  1. My husband is petitioning his mother...

Today I get this letter from NVC:

“The Immigration and Nationality Act (INA) does not allow derivative status to family members of immediate relatives. IR1, CR1, CR2, IR2, and IR5 classifications are immediate relative visa categories.

This means that a spouse, unmarried child under the age of 21 and a parent of a U.S.

citizen require their own individual petition in order to immigrate to the U.S.”

What does it mean? But we already gave NVC case number. Enlighten us please. Thanks.

  2. Yes they can still apply. I had only been dating my fiance for about a month after we fell and love and decided to get engaged. Process is going ahead so far! Good luck! Just as long as they can provide pictures, evidence of their relationship ect. :)

Thanks! I'll let her know.. I'm not so familiar. In my case we hire lawyer to do the process..

  3. We're in North Carolina. In our case, we really needed the SSN to be able to start my husband's driver's license process and to get on my lease. I would keep calling your local office where you applied every week to check the status, and if it's been 4 weeks, involve your congressman.

Okay, I'll follow up next week then. Thanks?

  4. The same thing happened to us when we went in to apply for our SSN the first time right after marriage on a K1 visa. They said it would take 4 weeks, but it ended up taking 6.5 weeks and a push via our congressman.

Really?what state? what should we do then?

  5. I went to SSA to get SSN cause I already received my green card.. But they gave me a letter saying they need to verify my documents and will take about 4 weeks because the officers says when she's checking on the computer my Lastname was not change to my married name yet she said the immigration should it, but why is it on my greencard my Lastname already change to married name I called USCIS according to representative whatever is in the card that's what on their file. So I really need to wait for 4 weeks for their mail or notification? I am worried cause my husband want to apply for Income Tax he needs my SSN. Thanks

  6. You shold apply for the SS number now, but must wait for the EAD to be eligible to work.

So I can go to their office without the EAD but still not eligible to work? If I'll apply now then later on I receive my EAD what should I do then? Go to their office again?

  7. I'm filling up my g-325a form, questions like Applicant's residence last five years and another question Applicant's address outside US of more than a year. If I already listed it from the first question can i just leave it blank or should I write N/A or None? Same as Applicant's employment last five years.Thank you in advance.

  8. K-1 is your current status.

While trying to answer question I'm also searching for some sample wherein it made me more confused.. Since I'm married and I'll be using my spouse name I should write my spouse family name for the question 1. FULL NAME ? and my middle name would be my family name before marriage ? How bout the OTHER NAME USE (INCLUDING MAIDEN).

    Thanks for helping.

  9. You need to file the I-765 with your Adjustment of Status. You are no longer eligible to file based on your K-1 status, since your I-94 is expired.

When filing with your AOS, you are category C 9 -- Adjustment Applicant.

Refer to page 5, number 7.A of the I-765 instructions: http://www.uscis.gov/sites/default/files/files/form/i-765instr.

Thanks you, one more thing do you know what should I write from the question Current USCIS Status? since my 1-94 expired.

You can refer to example forms for guidance also.

    Thank you
