Giving my 2 cents here: so when we were in the situation you are now, deciding if it would be better to fill the I 130 form Brazil or from the US, some very nice member sent me this thread:

It is believed to be a "expedite" process for USC petitioning forma abroad, unofficial, nobody knows if it is true or not but... well, our case was approved in one month, instead of the average 5 so.. I am glad somebody told me about it at that time, that's was I'm showing you now.

So, if I understood correctly, you are the USC (petitioner), right?
If so, this is what my husband (USC) and I did: We filled the I-130 from Brazil on March 2015, which was approved on april. We were both living and working in Brazil (he worked abroad for the last 9 years: this is important because for I864 your income from other countries are not "valid" - see the "adjusted gross income" in your IRS transcript, it's the information they ask when you file the I 864. It means that, even if he got a job the day he arrived in the US, we would need a joint sponsor, because he didnt have previous US income above the poverty line). On May, he moved to the US and stayed at his parents house while looking for a job, meanwile we were gattering documents to send to NVC (while the case was sent from USCIS to NVC, basically). When we sent the I864 for NVC (June, I believe), he sent the I864 as unemployed, and his parents filles I 864A as part of the household income (they were all living together). On July he got a job and moved to another state. Case was approved on NVC and I took the new I864 (with his new job), employment letter and everything to my interview and his father filled another I 864 as the joint sponsor (remember, my husband's past 9 years income was from outside the US, so it meant nothing here).
Another important thing that I see many many people making the same mistake: Have you filled US taxes when you were living abroad? Because even though you may not have to pay taxes (if you are already paying in the country you live in, or if you don't qualify) you must file US taxes.
So, answering your question: No, I 130 has nothing to do with supporting the imigrante, you can send it now, from Brazil and start your journey! The sooner you start, the sooner you will get your pouse in the US! The financial documento are only at NVC stage, a few (or many) months from when you send the I-130!
I know this is very confusing, it took us a while to figure out everything. Ask if you have any doubts, I may not have made myself clear. Chek our timeline, to clarify the dates.

Thanks dwheels76, I just called now, and they said, not to worry about it at this time of the process, as your case is done. I'm very thankful, and will never touch DS261 ever again!

I honestly don't know if it makes any diference t this point of the process, but I would strongly suggest that you call NVC tomorrow first thing in the morning!

I visitei my husband in the U.S. While waiting for case complete (my report is a few pages back). No problem at all. Had all documents to prove my ties w/ my country but wasn't requested. If they don't allow him to enter (seriously, based on the reports we see here it doesn't happen very much - but is a possibility so, be prepared!) I don't know exactly how it happens (I've never been denied entry) but I think - I think! - he wouldn't even pass immigration so probably not be able to see the kids (kids outside in the airport, in U.S. Territory, if somebody is not allowed to enter in U.S. Territory so..). Anyway, as far as I'm concerned, it shouldn't bring any problem to your case. The border officer wants to be sure he will go back to his country and not overstay in the U.S., so taking apartment/house lease; job letter, those things usually helps. Also, people say to take your noa1/noa2 if possible to prove your already trying to move "in legal ways", which basically means "why would I try to stay illegally?". We never know exactly what they'll ask. Better safe than sorry
We can't tell what will happen, or tell you if it's worth the risk (it's a family decision). I took the risk and it was amazing, I got to spend 5 weeks with my husband with my tourist visa and I had a CC by the time I came back. We can share our experiences and wish the best of luck!!

our case is generally much like all others here.... I am a US citizen, with two US citizen children living in the US since early august... husband stayed behind
hoping it would not take long.
Case at NVC now, Affidav received on 30 Sept, DS-260 done on 5 october and no word so far on case....
Embassy in Paris approved expedite as soon as NVC completes case.... we are certainly looking at more than another month before the interview is even scheduled...... pretty desperate.... kids miss their dad....
MY QUESTIONS:
Will it jeopardize the case in any way to try and come to visit for a month or so until new development comes, even if they do not let him in?
What can be the grounds on denying a visit to his wife and children? He just wants to wait out the process here with us, plus he would save me a bundle of money on child care which I am paying cause I have no before and after school care......
What happens if they deny entry? will he be sent back that day? will he at least get to see the kids if they are outside in the airport?

Should we risk it??? how are the odds for us?

What you heard is true. K-3 is still granted in some occasion (some countries) but for most of us, it became obsolete (what happens is that I129 is approved by the same time as I130 so they cancell the I129 and proceed with the I130 - which means CR1/IR1). Process times can vary a lot, specially depending where your I-130 petition is sent to. Our case was sent to California service center and it was approved within one month, some people wait for 6, 9, 10 months just in this first phase. It is a long and painfull process, but totally worthy!

You guys can start gathering all the necessary documents, reading about it and planning. And, specially, training your patience

Hi Everyone,
I came across this forum a little while ago while I was still researching different visas and things. I've now decided to join as plans will be underway soon! I'm from England, UK and will be applying for a CR1 Spouse Visa to join my soon to be husband in Georgia, U.S.A around January time next year. We are getting married in Gretna Green in Scotland on 29th December this year
! (As I'm sure some of the U.K/U.S couples may have already found, you and your partner have to be be together in the same place for 7 consecutive days in order to submit notice to marry in England and my partner has never visited for that long. Scotland has different rules so we are going up there for our marriage, yay!)
I am very excited to get the visa application underway once we are married as, from research, the CR1 appears to take up to 14 months to process. I've heard that the K3 is going out now because the CR1 waiting time has become shorter over the years and they would both take around the same amount of time to process anyway - could someone clarify that this is true?
Looking forward to reading about your stories and can't wait to to join you all in the waiting process. If there are a few of you out there who have CR1 approvals, could you let me know what your waiting times were like?

I tried reading through this - it's quite long! But there is a commonality here, which is that most people are from either Canada or a VWP country. But I'm interested in flying my husband out (NOT from a VWP country) for a visit (1.5 months). He already has a tourist visa. We have filed and received NOA1, but haven't gotten much farther. He is unemployed and living with his parents (so we wouldn't be able to show rental or employment letters at POE). Like everyone else on this, I'm worried about him getting through immigration. Thoughts??

Sharing a good experience:
Recently i visited my husband with my B1/B2 visa. I had previously visited the U.S. Once (long before being married) and never overstayed.
I went for 5 weeks, POE was in Miami. I took all evidence (return ticket, travel insurance, bank statement, job letter, apartment lease..) to show that I would return to my country, but it wasn't necessary.
It went exactly like that

-to visit my husband
That was that.
(Actually the officer complained of my handwriting, but that's not the point hahaha)
Go prepared to show your ties with your country, go confident! Spending some time with your partner helps a lot in this painful process. And then go back home

Did you make any kind of ceremony? Would be nice to include photos of it too

Same situation here, but I'm the beneficiary. Hubby lived in Brazil for 2 years, we are just waiting for interview now.

As BRlove said, there is an unofficial "expedite", some people filling from abroad actually have their petition approved faster, nobody knows why (and we won't complain!). We filled from Brazil and between NOA1 and NOA2 took us a bit over one month!
Read the guides, over and over again! Read, read, read, and ask all yours questions. Somebody will always be able to help!

With our I130 form and the documents, we sent, as prove of bonfire marriage: about 20 photos, plane tickets and passport stamps from the trips we made while we were dating, bank and credit card statements, apartment lease together, health insurance (together), around 4 affidavits from friends n family, and a letter explaining how we met etc

I checked the box and receivedmy SSN in less than 10 days after POE. And the day before the letter arrived in the mail, I called the SS office and they told I'd have to go there because they had nothing registered.
