    My wife had a conditional Greencard that had expired due to our length of stay here in the Philippines. Since, its a GreenCard with conditional (Fiance Petition) she was not qualified to file a Return Resident Visa. We were told that we needed to start all over and file a spouse petition. We have our two son's who are both American Citizen and I will be leaving the country very soon without my family. This is very difficult for all of us as I will be separated from my family until my wife get's approved for her Greencard.

    I filed a I-130 Petition at the US Embassy Manila on March 12, 2015. Does anyone know how we can expedite the process?

    - March 13 Filed DCF I-130

    - March 19 I-130 Spouse Petition APPROVED

    - March 27 Received Packet 3

    - March 27 Filled up DS-260 and Setup Appointment April 9

    - March 30 Medical Appointment St Luke

    - March 31 Medical Result

    - April 9 Final Interview - APPROVED (Thank you lord)

    That's the wrong answer for someone filing DCF in Manila. Perhaps in Germany you can wait, but in the PHL, you can prod the system a bit into action to get things moving.

    Congratulations you passed the first step.

    At this point in my journey, I starting emailing IV Manila. It looks like the email address I used is no longer being used (it's the IV Manila email that you used previously).

    I suggest using the new email that's posted on the USEM site.

    Send emails to this address fairly regularly explaining that you filed an I-130 directly with USCIS-Manila and was approved. You are now requesting the MNL Case Number. As much as you can, stick to the format as explained on this USEM website: (http://manila.usembassy.gov/wwwh3230.html)

    Visa Category I assume would be IR-1 if you've been married >2 years and Priority Date is the Date you submitted the I-130. State that you're the US Citizen Petitioner requesting your spouse's MNL Case Number.

    For me it took 2 emails and 6 working days for them to finally reply.

    Once you get the MNL Case Number, you can start filling out the DS-260, once that's done you go on and follow the rest of the instructions for the interview that I linked in my first set of posts ( http://photos.state.gov/libraries/manila/1178798/feb2015/IV%20Applicant%20Interview%20Preparation%20Instructions%20-%20English%20_February%202015_.pdf). With the MNL Case Number, you can move forward and set an appointment for an interview with the Embassy for your wife using the method listed in the instructions I linked above. And once you have the interview set, you can go ahead with scheduling her medical at SLEC.

    Just realized again that they gave you a new number to call. Any chance it's the number to IV Manila? If so, if they don't reply to your emails, try calling the number to ask if your wife's file has been sent over from USCIS-Manila and has had a MNL Case number assigned yet and if so, could they let you know what it is.

  4. Oh wow, ok so that's why this happened. As a green card holder, you're not supposed to stay outside the US for more than a year without having a reentry permit. Add to that the fact that the wife's GC expired while you were here:

    Yes, she was not supposed to stay here longer than one year but we had no plans to stay here since we came here ONLY to attend a wedding. However, she was almost 5 months pregnant and had complication traveling here in the Philippines. She had contractions and bleeding and doctor advised her to be on bed rest. Could not fly and after the baby was born, it took a year for the US Citizenship to complete for my son.

  5. Hmm, you will need to show income that'll put you over the 125% poverty level for your family size.

    If you don't have work lined up yet, you might need to get a joint sponsor, preferably a close relative with the income to put you all over the top of the income requirements.

    With God's Blessing, I recieved a job offer and will be starting on March 23. I make over 6 digits salary and that's over 125% poerty level. I just don't have 2013 and 2014 W2 since I did not work after we left the US.

    Are you filing direct from the US Embassy Manila? It's faster if the I-130 is filed via US Embassy Consular in Manila. I read some threads on this website that some are completing the process and getting approved within a 1 month and some 3 months. I was wondering if our situation would expedite the process since most I have read who completed the process in a few months have no kids and never had a Greencard.
