Not if you have a remotely competent divorce lawyer.

I'm sure a good lawyer could point to something more definitive within the US, but even the official manual the COs use before issuing the visa explicitly say it's not enforceable.

    https://fam.state.gov/fam/09fam/09fam030208.html

    (3)  (U) Use of Form I-134, Affidavit of Support:

    (a)  (U) Because INA 212(a)(4)(C) and INA 213A require the use of Form I-864 for so many classes of immigrants, the use of Form I-134, has been reduced considerably.  Nevertheless, there still are circumstances when Form I-134 will be beneficial.  This affidavit, submitted by the applicant at your request, is not legally binding on the sponsor and should not be accorded the same weight as Form I-864.  Form I-134 should be given consideration as one form of evidence, however, in conjunction with the other forms of evidence mentioned below.

    And from USCIS:

    https://www.uscis.gov/ilink/docView/AFM/HTML/AFM/0-0-0-1/0-0-0-12693/0-0-0-13496.html

"Such affidavits, although helpful in judging financial ability, are not legally binding."

Wow, you're like the best ever. Thanks :D

  2. Just now, geowriansaid:

An I-129F has nothing at all to do with financial support. The I-134 for the K-1 visa does, but it is not legally enforceable (and it probably wasn't even asked for at the interview...USEM usually doesn't request it). Without an I-864 form AOS being executed, there's no support required due to immigration.

That doesn't mean maintenance/spousal support can't be part of a divorce (just like anybody else), though.

Yeah, but I am talking about a judge that does not know that it's not valid. Is it possible that a judge my think it is?

Don't worry about her meritless accusations in the divorce petition.  She's probably trying to use them to get a green card by filing a VAWA case.  The good news is that you're going to be divorced from her soon.  And don't worry about her immigration problems.  USCIS won't tell you anything about her VAWA case.

Yeah, I just got back from court and the whole thing is reset for another date. I did find out today that she has already filled her VAWA case. I am just bummed out that this is all public record. I mean, maybe I want to be President.

  4. Just to let you guys know I have court tomorrow and I am sitting here in total shock at what this woman has said i have done to her. I can't believe this is going into a court record. I am so embarrassed, as a grown man i just feel like crying that one of my neighbors will read this in the court records and think i am this type of person. How can our own court system allow people to just write whatever they want and place it into a court record for everyone to see like this. I can't remember feeling this depressed in my entire life. I understand that she wants to stay in the US, but I have not done anything to warrant her to say these things about me. On top of that she has a Filipino friend who is lying to her in the court records to back her up. She has known this girl for only a few months and she is writing statements for her like she knows everything.   I may have to fire my lawyer and get someone with a pair of balls, if this lawyer doesn't nail this tomorrow. I was not prepared for this.

"Emotional abuse" --- Looks like she's heading for VAWA to get her green card, the old reliable for GC scammers.

Whatever you do, don't be alone with her, don't even speak to her except through your lawyer.

Did she move out on her own or did you throw her out?  If she left on her own, then she abandoned you, you have nothing to worry about.  If you threw her out, I don't know.  Every state is different.

She moved out on her own, I waited a whole year for her to move out on her own. I told her a long time ago that I was not going to sign any AOS paperwork.

She may be trying to set you up for a VAWA claim, as far as divorce is concerned that is a State issue, you do not need to know where she is to divorce her.

I have been going though all the divorce paperwork in Los Angeles and i do not see anything that says you can divorce with out the spouse.

Does anyone know where i can get more information. I am very good at understanding legal documents if i can find the documents, but at this point i am going to have to pay an attorney.

  7. I am the petitioner for a female beneficiary who has lived in the United States for over a year without filing for adjustment of status.  We were married within the 90 day period.  I told her that I would not support her because I did not think that we were compatible, so I did not want to forward with anything.  Within the one year I have asked her to leave numerous times. Currently I do not know where she is, only that she is with a girl that she met, but she’s still in the United States someplace.  I have informed immigration of the situation, but I do not know what to do in terms of getting a divorce.  She has at numerous times offered to have a child with me and then she will leave the United States which I think is immigration fraud. I almost took her up on the deal just to get rid of her and move my life forward. Can someone please tell me what to do in this situation.

She called me once and asked that i sign her AOS papers - I refused

She called me once and said that I did not cause her body hard, but emotionally harm because I said she was not a good wife

  8. Ever since i started working here i have been sending money every 1 to 2 weeks to mother, 2 sisters and 1 brother in the Philippines for utilities, tuition fees, food, and any expenses you could think of.. i told them i am not rich and have to work long hours to earn money and have my own expenses to pay for.. in Philippine culture, children are expected to send and spend money to parents and some relatives (i guess ).. sometimes i want to abandon them because i am honestly exhausted. I dont think its my responsibility to pay for their utilities especially there tuition fees when they have there own father (my step dad). My mother obliged me though and says its my duty. My full blooded siblings are here and send them money as well. I tried to set limits but they bombard my fb messenger.

How do i deal with them? i get so stressed about this. For me to be able to send money to them i have to work extra hours or sacrifice some personal expenses which i think i deserve since i worked hard..

I wish our relatives in the Philippines realize that we dont just pick up dollars in our back yard,we worked hard for it. I have to hold my pee, skip meals, sleep less hours, and get yelled and cursed by clients to be able to work. For them to demand money and get mad if you say no is disappointing.

Sometimes i want to be selfish and just forget about them but is it the right thing to do

I have read about this type of situation when i first started dating my GF 4 years ago. i told her to tell the family that we will not be sending money AT ALL. On top of that i did not even visit the parents. My GF and I said that we will visit a year after we are married because they are expecting me to bring a boat load of gifts. They think this because another family member married a Japanese man and they wore this guy out. I took a very hard line but you don't have to be as harsh, lay the law down and make a plan. My GF knows how her family is so she agrees with everything.

  9. We are having an issue setting up the interview on the https://cgifederal.secure.force.comwebsite. It has been about 28 hours since my fiancee has paid the $265 MRV fee at BPI bank. The website is giving me the following error message when entering the receipt number:

"No valid record can be found for the entered receipt number. Please validate that your receipt number is correct and that you have paid the correct amount for the visa which you are applying for."

Do you guys know if this is a common issue and is just a matter of waiting longer for the information to get updated into the website, or should I be concerned and start taking further actions at this point?

I just waited an extra day then it worked.

  10. Another thing to be aware of - you need to allow 5 to 7 days AFTER the physical exam (which takes 2 days, as mentioned above) before you can count on the information being available for access at the Embassy. You would likely have had to reschedule the Embassy Interview anyway. And don't forget to schedule the CFO. Whether it is Manila or Cebu, they are already booking into the second week of December, possibly later by now. (I haven't checked in a week.) Regarding the CFO, you can do it right away, and then get the sticker later, or wait until your fiance has the visa, and plan for the CFO after that. There is a time vs. money trade-off, as so often happens in life.

    Good luck.

PAL keeps canceling my bookings and they have increased the price of the flights twice since I have been sitting at my computer.

When I called them they told me that it's my bank, my bank said that as soon as they received the charge it was authorized then exactly 2 min later they would reverse it.

So basically all the airlines are full of sh*t right now.

I went into the Embassy system and rescheduled the interview for December 10th. Well it's been four years that i first met her i guess to add a few more weeks will not hurt.

Now that I have been sitting here for hours trying to get her on a plane I am behind in my work and really just want to go to sleep.

    Thanks for your help

  11. Good luck with getting a confirmed flight now.

Since your fiance is not from Metro Manila, she should be prepared of the traffic chaos. Here below are the road closures and re-block/ re-routing of traffic. Re-check alternate routes to St. Lukes.

    http://cnnphilippines.com/news/2015/11/15/road-closures-rerouting-schemes-number-coding-truck-ban-in-effect-APEC-summit.html

She will NOT finish her medical in one day, normally they will ask you to comeback the next day for the vaccines and results.

It seems like all the airlines are price gouging the price for a flight now is three times normal. Air Asia people just hang up on you when you ask to change the flight.

i will never use them again.

Thanks for the information, but we can't change everything for next week because we will not have time if the medical goes wrong. i am just going to fly her in ASAP so she can start the medical tomorrow morning.

  13. I just found out today that the airport in manila will be closed on November 18-19 for the APEX Summit.

I booked my fiancés flight with Air Asia for November18th about a month ago and i am just finding out today that she is going to have to leave early.

I am going to try and get her on a flight today so that she can get her medical done on the 17th and she can go back on the 20th for results.

But I am wondering if Air Asia should have done more to inform people of the canceled flights.

If we did not try to check and see if everything was correct we would not have known.

She has her interview at the Embassy on the 20th

  14. In January 2015 i strayed at the Tune Hotel in Manila for three days before going to Subic Bay. Now i can't connect them. The hotels they have in Manila are bot on the Tune Hotel website anymore. Does anyone know what happen to them? I thought the rooms are small but it was a good deal if your not staying long or on a budget.

  15. This schedule can work if your medical goes smoothly. However, there is no wiggle room in your schedule.

So basically if her medical goes right she can pick up the medical documentation the next day and be at the Embassy interview on Wednesday? It might be better i guess to get her into manila on the Wednesday of the previous week then she could start her medical on the next day and have a few days in case of problems.

  16. Hi everyone,

I was wondering if anyone could tell me if this is a good amount of time to take the medical before the interview at the Embassy in Manila.

Monday November 2nd 2015 go for medical at Saint Lukes

Wednesday November 4th 2015 Appointment at US Embassy manila

    Friday November 6th PDOS Seminar

    Thanks in advance

  17. hi, your girlfriend and i are almost in the same stage of the process.. .So, here's what i did, after calling NVC & getting my MNL#, i checked the visa status from this website:

Also, since i got my MNL# i fill out my DS-160(same website) and before i can schedule an appointment, i needed to pay first.. .Check this link for instructions: http://www.ustraveldocs.com/ph/ph-niv-visaapply.asp

    For the Medical appointment: http://www.slec.ph/

Most people say here, to not wait on the letter.. . I still wonder where mine is. I hope this post will help you, goodluck!

    Thanks for the help

This is my understanding of the next steps.

    1. Go to bank and pay visa fee

    http://www.ustraveldocs.com/ph/ph-niv-paymentinfo.asp

    2. Fill out online DS-160 and submit

    https://ceac.state.gov/GenNIV/Default.aspx

    3. Schedule appointment

    http://www.ustraveldocs.com/ph/ph-niv-appointmentschedule.asp

    4. Transmit information to SLMC

    http://www.slec.ph/us/registration/

    Just a few questions

What do you need to bring to pay the visa fee? Meaning how do they connect the payment with my case? Do they just need the MNL#?

Can I submit the DS-160 before I pay the visa fee? It seems like that is what you did.

  18. Ok i don't know what to do? I called the NVC and they told me that the documents where sent to the Embassy and that by GF should received a letter in about two weeks.

    What can i do now?

They gave me the case numbers and everything can we book appointments now?

How do you book the appointment at SLMC?

How do you book the interview appointment at the Embassy in Manila?

Do we have to wait for the letter to arrive?

I'm a little lost and the guides are just telling you what you have to do and not when and how.

    Thanks for the help

  19. There is no HIV vaccine yet.

The doctor at the medical makes the call and some of the vaccines may not be needed based on her age.

HIV and TB she would have the test.

So if she has no records is there anything she could do to prepare. She is 27 years old.
