    first of all i think you got yourself in an avalanche here, i mean what startes as missintepreted comment now seems like im a true nazi racist and proclaim i dont know what! so please liste for a second ok?

    besides the discussion of freedom of speach and stuff like that i'm trying to explain my comment further so you can either see that you really cought up on each other calling me a racist and batting me into the ground rather than thinking for yourelf. which was always happenes in a group of people versus an individuum. think for yourself, make your own opinions. but thats enough with that now.

    my comment was geard towards to things:

    - people that work in ajob get routine pretty soon. this is a human prcoess if you have to dfo the same work for some time. look at the number and you see that way more Greencards are applied for with couples from other countrys than germany. this is not racis or menat to show germany is better or anything. if you make a diagram than hispanic couples or asian couples (chinese, thai, korean, all) are higher in numbers than Germany. if you feel offended then you clearly cant draw aline between fact and emotion. and i dont say this to proove anything, i say this because of "routine" the USA is more concerned (in lack of a better word) with the high numbers. A worker that sees this will be attuned to that. human psychology. the waiting rom was basically a "nutshell" for these numbers. dont beoffended if it is the truth! im not offended that germany has a bad history with hitler all this ######! its the truth and we have to coop with it. sure it hurts but its fact. if you cannot deal with that should should not read this thread, like the discplaimer of music/movies if it offends you dont watch/listen to it.

    im not a racist, i dont think a race is better than another. period. i did not want to insult anyone for BEEING an asian/white couple or whatever, i just commented on the big pink elephant in the room so to speak. ignore it, aknowledge it it does not change its presence.

    and to end this thread hopefully on a neutral terms: if your a real couple why feel attacked when its not you im talking about? so please calm down and get back with your own business.

    thank you were glad its over and we can sleep a little more relaxed. in general i have to say it was faster than expected but with a lot of confusion from the USCIS in some situations.

    I also think that the people that helkp you here do a good job but sometimes lack a bit of faith. what i mean is i read so many times that you have to get a lawyer that its not recommended doing the AOS route instead of K1/K3 visa retunr to your country road. i know these advices are meant in good thought bur can disenrourage young couples that dont have money for a lawyer or are simply unsure. im glad we went this road and it work with no hassle to all couples out there and ponder if they wanna dare to to AOS from visitor, student ot whatever visas i can honestly say: " if your intentions were clean not to come to stay and you have a relationship that works, try it!"

    i was only commenting on the fact that it made a difference that we were different, stood out of the mass. thats all. not racist or anything, just the facts are that marriages from mexico, asia etc are more often "assembled" to get into the us than one few ones from European countrys. Just look at a waiting room or the official numbers.

    its a printed letter with the signature of the local director so nothing personal but better to have this than nothing since i did not get a stamp or anything else.

  3. Hey Folks!

    We had our Interview on October 2 at 7:50am in the Morning....in L.A! what a sleepless night. Get up at 5am..

    We were nervous as hell, coming from Germany on Visitor Visa (B2) made us believe its going to be hard. Furthermore we dont have much in chared accounts (only checkings/savings joint bank, cingular phone bill, Insurance) but we were ready. I luckly saved my return flight ticket which i held onto as a joker :)

    We waited for 3minutes or so with some other early birds and then got in. We had an middle aged black woman which did noit seem to care much. She asked us how we knew each other and when we said Internet she coulnd not believe it. That is rather the fact that people date over the net, than us actually meeting there. So we showed her the joint accounts and talked a lot (my philosophy was give em to much information so they dont wanna hear it all!). The did not even want to see our wedding album or any pics at all. When we shows her the Bills she already fondeled with my Passport (I 94 removed, Visa cross out) and said "your not visiting no more", she did not seem very interested or maybe we were so believable. Maybe me beeing a tall white Guy from Germany convinced her more than the fiftysecond Asian/white couple etc. It seeme dlike it in the waiting room because we were the only white folks there.

    The whole Interview was over in 12 Minutes, we were surprised. She said i should received my Greencard in the next 90(!!!) days and congratulated us. No Stamp but a printed Letter saying i am approved.

    Yeepeee! I am a LPR now ;)

    We hoe to visit Germany for christmas if my greencard arrives earlier. 90 days is pretty uncommon isnt it? i read more like 2 weeks here all the time. As long as its here till middle of december its ok.

    Fazit: AOS on a Visitor Visa is not more complicated, the question of me comming to marry on intention never even came up. Its all about how secure you are in your marriage, we are so they saw that. good luck folks!

    i called the national hotline and asked if AFTER i filled the I-130&I-485 to chicago AND got the NOA1 can i go to the local L.A office to get my I-765 approved faster ( i read here somewhere sometimes the same date your there!).

    they told me its impossible and everything has to befilled to chicago.

    so my question is if L.A (we live in that area)is an option or not. Andy is having a job waiting and he needs the EAD fast.

  5. If your I-130 has already been approved.... Then you do not need to file the AOS your green card is coming in the mail. You do not have to adjust status.. You are an Immigrant with a permenant resident card now... Unless you have to go to the Interview out of the U.S.. Once you do that when you come back your greencard will be in your hands... I am trying to see what you are trying to say

    nope we beginn(!) filling both right now. nothing approved yet. the guide for the I-130 says file noth together. so i dot know which application type i should mark in the I-485

    I'm filling out the I-485 now and am confused about the second part: application type.

    im NOT a K1/K3 so its not c).

    "I entered as a K-1 fiancé(e) of a United States citizen whom I married within 90 days of entry,or I am the K-2 child of such a fiancé(e). (Attach a copy of the fiancé(e) petition approvalnotice and the marriage certificate)."

    my usc wife is filing I-130 while i AM IN THE USA. so i guess im B)

    "my spouse or parent applied for adjustment of status or was granted lawful permanent residencein an immigrant visa category that allows derivative status for spouses and children"

    because a) would suggest the I-130 is already approved but we will file that as one package.

    "an immigrant petition giving me an immediately available immigrant visa number has beenapproved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile orspecial immigrant military visa petition filed with this application that will give you animmediately available visa number, if approved.)"

    please help me here urgent!

  7. Hey there!

    assembling the package at the moment for AOS. Since my Husband is in the US we need a I-130 and a I-485. We read the guides and list. one question remains: its one package which contains both pertitions, do we need to include two(!) certified marriage certificates? if its the same person processeing them it would be useless. we could put one certified copy and one normal copy in it and write see "certified". We only haveone certified copy at the moment.

    please give me feedback if they really need two.

  8. Here's what you need to do, as you had no K3 visa:

    o Tracy (USC) files the I-130. This is requesting the US government to allow you, her husband, to come into the US.

    you mean STAY in the us while pending right? because im here now :-)

    You file these two "packages" together. The I-130 is necessary for the I-485 (AOS) to go ahead because, basically, she needs to confirm this on marriage grounds.

    so literally one package but with 2 cover letters inside?

    That clear things up?

    abit, still dont know what to file to chicago and what to L.A. cant i give all the stuff to them at the apointment in L.A??

    do i have to wait for the NOA before doing I-765 or can i maybe just get the approval when im there? it said so in the guide to I-130

  9. 1. Simplest answer for that: you are now aware that if you leave the US after being married to a US citizen, you will be unable to return before the K3 process is initiated. You are better off to stay in the US with the USC (US citizen), your spouse, and change things from within the country than heading back. It could take longer than six months, and you have the grounds that this was spontaneous. Your timeline makes it sound like that. :)

    2. Yes, getting a joint bank account is a good thing to do. Then the both of you can get cheque cards for it and maybe set up a bill payment on it. Make that payment automatically every month and it will help to establish your credit rating here in the US. It will also show that it is being used regularly. Even though you are not depositing a pay cheque into the account, you are still considered to be responsible for activity in that account. That's the benefit of a joint account, among others!

    do i establish credit even i dont have a ssn yet??

    i did.im a bit confused. the I-130is filey BY tracey FOR me INSTEAD of the normal K3 visa form right?

    This highly invaluable checklist is very good for you to follow! It will give you instructions on the different things you require for your I-485 Adjustment of Status and for your wife's I-130 (Petition for an Alien Relative). I was referring to this in response to your question if you require anything special in your package because you are adjusting from inside the United States.

    since we are in L.A it seems the best to file that locally with CIS so we maybe get the EAD at once (it says small chance).

    "Some people who have filed their petitions with an CIS office can receive employment authorization that day (ex: LA), but in most cases, your spouse will get their Employment Authorization Document approved in 30 to 90 days and will be scheduled to have their picture taken and to have their EAD card issued."

    so my question: is the I-130 and the I-485 two packages? do i send the I-485 to chicago,wait for the NOA and the go to L.A and file the I-130 there? or both there? pretty confusing..

    4) Richard entered USA on a temporary Visa and the subject of his original intent never same up in the interview. It was a question I asked our attorney and she told us they wouldn't ask and they didn't.

    5) My bank put Richard on the account without an SSN. They took a copy of his passport and made him sign a form. If your bank won't do it ...shop around for a bank that will.

    ok good to hear so far that seemed to be the biggie that i have to convince them why not go back for 6 months to Germany to get K1/K3 instead of insisting on staying here. but we dont want to be apart.

    I got a normal Bank account now, now were getting a joined one. what i meant was it says proof that is beeing used. i mean, sre we can put money from tracey on it and get it used, BUT sinc ei cant work ther enot much activityfrom me on it then right?

    damn how often do we need to do this?

    I've heard from clmarsh that she wasn't asked about this; my interview isn't until the end of April and you can bet I'm fairly nervous on that point. Here's what I suggest: compile what information/evidence you can, just in case (the big one: a return plane ticket; pictures; any lease/mortgage proof; mail sent to employer that he's quitting his job, etc) that would show he has ties to Germany. You can always stick that stuff in a scrapbook if it's unneeded.

    i had a return ticket but of course i canceled it. could be a good idea to show my intention though. thank!

    Others have said they were not troubled on this point in the interview, so don't let it stress you out too much.

    No. You just need to have everything that they ask for -- look at the AOS assembly package. You'll be putting in the I-130 bundle and then the I-485 bundle; there's a nice checklist that's very handy, talking about how to assemble your photographs and order of things. I'd also suggest that you put on the cover letters, don't staple (paperclips are your friend).

    what exactly do you mean? assemble fotos? more than one coverleter?

    The EAD comes from MSC, at least Claudeth's did.

    what is SC? to many shotwords here hehe.

    How old is the biometrics? It seems that each has a different requirement. They took full prints for Claudeths AOS but only one print for the EAD.

    1st biometrics from ocotber 2005, second once, 3 days later at POE

    All in All it seems we got the main parts right :-)

    We're Andreas (GERMANY/SPOUSE) and Tracey(USC). We embark on the Road of AOS while staying in California. We married in Vegas on the 6th of march and now prepare to battle the giant.

    We searched this website , read all faq and still have some questions, please be so nice to help us getting it all right:

    1) please read timeline *g*. We're in Sylmar/Los Angeles. So our Offices are Chicago for I-485 and the Los Angeles Office for the EAD(I-765) right?

    2) When Andy got his B2 Visa he had Biometrics taken. He again had his Picture and Fingerprints taken at Columbus Airport (Port of Entry). Does he need to have a Biometrics again for AOS?

    3) Since Los Angeles allows direct filling for EAD(I-765), we DONT send it with the big package(I-485) till we get the NOA-1 and go to the local office then so its proccessed faster. correct?

    4) We know that since he entered the USA for a temporary stay we will have to convice that it was not his intent to stay (which is true) at the Interview. any special advise?

    5) since we're filling the AOS FROM the US without him leaving, he does NOT have an K1/K3 Visa, do we need to alter anything in the irst big package because of that?

    6) He does not have an SSN yet. Should we wait till the EAD(I-765) is approved to file for one? when is the best point in time?

    7) SInce we just married we're getting startet on setting up combined accounts etc.BUT since he can't work at the moment AND does not have an SSN, there is not much we can do at the moment. no credit check possible on him, no employment, etc. Any Ideas what to do?

    8) Important One at last: His B2 Visa is valid till 19. April 2006 once we filled the AOS(I-485) he is pending and legally allowed to stay in the US till the case has been decided/approved right? Just checking back :-)

    So many questions...hope you dont mind.we just dont want to spoil money or time with wrong info because our reservers are extremely low (savings, NOT monthly income, way over the 125%) and he would have a Job waiting for him once he gets the EAD.
