    I'm not on the list yet but here is my timeline: Sent 10/22, delivered 10/24, NOA1 10/26 text and e-mail received 10/29. Check cashed 10/30. Sent to Nebraska Service Center. I am still waiting for NOA1 and extension letter

  3. Sent our package Monday Oct 22nd, it was delivered the 23rd and picked up on the 24th of October. I got my text notification on Monday the 29th. Check was cashed on the 30th. e-mail and case number online say they received my package on the 26th! Still waiting for paper NOA1 and extension letter. Do they usually come at the same time?

    My greencard expired on October 28th, and I am getting promoted to a salaried position at work in the next few weeks, so I am hoping I will have my extension letter by then to make my transfer at work go smooth! My e-mail says to contact USCIS if I have not received a paper notification by November 25th, which is one day after my anniversary :)

  4. My plan is to get it sent out tomorrow at the latest, and although it will be Friday I am still going for overnight shipping. I told my boss the situation I was in and she told me not to come in to work today and just focus on working on finding these documents. I might be able to get to some bank statements online if I can find the folder our online login is on (we usually just use the phone app but you cant download statements from it, just view them. If not, would a letter from our bank stating when we opened it together work?

     

    Why would an apology letter not make a difference if it got there late? Would buying a house and being on the move not be seen as a valid excuse?

  5. My 90 day timeframe would have been somewhere the end of July. We were in the middle of buying a house at that time, the whole month of August for us was a back and forth with the mortgage company. Our closing date got pushed back a few days and we ended closing on our house at the end of August. We used the whole month of September to move, and now we are finally settling in I just realized, I need my package made AND filed within less than 10 days from now.

    My evidence is very basic since we have yet to unpack most of our stuff and I have no idea where most of my stuff is right now. I am including the items I have listed below. My main concern right now is getting it accepted within the timeframe and not having it sent back. I understand we might get an RFE with this evidence down the line and I will have everything to prove the legitimacy of our marriage if they need more, but I just cannot find it right now.

    My two questions are: Should I add an apology letter for delayed filing just in case it makes it there too close to Oct 28th? Would they accept the reason I explained above?

    and, would this evidence be enough for the time being?

  6. So, the earliest I can file for my removal of conditions is July 30th, 2018. We are currently closing on a house and if the inspections come out positive, our closing date will be August 17th, less than 3 weeks after I can file for ROC.

    Should I just wait to file the I-751 and put my new address on there? If I do that, should I still send in a address change form for me and my USC spouse before filing, or at the time of filing?

    Or should I just send the ROC documents on my 90 day mark, July 30th and then send the address change form as soon as we close, on August 17th, because we want to make sure the ROC documents are sent out as close to the beginning of the 90 day period as possible?

    I'm a little lost!

  7. So I made a thread last week about my greencard having "Usa" as a birth country and not "Belgium".

    Since it says USA, and I wouldn't need a greencard if I was born in the USA, do you think it would pose a problem if I travelled with it?

    I didn't have an interview as I am a K1, and so I still have my EAD/AP that has the correct country of birth.

    Since our nearest USCIS office for an infopass appointment is a 6 hour drive away, I called USCIS and asked if I should get it corrected.

    She said I don't have to correct it because it was USCIS' mistake and not my own.

    She also said I could have some trouble travelling but it would make it easier on me if I just kept my EAD/AP card with me as well as my other documents so they could verify my identity.

    This is my temporary 2 year greencard, in a year and a half from now I will have to file for my 10 year one, and I will only travel once, or twice maximum, with that card..

    I asked if there was any written document they could give me as proof that I contacted them and can legally work and travel with the greencard I have right now. She said they don't have any documents like that, but I can just tell the person checking my greencard that I have called USCIS to confirm and that it was okay. (like they would believe anyone saying that without proof, right?)

    Should I call back and ask for a tier 2 officer to see if this information is correct? Is there any e-mailaddress I could contact so when they send me an e-mail back confirming I can keep this one I have proof?

    Has anyone travelled with a greencard with an error on it before, and how did it go?

    I know I can just send an I-90 and get my passport stamped but I don't have my drivers license yet, and my husband is switching shifts at work to 5 days a week, and he is out of days to take up at work. If it was closer by I could ask someone to drive me but a 6 hour drive would mean my husband as to call in sick at least one day at work, and we can only afford to do that if there is no other possible solution.

  8. I got my Greencard on Saturday.

    I was so happy this was all finally over for at least a year and a half, but then..

    The country of birth on my GC says Usa instead of Belgium (their mistake, I wrote it right on all my forms)!! So now I am stuck in this hell for a few more months...

    I am guessing atm that our best option is to make an infopass appointment to get a stamp in my passport so I can keep driving and look for a job, and then send my greencard back with a I-90 form...

    What do you guys suggest?

  9. - She will go through security and may or may not be taken aside for a more extensive interview. If she has layovers she should make sure she has plenty of time in between flights.

    - Once she gets here, get her an SSN in her maiden name. Allow at least 2 weeks after arrival though for her to be in the system.

    - Then get married within 90 days.

    - If you have some time left after getting married before your 90 days run out, go back to the SSN office to get her last name changed, if she wishes to do so.

    - At this point she can be added to your bank account (or get her own) if you wish to do so, but not all banks will allow this. My husband changed banks because his old one refused to add me to his account until I had a greencard in hand. This meant I could not do groceries when he was at work, as he could only have one card.

    - As soon as you can, but most definitely within 180 days after your I-94 expires, send the AOS package out. If you have plans to get an EAD or AP, get them at the same time. Even if you aren't sure if you need them, seeing as they are free of charge if you file together (or if you file your EAD/AP afterwards and include the NOA1 of your AOS package, they will also be free). If you file EAD and/or AP before you file for AOS you will pay quite a lot of money, not exactly sure how much but you can easily find that on the USCIS website. EAD is a work permit, AP is a travel permit. Since it's free, I suggest you just apply, as it might come in handy (if she needs to travel when a family member is sick, but not "sick enough" for emergency AP, for example, or just to go on a honeymoon abroad!)

    -For your EAD and AOS you will have to go to a USCIS office (you will get an appointment letter for this) to get fingerprints and pictures taken. You may or may not also have to go to the same, or another USCIS office, to get interviewed. Some K1 applicants, however, get their interview waived, like myself. This means you'll get approved without an interview. You'll probably have to go to an interview for your ROC afterwards, though.

    - Once your EAD/AP is approved, you can get your license if you didn't have one yet. You will get a temporary one, however, and have to go back for a permanent one once you have your greencard in hand.

    - With your EAD/AP in hand you can travel and work until your greencard gets approved.

    -Once you have your greencard in hand you can relax for about a year and a half, and then you will have to get ready to apply for ROC or removal of conditions. Your then wife's greencard is a conditional one seeing as she got here on a K1. This means you will have to get the conditions removed after 2 years. Once that is done, you will get a 10 year GC.

    In order to get helped better with future questions, however (you will most likely have more questions while filing for AOS!) :time: it helps people figure out where in the process you are, in order to give you better and more accurate advice!

  10. I see you have already filed. You will probably get it in time for Christmas though if you don't get an RFE.

    I doubt you can get it expedited unless you have specific proof of a valid reason to do so..

    I needed mine expedited because I had my wedding abroad planned, but was told by lots of people I wasn't going to get it anyways, even based on financial loss.

    It came in the mail a week early, however, so all was well. Good luck with yours, who knows, maybe someone has better news for you, I'm unsure of any extra ways around the system for military families.

Oh no, I mean there were random questions about the state too, like "What is the capital of Minnesota?" and "How fast can you drive behind a vehicle that has an orange triangle on it or how fast can said vehicle go?". Like, what? I've been driving my entire adult life and I've never needed to know how fast to drive behind an Amish buggy. The answer should be "slow enough so you don't hit them."

    We both got our Minnesota licenses the same week, my husband and I did and we didn't need all that. Only things for him were previous driver's license and greencard and for me previous driver's license, passport, and marriage certificate for different name proof.

    We did have some initial trouble in CT the year before because the testing center lady didn't want to take the stamp in the passport as a I-551. That was resolved, though, she had just never seen it.

    haha funny enough, the triangle question was on my examas well! we live in a really rural area (haven't seen many amish buggies though!) and all kinds of tractor looking vehicles drive on our roads with that triangle. Our correct answer was "25 mph or less". haha!

  12. I had those random speeds and braking distances and all as well but since I had to know much more random stuff back in Belgium it still felt really easy to me. The boy ahead of me was taking his test as well and had about half of the documents I needed with him. They needed my ead card, noa1s for the ead, the noa1 for the i485, noa2 for the ead, belgian passport, international passport, original ssn card bank statements, apartment lease, birth certificate, and the list goes on. They made me drive back home for something new twice before I could take the test. I understand, but it's still a lot, especially when afterwards they tell me it needs more inspection. All my proof was right there on their desk, in originals, so that did upset me a little.

  13. I took my multiple choice drivers test here in VA yesterday, I scored 39 out of 40, only because I clicked the wrong answer on the one I was wrong on. It was really easy but it is a headache to actually get tested. They asked me a boatload of documents and even then it took them over an hour (waiting time not included). After I passed they said I couldn't get it now because it had to go for elevated inspection to the headquarters... It's so frustrating sometimes. Although my greencard is on the way (approved a week ago) I can't get a permanent driver's license. I can only do my real driving test in January but even that one will only be valid till June and I cannot apply for a permanent one until my temporary one expires. All those extra hoops we have to take are just exhausting, I feel like a circus animal. They always find a way to make you feel like you don't belong. Anywaus, good luck on your test, it's really easy as long as you've studied! Most questions I had were exactly the same as the ones I practiced on the official dmv website, same pictures and everything!

    me n'either! never got a text or an e-mail for the update this morning either. who knows we might not get anything texted to us! As long as they keep moving forward with the card we're good! my ead/ap still says it was sent to me, no updates after that, and I got them on the 15th of september. They seem to be slacking with their updates

    How was your wedding? Did you have a good time in Belgium?

    Hey Soley, we had a blast, thanks for asking! I think I gained about 10 pounds in two weeks, eating all the food and drinking all the lipton ice tea I had missed so much :D As usual it went by way too fast, but we still enjoyed it.

    I seem to have convinced my father to visit us in the US as well, and they will be visiting us in April already, seems like we live from visit to visit anymore, there hasn't been more than 6 months in between but that's not a bad thing :)

    I'm studying for my learners permit at the moment and job hunting.

    It feels great that life can finally start! This approval was the last little push we needed, on top of the promotion my husband just got at work today. I'll have to make something festive for dinner, and cake for dessert haha. We'll celebrate with a Stella beer!

    I see your interview is coming up very soon now, how exciting!! Are you getting nervous? I know I would be! Is yours far away? I am happy we don't have one as it is 5-6 hours away, but I'm sure we won't be that lucky with the ROC!

  16. I got my RFE on Oct 3 and they received the response on Oct 5. So how many days do I have to wait to file my request?

    How many days will it take for Advance Parole?

    When you got it in the mail doesn`t matter much, it is the time in between them issuing it (it should say on your RFE paper notification) and the time they update your status to "Response to RFIE received". count how many days that was, plus 76 days.

    So if there were 15 days between them issuing it and them receiving it, you have to wait 90 days since they received your applications (received date, on your I-485 NOA1, is the date they count as day 0, the day it started). You can just google " XX days after 08/1/2016" and it will tell you exactly which date you can file one.

    But if you are not in a hurry, just wait it out. The only reason I filed is because I was only 2 weeks away from my travel abroad to have my wedding ceremony in my home country.

    It will come very soon if you sent them what they asked for in that RFIE. It will most likely get approved before you get to send your service request.

    I hate to say it but patience is a virtue!

  17. Does RFE affect Advanced Parole?

    It doesn`t directly affect your AP but it affects the time for it to be approved.

    RFE papers for the I-485 state that when you get an RFE for your Adjustment of Status, your AP and EAD will be put on hold until they receive your RFE response.

    Also, if you have an RFE for your I-485, you cannot send a service request at day 76. You will have to count how many days were in between the RFE being issued, and the new status update "response to RFE was received", and add those to the 76 days.

    So if there was 20 days between them issuing your RFE, and getting your response back at the USCIS office, you cannot file a service request until day 96 since the received date.

    I hope this makes sense.
