  1. Hello everyone,

    Thank you in advance for any responses. My wife finally got her interview scheduling letter for the Tokyo embassy in Japan. We're ecstatic, but the problem is, they listed her police document as only a copy received and so we're supposed to take the original to the interview.

    However, we sent them the original sealed police certificate, so we're not sure why they're listing it as a copy and or what we should do. We're worried we can't get another original from the police station as it's generally a once a year thing here. Should we try to contact the NVC and ask about it, or should we wait to explain at the interview?

    I want to start by saying thank you to everyone who has helped me here before. My wife and I couldn't have made it this far without everyone's friendly advice!

    So today I received what I assume to be an RFR and I was wondering if I could please get some advice interpreting it.

    Here's what it says

    "INSTRUCTIONS FOR: APPLICANT

    ______F - FINANCIAL EVIDENCE:____________________________ We reviewed your I-864, I-864EZ, I-864W or I-864A Affidavit of Support form and supporting financial documents. We found that you didn't provide all the necessary supporting documents or you had incomplete information or you missed some questions on the Affidavit of Support form(s). On the attached Affidavit of Support checklist, we have put an "X" by each item you need to correct. You must send additional financial supporting documents or complete and submit a new form with the corrections noted on the attached checklist, or both. You will need to go to the Department of State's website at http://nvc.state.gov/aosand follow the instructions for the Affidavit of Support form(s). From there, you can fill out a new form online, then print and send it to the NVC. Please read all instructions and send the necessary forms and supporting documents to the NVC. We require an Affidavit of Support form for each case regardless of your income level. Your case is on hold until you send us the items we need. When you return the documents to the NVC, please make sure that the documents are in the correct order and stapled together, as stated in the I-864 Important Notice instructions.

    Form I-864: Assessment Letter for JOINT SPONSER

    The National Visa Center (NVC) recently reviewed your I-864 Affidavit of Support form. The Affidavit of Support form had one or more sections with missing or incorrect information or was missing required supporting documents, or both. Please review the instructions below to complete a new Affidavit of Support form or to obtain the missing supporting documents. Send the corrected Affidavit of Support form or original documents that are missing to the principal applicant so he or she can take them to the immigrant visa interview. You should also send photocopies of the Affidavit of Support form to the principal applicant for each traveling family member to take to the visa interview. Failure to take the original documents and copies for each traveling family member to the visa interview can cause processing delays. The Consular Officer will review the corrected form and documents at the time of the interview.

    You do not need to contact the NVC at this time. Also, do not send an updated I-864 Affidavit of Support form or documents to the NVC. After we schedule the immigrant visa interview, we will send you an appointment letter. If you need a new I-864 Affidavit of Support form, you can find it at uscis.gov/forms. \pard[x] [x] [x] [x] [x] [x]

    You must submit the following supporting financial evidence: [x] Proof of U.S. citizenship, nationality, or Lawful Permanent Resident status (examples: a copy of your birth certificate, certificate of naturalization, certificate of citizenship, consular report of birth abroad to citizen parents, or a copy of the biographic data page of your U.S. passport)."

    It appears that they misplaced the proof of our joint Sponsor's citizenship, but I'm confused as to whether I should mail it to them or wait and bring it to the interview.

    There's a cover sheet attached, so I'm assuming they want us to mail it to be NVC, but then again, as noted above:

    "You do not need to contact the NVC at this time. Also, do not send an updated I-864 Affidavit of Support form or documents to the NVC. After we schedule the immigrant visa interview, we will send you an appointment letter.."

    Please let me know how you would interpret this and if it may just be better to mail the documents again to the NVC. We are in Japan by the way. Thank you so much for any responses.

    Thank you to everyone here for always providing your opinions and other answers, I really appreciate it.

    My wife and I are just about to send off our I-864 package, but I wanted to make one last check and ask about part 6, question 13 of the I-864.

    For the last 3 years, the total income numbers, these should match line 22 of the 1040 tax returns right?

    You should only use the "adjusted gross income" number from your 1040 if filing the 1040EZ form, is that correct?

    NLR,

    You didn't need to send 2 with the supporting documents. You should also check to see if you need any for the medical.

    They need to be US passport size as per the NVC website.

    I read on this link http://travel.state.gov/content/visas/english/immigrate/immigrant-process/documents/submit/documents-to-submit-to-nvc.htmlthat we are supposed to send 2 photographs along with the documents. Are you saying that we only need 2 for either the medical or interview? We haven't sent the documents off just yet, so there's time to put a stop to the idea if they're not required.

    I understand now about the 2x2 sizing requirements. I'm still just a little confused on how many to prepare.

    Any other responses would also be greatly appreciated! Thank you.

    I wanted to start by saying thank you to all of the people on this forum. The information here is so helpful!

    My wife and I have been able to pay the AOS and IV fees, and we've submitted her DS-260 online. The next step is to ship off the documents. I just two quick questions if I may:

    1 - the document checklist shows that two photos of the applicant (my wife) are required, can these be the same size as the ones that we submitted with the IV-130?

    2 - after we submitted the DS-260 online it said "remember to bring two photos to the interview..." among other things. Does that mean that we need 4 photos in total? 2 to go with the supporting documents, and an additional 2 to be submitted at the time of interview?

    My wife and I are currently dealing with the NVC center and we're just a bit lost as to what we're supposed to do next.We would really appreciate any comments/answers.

    1) We selected an Agent, paid the AOS fee, but we cannot access the DS-261 form or pay the IV application fee (it hasn't shown up on our account as payable yet.) Are we stuck twiddling our thumbs at this point? Should we send the AOS along with the supporting financial documents, even though we haven't completed the DS form or paid the IV fee yet?

    2) When do you actually send the supporting civil documents? I.e. the applicant's birth certificate, police check etc. On some guides I have read you put everything in one big package and send it together with the supporting financial documents. Other websites seem to suggest that this step comes after submitting the AOS/financial documents, meaning that you would send two packages to NVC - one for financial documents, and one later for the supporting civil documents. Is this correct? Could someone please tell me the usual order?

    One more question if I may - I will be the primary sponsor for my wife, and my father will be our joint sponsor since my income will not be enough alone.

    If my thinking is correct then we need to file only two documents:

    I-864 (From me, the primary sponsor)

    I-864 (From my father, the joint sponsor.)

    Is this correct? Is there a point to the I-864A form? Are we supposed to use that?

    I am an American citizen living in Japan with my Japanese wife. We applied for a CR-1 visa using the I-130 form and we recently received the welcome letter from NVC. I am honestly confused though about what I should do with the I-864.

    Here's the conundrum that I'm struggling with: my current income satisfies the 125% of federal poverty guidelines requirement, and the last 3 years of tax returns prove that too. But I will technicially become unemployed in April of next year when I go back to America (hopefully) with my wife together. I know at some point that I will have to explain that I am planning on going back next year, in order to "re-establish" permanent domicile, so I'm worried that some eyebrows will be raised.

    My parents are willing to be joint sponsers, but the question is, do I file the affidavit now as is and perhaps explain my circumstances in a letter at the interview stage, i.e. cross that bridge when you come to it, or do I attempt to file for joint sponsership early on, in order to prevent any possible delays? Can I even file for joint sponsership if my current income exceeds the poverty guidelines?

    I would appreciate any responses!! Thank you very much in advance.

  9. Hello all and thank you for the responses!! I understand what to do now, so thank you.

    I have two more questions if I may:

    1) For #22 on the I-130 form: "Complete the information below if your relative is staying in the United States..." since we are both living in Japan, I think we should we write N/A here, but my question is, for the part next to that box: "If your relative is not eligible for adjustment of status, he or she will apply for visa abroad at the American consolute post in..." should we write Tokyo, Japan? Sorry if that's confusing but I hope that it makes sense.

    2) Regarding the G325A - employment for last 5 years. My wife's contract with the public school she's employed with expires at the end of March and her next school starts the first of April. We want to finish assembling the package and send off everything probably about March 20th or so.... Would it be better to just go ahead and list her next school as "Present?" She's already had her interview and been accepted after all. Please let me know what you think.

    I'm currently trying to get a CR-1 visa for my Japanese wife. We're both living and working in Japan right now and we're getting the I-130 package together.

    I just had a quick question: For i-130, section B (Information about you), #2, address - should I list my permanent address back in the states (where my family excluding me lives,) or should I list where I'm currently living and working with my wife now (Japan)?

    I read that some people listed their address back home, even when living abroad, because it looks better for establishing domicile status, while others disagreed. I think it would look confusing too if I listed my U.S. address in #2, and then in #21 (last address of where you lived with your spouse) to list another different address (while indicating "from xx to present".)

    Could I have some more opinions on this please?
