Not sure what the exact case is - is her 10 year Greencard expiring or did she apply for removal of conditions for a marriage based 2 year Greencard? If the second, the receipt notice should have stated that it serves as an extension (how long exactly is stated on the letter) so she would be good to travel with expired Greencard and the receipt notice.

She can also make an infopass appointment at her local field office once they reopen, and ask for a I-551 stamp in her passport which will function as Greencard and is valid for I believe 1 year.

    Thanks for the advice.

She has the 10 year GC (not the 2 year marriage-based one).

I am not sure about infopass as I never used it, but USCIS website also seems to suggest making an appointment through infopass is not available now.

She is actually abroad already. But she will travel back into the states next month to finish the move-out from dorm, then come back to Asia.

  2. Hi Guys,

I am not sure if this is the right place to ask, but my sister has a pressing issue.

Her GC is expiring soon in August, but her school ends in July and will be kicked out of the room. Since we don't have immediate family in the States who would be able to accommodate her, she is planning to travel back to Asia first and move back to the U.S. later this year.

The problem is, her fingerprint appointment originally scheduled in April was cancelled due to the virus. She did receive a letter from USCIS saying that "she doesn't need to get fingerprints scanned at the office" because of the pandemic, but it doesn't state how and when she would get a new GC, either.

I just wonder if anyone has similar issues now? Expiring GC, no fingerprint appointments, and would be travelling abroad soon? What should she expect? Bring the then-will-be-expired GC along with the letter when she comes back to the States later this year and explain to the immigration officer on shore? Or did we actually miss something she should have done before leaving the country this summer?

    Thanks!

  3. You must submit the original Name change court order which will be returned to you via mail. To avoid hard time, you should give them your driver license either with old or new name, they just take a copy of your driver license. It is an easy procedure, do whatever they tell you to do.

I will use the in-person expedite service since I have an immediate trip coming up. I guess I should just bring all three (NC, court order, and DL) and see what they need in the office then?

  4. Hey guys,

Sorry if I missed posts about similar questions, but I think I will just ask here.

I finally finished my interview like two months ago and got my oath letter, for a date in late April.

I knew I probably shouldn't have done it, but I did it anyway. I completed the questionnaire on the back and checked "No" for "Since your interview, have you traveled outside the United States?"

The thing is I suddenly need to go north to Canada for a weekend before my oath, and I wonder what I should do about it?

Can I just check "Yes" instead and maybe blackened "No," and just explain to whichever officer I meet on the oath date that it's a mistake?

    Thanks for your help!!

  5. Thanks you guys. I appreciate the kind words of support.

My case update so far: I have reached out to just about every official channel possible, and gotten email responses from the Director of my field office with some mixed messages. The bottom line is, I'm stuck in background checks and until those are done, no interview and no further movement that's visible to me anyways.

So, after discussing with my lawyer, we've decided to seek the help of Court. I'm supposed to meet with him next week to give him all the documents of efforts made (infopass, senator inquiries/responses, phone call dates/times, email correspondence from/to USCIS and Ombudsman's office, etc.) and we'll file a Writ of Mandamus because the case is excessively delayed. Here's to hoping that the filing action brings about a wrap up of prolonged checks and I get an interview date, and then we play the waiting game of 120 days again (hopefully not!).

Good luck! As someone who is being held up and hung in the process for so long, I really find the system really sick.

They don't give you a timeframe, no estimate, so status bar. Pushing all the responsibilities into the so-called background check but not offering an explanation on what exactly is needed to be checked so long. It is just really disappointing. And the official channel of self-help simply puts you in a series of wait game one after another.

Please excuse all my gripes but I definitely feel you. Now back into another waiting game of oath myself, so I can totally feel it. Will pray for you to get it through soon at the same time!! Good luck!

  6. Hi Guys,

I am an applicant from April 2015, Since the discussion sort of ended there as it has been quite a while, I thought I may want to ask here.

I finally had my interview in NYC on 2/9, and was told being recommended for approval. If I didn't misunderstood my IO, I was told I could leave and just wait for notice at home. So I didn't stay in the building any longer, not something like waiting in the room for additional notice, not to mention oath letter.

Just want to check if that is a norm in NYC? that interviewees just leave and wait for mail at home? Or did I miss anything that I should have stayed there for additional notice?

    Many thanks for your help!

  7. Congrats Mia, you def. waited a long time.

I'm still waiting... sigh. I might have to file WOM if no interview by April. It's nearly a year now :o

I also submitted last April and have been waited for eight months like MiaPA. Luckily we both had our interviews eventually. Now I am waiting for oath.

One thing I noticed during my interview was that some input errors seem to have mistakenly declared my marital status as "separated" while I am actually single and never married. I don't know if it had an impact on my progress but I couldn't rule out the possibility that it may have thus slowed down my case.

What I want to say is just that I totally feel you, especially seeing more and more people advance through the process. But you are not alone. I still want to cheer you up and hope that you won't lose patience along the journey.

  8. I agree with you, this last part of the process is definitely more painful. My green card process went much smoother, I believe it took 5 months from the time I mailed my application, to being approved, the time went by so fast.

    Hi MiaPA and all,

I totally feel you and it is super painful in the unknown waiting process. After eight months of waiting, I finally got my new year present and received the notice of inline for interview. Have you got yours? Since I finally hear something about mine, I believe yours should come soon!!

But I want to ask how long it is before the actual interview date? The thing is I will be away during Asian Lunar New Year (and this year is from 2/8-2/14). I hope that mine won't be scheduled right in that timeframe.

If I received the inline notice today, will I be scheduled anywhere near then, or am I worrying too much?

  9. I sent my package in May,I had FP in June and I had my interview in Aug and I am still waiting on oath letter 6 weeks later. I am getting so frustrated so I really understand how you feel. Are you in NY,too?

Yes I am also in NYC. That's really scary to me since I applied in April and I haven't even had my interview scheduled yet.

This is really really mad threatening.

  10. Wow! That's horrible. Did you call customer service and ask to speak to a supervisor?

I did. I actually called a few times. One supervisor was nice and kind enough to help me create a service request. But the reply was simply that they regret I have to wait. This is really frustrating and what happened on me has become really abnormal, if every one of you has it being processed so fast...

  11. HELLO JUST TO LEST YOU KNOW NYC PROCCES IS REALLY FAST A LEAST THIS YEAR I SEND IN JUNE I ALREADY HAD MY INTERVIEW JUST WAITING FOR OATH LETLER IS YOU DID FPRIBT 09/25 YOU PROBABLY GET NOTIFICATION FOR INTERVIEW BY OCTOBER 25 HO-FULLY GOOD LUCK ..

But also in NYC office, I sent in my application in April and haven't been scheduled interview yet. Maybe just my bad luck.

  12. I'm in NYC too. Sent my application 8/28. Just done my Fprint today, 9/25. Now I'm so worry about the lone processing time because my GC going to expire in Feb, next year??

I am pretty sure I have seen threads about how to deal with an expiring/soon-to-expire GC. I remember there were some way you can solve it without issues. I don't have this concern so I don't remember, but you can definitely find them on VJ.

But unfortunately, I applied in April and am still waiting for my interview to come. :crying::crying::crying: They haven't scheduled anything yet so I am really worried. I hope you won't be as unlucky as I am. Good luck!

  13. I'm also in NYC I sent my pkg early May,did finger print around June 19th and I had my interview in Aug 20th. I am now waiting for oath letter. It's been almost 5 weeks so I'm having a bit of patience because I've heard the have 120 days. *sigh*

It's great at least you have your interview done. I haven't even been scheduled one yet. It shouldn't be too long a wait for you. Good luck!!! :)

  14. Hi Guys,

I looked it up on the forum for a bit but didn't find too many people discussing about NYC specifically.

I submitted my N-400 in mid April and had my fingerprint done mid May.

I understand at this point it is still within the claimed "normal processing time," but I just happen to have a few friends who applied two months after me and have either interview done or scheduled as of now. I am really worried.

I called USCIS and Senator, but they just gave me the official explanation that I need to wait.

Just wondering how's everyone's cases been going in NYC? Was it really a huge backlogged or does that mean there is really something wrong with my case? What should I do?

    Thanks,

    nycplungon

  15. bad luck.

I called USCIS today again and spoke to a tier 2. It was a super nice lady. She really seems to be in desire of helping me, but she told me the same thing that the system has been down since Monday (hmmm so it sounds worse now), and their team has very limited access.

Is it my misconception or is it true that their computer system is constantly down? I remember calling in August and someone told me a similar story. I hope it's not just their standard reply to revisiting customers. LOL

The most interesting/ironic/however-you-want-to-call-it thing is that the on-hold music I had was Everytime I Close My Eyes by Babyface.

"Girl, it's been a long, long time comin' yes it has. But I, I know that it's been worth the wait yeah"

    :blink::mellow::crying:

  16. I apologize if it seems too awkward for me to all over a sudden jump in.

I am an April applicant in NYC, and back in April thread, there are two of us also being backlogged and haven't heard anything since FP.

It has indeed been a very confusing developments to us. At least in NYC, apparently quite a few people applied in June have either done or been scheduled interviews, and I haven't. really confusing and frustrating. Wishing everyone the best.

  17. It is done and dusted.

I am an American. Can some nice person update the list please.

    Congrats!

After three calls (two of the previous calls just got disconnected mysteriously), I finally spoke to a tier two, who told me their system specifically for access to N-400 has been down for the past two days, and asked me to call back later.

Things have developed to a point (after hearing so many contradictory info from different officers and witnessing mysteries) that I started to suspect if they just try to fudge my case and respond me random stuff.

Hope not the case, but really don't know what to believe either LOL

  18. If you're both good with spending a little more money, and your cases are outside the posted processing times, the Writ is one option. Federal District judge can force the agency to wrap up whatever part of the process is causing delay, but keep a record of whatever you've done so far (call, infopass, senator correspondance, etc.) because apparently the judge has to be convinced that it's an unusual delay, and that you have tried everything possible to get results first. I'm saying this based on what i've read and found in numerous cases where there was an unusual delay.

I have contacted my senator too, and got a receipt letter acknowledging my request for intervention. They said they'll let me know within 30-60 days what they find out. Did you both get a senator's receipt letter too after submitting the request?

Yeah I would also wonder if Writ just means hiring an immigration lawyer?

The tricky thing about my case is I filed in NYC, NY, and they just keeps saying I am still in the "normal processing time."

Odd enough I just met a friend of mine, who was a citizen of a G7 country, applied in the exact same office as mine in NYC in June, two months behind me, had her interview last week. And I have yet received nothing.

I got one email from my Senator saying that my case is still in the "normal processing time," the same rhetoric USCIS has been using, so I don't know if that would work as an receipt letter. It is just so upsetting.

  19. I just heard back today also from my Senator, no news except I am stuck in a background check. I don't know what the problem is, I've never been in trouble with the law. It never took this long for a background check for my AOS, what would cause it to delay this time around? I don't get it.

Well my case seems even worse. My Senator didn't even elaborate on that. I tried to contact the second and only remaining Senator in my state today, but I guess he would give me the same response. sad.

I do suspect background check being the issue for me, which is also odd. I am single, never married. never had kids. Come here as a student and no criminal record. I didn't even run a red light. Not sure why I am stuck.

The only thing came to my suspect is my name. I have a hyphenated name (eg. Park Geun-hye. I am not Korean but just using it as an example. so Park is the Surname and Geun-hye is First Name). Somehow ever since Day 1 when I applied for the visa in the very beginning, the embassy in my home country asked us to drop the hyphen and replace it by a space, so First Name ended up being "Geun Hye" and Surname "Park."

It all worked out fine and it appears to be normal on GC that it reads Geun Hye Park, and I never had an issue however I use it ("Geun Hye", "Geunhye" or "Geun-hye" as how it writes on my passport) when crossing borders, applying for credit cards, etc. The only exception is that on my SSN card it only has "Geun Park".

Now I am just really worried if they mess up my name and thought "Hye" is the middle name and can't locate my file, and therefore just put my file aside and forgot about it. But there is also no way I can check what really happened. It really annoys me that this whole uncertainty can't be resolved.

Once again, I can't totally understand high volume leads to long wait. And I can totally buy it if everyone has to wait, and is processed by the order of case reception. But if a small number of people like us have to wait undefined extra long time, I think it's reasonable that at least we are given some sorts of explanations of what is going on and what to expect. Make us all hang here wondering is just so bad and not right.

  20. Contacted my US senator this morning to make sure they had received my privacy release I faxed in on Friday. They have received it and inquired about my case with immigration on Friday and now they have been sucked into this fantastic waiting game with me

My senator did get back to me, and they just repeated the USCIS rhetoric that I have to wait until 30 days after the processing time indicated on website, which is Jan. 24, 2015 as of now for NYC field office.

Yet at the same time people on VJ who filed after me (see May or June thread) are all getting interviews (or have it done).

This is really an upsetting process. Can't even schedule my family trip now as who knows when USCIS will schedule it. Feeling helpless and unfairly punished for no reason. I didn't even do anything wrong.

  21. Hi everyone! I was also getting worried about my interview but they sent me an email stating that they have scheduled my interview and wait for the notice in the mail. It should be here next week and I'll have it updated by then. So hopefully everybody else is on the way for their interview for those who are waiting...

Good to hear good news for you! I just checked another website in my native language and realize someone in California applied in June has done his interview last week. I am just so jealous. :cry2:

Keep my fingers crossed and hope I would get mine very very soon, too!!!

  22. Finally heard back from my US senator's office today, going to be faxing out my privacy release form today and hoping really, really bad that I will hear something from Immigration :)

I am sorry but what is the senator thing? Is that something that might help with the process and something I should do, too?

    Haven't heard anything either.

I actually went to infopass last week, in case anyone wonders.

The officer was nicer and calmer than I expected (which wass a good thing at least), but he told me my case has not arrived in NYC field office yet.:shocked::shocked:

Now I really wonder what happened? I thought most people's cases were delayed because local field office are cramped and they need time to process them. But according to my officer, my case was not there yet, which should imply it might take even longer? I asked so but he didn't reply. He just said he can send a note to the processing center for my case if I don't hear anything by November.

When I mentioned that there are quite a few people who applied after me but also got placed for interview, he just told me "they were just lying to me" and dismiss my case.

Well overall it wasn't a bad experience. At least the officer was not as rude nor mean as I expected.

But the only things I have learned is that 1) my case is still nowhere, and 2) people here on visajourney are lying (according to him).

I just hope he actually did see something and did help me pick up the case, but just didn't tell me so.
