  1. I did not receive an NOA extension letter but did receive a NOA biometrics letter...Should I have received an extension letter by now? I have a receipt date of 4/15/08. Could the letter be lost in the mail? How do I travel because her green card is expired now...Any help greatly appreciated.

(copied from my response where you posted this question on the list of VSC applicants)

Hmm, that doesn't sound right. Since I never received the NOA extension letter I can't compare it, but I am pretty sure that it says that there will be a biometrics letter sent. The application requires a biometrics fee and the USCIS only keeps biometrics valid for 18 months. Would you type out exactly what it says on your extension letter? It sounds like it is a different letter than others have received and I am curious if this is a new direction now. I do know that I - and every other conditional resident that I know who has applied for the I-751 - have had to do biometrics.

The NOA extension letter is not an approval letter. It basically states that they have received your application and that your status is extended for one year while that application is being processed. You need to present the extension letter and the expired green card when returning to the US after traveling outside of the country.

  2. I never received an extension letter, but I did get a biometrics appointment notice and went to biometrics already; how can I travel...Do I need to make an infopass appointment to get a stamp and do I have enough paperwork to get this stamp?

First, you are probably running into a little delay because of the time of year. Remember, USCIS employees get vacations too, so it is logical that some things will slow down even more than usual. You should probably get something this week.

That letter will have your extension authorization on it. You can take that letter to your local USCIS office to get the stamp in your passport. It is not likely your new green card will be issued before your trip so get this done soon. Make sure to use the Infopass option.

Be patient, it's probably on its way now.

  3. First off that really bites. I am waiting for our green card and hope we do not have the same thing happen to us; however, we did get a stamp in our passport.

It is times like this that make our government look horrible and irresponsible.

I hope you have some more patience. I would contact a lawyer for their recommendations and mabye even their assistance.

  4. Hi Everyone:

This should be one of my last posts because thank God yesterday we had our interview in Tampa and it was a success. IT WAS EASY! I had a lawyer and an interpreter with my wife and myself however the interview was painless. Our interviewer from the Tampa, FL office named Donald was great. He asked us to swear to tell the truth. Asked us for identification, asked for my wifes passport. Asked her a couple of questions from the I-485 application, like are you a terrorist, involved in drugs, etc. Easy stuff you know answer no. We had a ton of paperwork and photos and he did not ask to see any of it. For some reason my lawyer filed an I-130 and his concern was this was not necessary and told my lawyer to write on a piece of paper to withdraw this petition and he would give us a stamp in my wifes passport for her green card. Said the green card should arrive in 1-2 weeks. My lawyer did have a small packet of papers assembled which she gave to the interviewer but he only briefly looked thru these and that was basically it. I hope others have it as easy. We did hold hands during the interview which I think helps. GOOD LUCK TO ALL V'JERS.
