this instance, both the letter of the law and the spirit of the law agree with my previous assertion.

The best way is married filing separate in conjunction with N.R.A. However filing Single, even though not recommendable, would not be a lie. If you do not live with your spouse for the last 6 months of the year, IRS allows you to file as single. It would allow for the Earned Income Credit to be claimed. Do not take my word for it, look it up at IRS.gov.

I am wondering if somebody can answer this question because they went through it. It seems like if NVC sends you a checklist and/or a second checklist, and it/they remain unfulfilled it gets sent to the consulate, and the consulate deals with the documentation issue. Please do not laugh or shake your head, just state whether is true or not, or at least possible. With anticipated thanks.

Does that mean you are not going to submit an I-864? You do know that you need that one. Like most things in life, it comes down to the money.
