  1. My wife and I got married in Chile on January 28th, 2006. Immediately after that, we filed at the consulate in Santiago. She got approved for her CR1 visa in March, and arrived in the US on April 27th, 2006.

First question - I'm assuming that we can send in the I-751 form 90 days before April 27th of next year. Is that correct? The way I understand it, it's not 90 days before your marriage date, but 90 days before the date of entry to the US.

Second question - Are you supposed to send in the fingerprint cards - Form FD-258 - with the I-751 or do you just send in the I-751 and wait for further instructions from the USCIS?

    Thanks,

    Dave

  2. My wife has a CR1 visa, she arrived to the US on April 27th, 2006 from Chile. We filed directly at the consulate in Santiago. I am in the process of finding out what we have to do to lift her conditional status.

First of all, I'm assuming we have to file within 90 days of April 27th, the day she arrived here. It wouldn't be 90 days before our wedding date (January 28th, 2006), or the day she was approved (March something, 2006), correct?

Secondly, they're telling us to submit two completed fingerprint cards (Form FD-258) for applicants and dependents between the ages of 14 and 79 as well as the I-751 form. I'm a little confused about that though, because they say later in the instructions that once the I-751 form is submitted they will send you instructions on how to go about completing the fingerprint cards. So do you have to prepare the fingerprint forms before sending in the I-751 and send them in at the same time, or just send the I-751 and wait until you hear from USCIS to do the rest?

Anyone who has done this before please let me know what the process is.

  3. My wife just got approved for her CR1 visa, which will be arriving through courier to her apartment within the next 2 weeks! Then she's coming to America. We're pretty clear on everything, but there are 2 things that I was wondering:

It's cheaper to buy a round-trip ticket than a one-way. In fact, it's about $400 cheaper. So, can we buy a round-trip ticket and not use the return, or is that going to cause problems? Of course we'll shell out the additional $ for the one-way if that's the only option, but it would be nice to save some $, especially since she might not be working for a few months.

We got married in Chile, so once she's here do we have to have another civil ceremony, or is our marriage there valid in the U.S. as well? Any advice appreciated.

By the way - we did DCF at the Santiago consulate and I must say that things went really smoothly. Petition was approved on the spot and she had all of her forms and an appointment date for 2 months later by the time we left.

  4. We filed for the CR1 visa. I submitted the I-130, Affadavit of support, biographic info sheet, etc. I just wasn't sure what the difference between a CR1 and an IR1 is besides that they give you a different one based on if you've been married for less or more than 2 years. We got married in January of this year in Chile. I was in Chile with her but I had to come back to the States for work. So I guess all I have to do is get her a SS # once she gets here. I'm trying to find out right now what else she/we have to do once she gets here. Any advice is greatly appreciated.

  5. My brain hurts from reading immigration information, so I figured I'd just ask.

My wife will enter the US on a CR1 visa. We got married in January and filed in Santiago Chile. Her interview is March 21st. So I guess we'll have to file for adjustment of status, but, will she be able to work in the meantime? Does she just need her SS# or does she have to wait until the adjustment of status is completed? Thanks.

  6. My wife and I filed for a k3 in Santiago, Chile, and her interview is coming up in 2 weeks. One thing we're trying to clear up is if she can apply for a work permit now, or if we have to wait until the adjustment of status is completed. I was reading about the I-765, which we did not file at the consulate in Santiago. Can we do that now? Would it even be worth it? Any advice is greatly appreciated.
