I already know I am required to submit a statement, I guess my question is whether or not I will need a co sponsor when filing the I-864, even though I currently make enough to fulfill the income requirements, and can prove so with 6 months worth of pay stubs and a letter from my employer.

    I would love some insight/advice if anyone has had a similar experience. I was not required to file taxes for 2014 as I was a student living in the UK, not working. I am now employed and meeting the income requirement - I will submit the required statement, 6 months worth of pay stubs, and a letter from my employer instead of my 2014 tax return when we file for AOS... It doesn't state anywhere (that I have seen) that I will need a co-sponsor, but i'm worried that without my tax return, and without a co-sponsor, we will get an RFE. Has anyone been in this situation, and if so what did you need to do?

  3. Quick Q - any recent K1ers who had their i-134 accepted and followed the example form's answer for question 11? Just to give my fiancee a bit more confidence in putting what it says there!

    We did! and so did a couple other VJer's I talked too. The example form will be just fine as long as you have the supporting docs :)

  4. I believe they are only rescheduling interviews if the ds-160 was filed on or after June 9th. Otherwise, you can still attend your interview.

    Just a warning ByterMoon, you cannot get married before your visa is approved.. that will void the entire process. Your K1 would be cancelled and you would have to refile for a CR1 visa. Just want you to be careful! :)

    Hey NewKid,

    It took exactly 35 days for the NVC to receive my case and assign a case number. I too, was getting very anxious - along with a few others (some it took over 40 days to receive). CSC can be slow in sending out certain petitions to the NVC, beats me as to why. It may be there by now, with a case number assigned, even if it hasn't left for your embassy yet!

    I was hoping to get advice/experience regarding health insurance once my fiancé arrives in the states. Did many of you from the UK stay on NHS insurance (travel insurance) until you got married? Or did you sign up for a US health plan straight away?

    As I am not 26 yet, I am still on my parents health insurance plan, but am wondering if and when I should switch to my own plan so I can also cover my fiancé/husband if we wait until we are married. Thanks!

  7. We received our NOA1 on May 13, and have not been able to check the status since that point on USCIS or on the app. It just comes up with an error, which seems standard for where we are. The case was last updated on May 20th. We are waiting for the NOA2. My fiance is from Scotland; he worked here on an F1 visa and extended through an OPT for 3 years before leaving to go back to work for a few months this summer after his visa ended. I'm hoping to get NOA2 and interview complete by July and him arrive in the US by August.

    Can anyone on here please share their experience in regards to the UK Police certificate, I applied for the 10days option wanted to confirm how long they really take to reply and send back needed information and if its possible to track the progress.

    My fiancé got his today, exactly 10 days after he ordered it! We were starting to get a bit nervous too seeing as his medical is on Monday and we were cutting it pretty close! Wouldn't have been enough time to order a new one if it didn't arrive!

I have spoken to USCIS and they said there is nothing they can do until it's been 90 days and they informed us it was sent to nvc .I spoke with multiple supervisors at nvc and they told me to check with USCIS and they don't understand how they haven't got it yet. our lawyer was the one who told us to contact our congresswomen at the 56 day mark.

    I'm sorry to hear this :( It took almost 40 days for mine to reach the NVC, and many of us in the same boat only received our case number after putting in a service request. You were right to have contacted your congressman, once USCIS and NVC receive an inquiry from a congressman they have to look into your case and respond within 48 hours - so you should hear something very soon.

    If CSC doesn't have it, and NVC doesn't have it, maybe it got sent to the NRC (as happens occasionally) because someone doesn't know their alphabet and cannot distinguish a "v" from an "r." It doesn't mean your case is lost, just off track. Very frustrating, I know! Keep us updated!

  11. Hello! Its been two weeks since my petition was approved April 6. I just was wondering how long is it taking for those with NOA2 recently and had NVC process their petition? I called NVC and they haven't received mine .thanks!

    Yes, unfortunately CSC takes its time! It took me 40 days to receive my case number, I even ended up putting in a service request with the USCIS after 35 days had passed and NVC still had not received my petition. Good luck!

  12. No, no, no, no!!!! Do NOT settle for a rude tier two rep!!!! You could've initiated a service request like two weeks ago!!! Don't forget my case is ONE day behind yours and my fiance asked a rep to put in service request on the 09th!!!

    Just remember, at the end of the day, it's our lives that these reps aren't taking seriously. If we're not persistent they won't budge! I know it's tedious but you have to keep calling and getting transfered (or called back) and connected with somebody helpful!! They can't deny your request to put in a service request!!!

    That is ridiculous!!

    I absolutely agree. Please call USCIS back and speak to someone different! These people are ridiculous in that every single one of them will tell you something different! It took me 3 attempts to finally get put through to a tier 2 rep to put in a service request. My NOA2 was almost 10 days AFTER yours and the rep had no issue putting in a request for me! The person you spoke to was obviously in a bad mood and decided he wanted someone to suffer along with him.

    Don't give up, keep calling until someone helps you. I would try calling early in the day when everyone maybe isn't so tired and grumpy. Howeetest D is right, they cannot deny your request.

  13. Got off the phone with USCIS. They said they send out the approved forms to NVC immediately. The operator told us that after approval they have no jurisdiction over the forms so right now we can't do anything.

    He also told us to USCIS call back after 90 days passed and if we haven't heard anything still. This statement doesn't make sense to me after he said that USCIS doesn't have jurisdiction over this, so why would I call them back.... anyways, we'll contact the congressman on Friday...

    Is that the first time you've called USCIS? Did they put you through to a tier 2 rep? I called them 3 times within 10 minutes of each other and spoke to 3 different reps. They all gave me completely different answers!! It was SO frustrating. Finally I spoke to a rep who was willing to put me through to a tier 2 officer, and he was so helpful. Don't give up if that was the first call you made, keep calling until you get through to someone will give you a somewhat helpful answer.

  14. Wow! Smh. Just out of curiosity, how has the process been with using a lawyer? My fiancé and I were going to use one then we found this site.

    My fiancé and I hired a lawyer before we found out about this website. In hindsight, if I had known about VJ, I would not have wasted the $$$ to have a lawyer draw up the paperwork maybe a week faster than I could have done it myself. That is about as helpful as my lawyer has been. She even messed up a couple items in my initial paperwork, causing a delay in my packet being sent out. She also advised my fiancé not to attempt to come visit me, and told him most likely he would just be turned away by boarder control - which I am finding out is not the case whatsoever. Our case is pretty clear cut, I think the only time a lawyer needs to be involved is if there was some sort of issue. Maybe others have a more positive experience with their attorney. I have paid a large sum of money for "peace of mind" that is not being provided.

    In terms of not receiving a case number from the NVC, the lawyer has yet again been no help. All she could tell me is that it may take up to 8 weeks and if I don't hear anything by then I have to put in a service request. As my lawyer, you would think it would be her job to look into this matter further, chase up the NVC, possibly contact my congressman if it comes to that (it has only been 33 days for me). Maybe only the petitioner can do these things, but she technically has power of attorney and is my representative, so should be able to help me out.

    I understand everyone's frustration, all I can think is that CSC is waiting to send all our files out in bulk, and hopefully we will hear something soon!

    In the mean time I have requested information from nvcresearch@state.gov and asknvc@state.gov. My next step will be to contact a tier 2 rep at USCIS if no case number by Friday, then my congressman.
