  1. There is no technical term "legally present". Each state sets legal presence requirements for their driver's license, that they define, and each state is different. In most states, being AOS pending by itself does not satisfy the requirements.

    Yes under the state law, i need a EAD to officially renew my DL. However, they told me that while I am waiting for the official document to arrive (EAD, GC) I can get a temporary license - it's simply a sheet stapled to my old DL, that last 90-days or until my official documents arrive so that I can renew my DL. It is more like an extension rather than a renewal. It says "legally present under federal laws" rather than state law (because obviously under state law i wouldn't qualify to renew My DL) so that's why i got really confused..

    While your AOS is pending, you are authorized to be in/stay in the US. You are sort of in limbo as an adjustment applicant. You are authorized to be here, but not really under any specific legal status, such as a permanent resident.

    Yes, until a decision has been rendered on your AOS application, you are currently legally residing in the US.

  2. Please clarify a few things.

    Did you enter the US on an F-1 student visa? Did you maintain that status?

    What is your basis to adjust for a green card?

    Yes i entered US on F-1 Visa in 2010 and graduated college last year. I got married last year and filed for GC in March 2015, but then withdrew my application in January 2016. I sent a new petition in February 2016 after hiring a lawyer. So i was out-of-status in january and partly February 2016 while marrying to a US citizen.

    I filed for green card last year but them withdrew my application then filed a new one in February this year. I am waiting for my EAD to get approved and already got my fingerprint appointment almost a month ago. Here's my question: Am I "legally present" while waiting for AOS? I recently got a 90-day temporary driver license in Oregon due to my old one expiring soon. One of the requirement is to certify that i am "legally present in the U.S in accordance with federal immigration law." I checked the box and they gave me the temporary license (a yellow paper stapled to my old license) without checking any NOA letters. She said as long as I am legally present i should be fine, but if I am not then it might go against whatever i am applying for. I asked if she could elaborate further but she didn't give me any straight answer..

    In short, my question is: Am I "legally present in the U.S in accordance with federal immigration laws" while waitin for AOS? Please help!! Thank you so much!!

  4. Hi everyone, recently i got my EAD and about to start a new job soon. I already have a SSN card while being under F-1 status and worked on campus. Do i need to go to the SSN office and update them that I got my EAD? Or it does not matter and i can just wait until i get my green card and update later?

    Thank you! Actually today i just woke up with my case updated. My EAD card is being produced! The date is April 26, only 2 days after my biometrics!! My case is moving really fast. But my husband, the petitioner, also got a biometrics letter since our case falls under the Adam Walsh Act review...it's going to be a tough process.

  6. Hi everyone! I'm a March filer too, adjusting from F1 visa. Been following this thread and anxiously waiting the last few days... But here's my timeline:

    3/24/2015: send package to USCIS

    3/26/2015: package received (Thursday, so it was the longest weekend ever waiting...)

    3/31/2015: NOA1 in email and text

    4/1/2015: checks cashed

    Now more waiting...

    I'm graduating in april 25, can't wait to get my EAD and get a job!!

    I am currently filing for AOS and had an issue with my I-94. I entered US 4 years ago as a F-1 student, and just got married in Janurary. I am filing for AOS, have everything ready, but recently have an issue with my I-94.

    My correct I-94 with my correct First and Last names showed my last entry date was August 21, 2012 - it also has record of all my past travel history.

    However, last summer 2014 I travelled back home (Vietnam), and reentered the country in August 25, 2014. However, this date did not appear on my I-94 record. I called the CBP office and after they checked, they told me that my a mistake was made. They told me that it was a mistake done by the airline, as they put my middle name instead of my first name. But my passport number and DOB are still correct. They told me that it should not be a problem because the last name, passport number, and DOB are still correct, and there was nothing they could do.

    So now I end up with a I-94 that has all information (past travel history, first and last name, passport number, DOB) correct except for my last entry date, and a second one with all information correct (last name, passport number, DOB), except for my first name and no travel history (because the system treats it as a different person).

    So, my question is: will this affect my AOS process? Which control number should I include in my files? I am planning to file with my correct I-94 form (without the last entry date), and print out both the i-94 records, with a letter explaining my situation.

    Please let me know if you guys have any experience with this... Thank you so much!
