  1. Hello everyone,

    just recently a friend who has a temporary green card with removal of conditions in july 2015, has taken the courage to tell me she and her kids are in an abusive relationship. I know she has to file a separate I751 and not jointly with her husband, but what's more important what are the steps she needs to take to keep herself and more importantly the kids safe and also start building proofs for her case to be approved by uscis. Is it by restraining order?She is afraid to leave the home or the kids and can't go back to her country. She wants to stay here in the US.

    Any help is appreciated.

  2. Hi there,

    Living overseas on military or government orders is just like living in the States. Your APO/FPO address is your mailing address and that's where everything will be sent to. Since your two-year greencard is expiring in May 2009, you can start applying for your removal in Feb 2009. There are special instructions on the I-751 for military/government personnel living overseas. For example, instead of having a biometrics appointment you mail in passport-style pictures and a fingerprint card that you get from the MPs or the Security Office (usually same building as housing, finance, transportion office... on the military post). On the I-751 your write in big letters 'military overseas', so they know right away. I think this is even written in the instruction. So don't worry, you are just fine.

    I am going through the same thing right now. We moved to Germany on military orders in August 2006 and I applied for my removal of conditions in July 2007. You can check out my timeline.

    Thank you so much, you gave me the info I just needed! Actually afterwards, I found it on the I-751 instructions, but it wasn't specifying anything about the biometrics appointment. I feel a lot better now. Thanks again!

    My 2 yr GC will expire in may 09 and my husband and I just left the US cause he got military orders overseas for the next 3 years. I know I cannot apply to remove the conditions on my GC while being outside of the US but I don't know what to do if there's a form I should send or inform the USCIS about our transfer so that I don't loose the permanent residency in the US.

    these questions are addressed mainly to all VisaJourney people, who had

    lately or will be having soon an interview in Naples (Italy), my question

    are as follows:

    have you had to wait more than 2/3 months in order to get a scheduled

    appointment when you sent back to them the check list by fax?

    were you advised by mail when the date for the interview was set, or they called you,

    or you had to call them to find out the date of the interview?

    Hi! nothing like that, I sent the fax friday afternoon and I got a phone call today on my cell, to which I didn't answer but they had left a message on the answering machine saying they had scheduled the interview and also they had sent me an email confirming that. I am supposed to print that email and take it with me to the interview. It all happened real quick after we got the approval. I admit I have sent a couple of emails to them asking them to send the packet 3 by email cause I wanted to speed everything up and they replied the next day about it. I really can't complain so far.

  5. Hi everybody. I just registered. My fiancee lives in Russia. She's employed and pretty much financially independant. But occasionally I send her money. But so far, the only way to do this is to wire her the money through Western Union. They charge 10% for the privilege, which I think is rather exorbitant. I could hand deliver her a debit card, but that's a kinda expensive trip just to send her a $100 a month. Any other suggestions?

    Have you checked with paypal?I am not sure though if she has to have a credit card where you credit the money or just a bank account.

  6. hello, i have a few questions regarding the I-129F, and the G325A.... I am in the United States Air Force, and i am currently stationed in Korea... But i will leave here to go back to the US on Aug 05... Now my questions... On the I-129F, I put my local address in Korea... will this be ok? Im thinking about writing a letter to be included with package, stating that i am in the military and that i am in Korea and i will be leaving here August 05... And asking them to send all responses to my mothers home address... Would this go over alright? Also there is a question asking where my fiancee will be staying in the USA... Im also thinking of putting my mothers address here to... I know there is a section about being in the military Overseas on the I-129F and it asks my current address overseas, So should i put my mothers address as my primary Address at the top of the form??? I really love this girl, and i would like the package to be approved before i have to deploy to Iraq.... Thank you very much to anyone who has any advice...

    don't put local address, they only want a US address so your mother's would be perfect. Depending on wether she lives then you will use the US Service center that belongs to that state to file for I 129f.

    ....don't put your local address at the top of the form cause uscis will only ship notices to us addresses so your mother address is fine also for when your fiance will be in the states.

  8. Hi guys, I would like to share this with you as it might be interesting and useful to some who maybe are in the same situation as mine:

    my fiance is deployed on a ship and as many of you, we were waiting to receive the RFE about IMBRA. Well since he wasn't able to pick up the mail in the US he asked an operator of the call center if it was possible to get a copy of the notice with the supplementary info requested. Well I was skeptikal about them doing it and I was already trying to figure out a way to get the envelope sent to him on the ship, but after two days he got everything in the email from Vermont Service Center!!!! All he has to do now is print it, sign it and ship it back from there!

    One thing I am concerned about...is the envelope....have you guys received an envelope with a specified office it has to be shipped to or similar? Because I wouldn't want to risk his envelope to end up in the pile of new applications instead of RFEs and be treated different, or even be lost somewhere!

    hi, is there a part on the form where it says that someone else can fill it out, on behalf of the petitioner?Do you think I could? (I am the beneficiary) My fiance is deployed right now and won't be able to get any mail until he gets back to the States in august...:o(

  10. Thanx everyone for taking the time to look at my post.

    Didnt expect to cause so much comotion over it though so sorry about that.

    As for the few that have negative thoughts about my fiancee getting pregnant it was purely a miracle that she got pregnant just like any pregnancy and i thank god for the blessing so sorry if anyone feels differant.

    The reason i am concerned is that a visa once it is issued is only good for 6 months and the airlines wont allow a pregnant paasanger after they are 7 months and there is some concerns of flying a newborn baby until it reaches 6 months of age so i am worried we might lose the visa during this short window of oppertunity.

    From the way i am seeing things progress on the timelines of most other cases it will be about 4 months before i get anything back from the uscis and then who knows how long it will be before the papers get forwarded to the embassy in manila.

    I just talked to a person at my congressmans office and they informed me that they may be able to help with expediting the interview but thats after the approval comes from the uscis.

    Are you sure that all airlines have that policy about the age of the baby? I had my baby fly the first time at 1 month and a half old. It was a european low cost airline and I was flying in Europe, ok, but maybe you can check the rules with different airlines.

I would not worry so much about the different visa's in your passport, what I would worry about is the length of time left in your passport and the fact that you have no job in Italy and you are taking your son with you on this trip. Can your partner come to you in Italy?? It would make things a whole lot simpler. Also was just wondering you will need to renew your passport can you not do that now?? I know in some countries they allow you to renew upto six months before your old one expires.

    oh no...that 6 months visa is in my old passport but I also have a new almost immaculate one... but reading what you all say is what I am also worried about, so I don't think it's a good idea to travel until we can actually move there..after filing for K1

  12. No one here can tell you what a CO officer will do for sure. It is at their discretion whether or not to admit you, and they can ask you any questions they see fit. That said, you're well within your rights to visit here. Having other visas before that *shouldn't* have any bearing on your visit this time.

    The only thing you can do is bring documentation to show ties to Italy, and hope for the best. Perhaps you could schedule your flights to go through Shannon, Ireland as that is a US port of entry (as far as immigration is concerned - not customs - I believe Dublin is also the same way, but research it for sure). That way, if you do get turned away, you wouldn't have as far to travel back home.

  13. Hi, my fiance insists on going to the US to visit him and stay for a period of 3 or 6 months. I have a 6 months visa still valid on my old passport. I have been reading a loton this forum but everybody is going to the US alone. I will bring our son too and I wonder if that will be a reason to make the immigration officer even more suspicious about my intents of going to the US. I do not have a job in my country so I can't even show ties but I do intend to return. I just would like to stay there for a while so that our son can stay with his father for a bit before we decide to apply for a K1 which looks like it's gonna take too long.

    Do you think I should just go there for 3 months?

    On my old passport I have different visas from the past 10 years, such a j1 and student visa, plus the b2 . I wonder if that can prevent me from entering as they would think that I have tried different ways to cme and stay in the US. and ones I get interviewd should I tell them I am visiting my fiance or my boyfriend? would that make any difference?

    please help I am so scared of being questioned!

    I checked the dcf in the netherlands...thanks for the advice, I have been living there for a year and a half and didn't even think I might have needed to go back there to do this....:o)

    Yes, I understand your point about spending the 6 months tourist entrance together in the US. There is always the risk that you will not be admitted, so do have a back up plan. The same applies if you visit while you have a K-1 pending. Most people are admitted for a visit while they have a K-1 pending, but some are turned away. As always, it depends on that individual's situation.

    What a shame that you did not know about DCF when you were in the Netherlands! Ah well, it all works out eventually :)

    "Bouncing ideas around" means just talking about various possibilities.. sometimes when you have lots of choices, you just have to talk them out and see what you can learn so that you can make your decision. That isn't a very good explanation of that idiom, sorry!

    I do get the point, thanks a lot! you know....in order to get some info I sent an email to the us consular office in naples and I got an automated reply saying I would get an answer in two weeks!!!!I love this website!!I wish I could also help people around but for now my knowledge is pretty basic.

    Anyway, I have thought about the fact that I might be denied entry...but I seriously do not want to staylonger than my visa lasts and I will be honest, I get really scared and anxious everytime I go through immigration in the states even ifI have nothing to hide. I am gonna go there with a baby, wow I really hope they won't be so cruel to send me back right away....

    I know about those European marriage timelines... I hear that Gibralter is very fast, easy and no messing around. Not the easiest place to get to, buuuuut....

    I suppose the fiance option is the next best. As a Navy guy, your fellow has not lost his US domicile; he just needs a stable US address to send that petition off from. The sooner, the better, obviously. Going over to marry, then filing for the K-3 would take an additional period of time for virtually the same result.

I checked the Vermont Center and they process the I129f very quickly but if he uses his parents address it's under TexaS center which is taking more time...maybe I should just wait..we also have to see if he will be deployed on the ship...that will slow everything down even more....I will ask him about the expedite..

    Since you know something of DCF, I have to ask: How fast can you get to the Netherlands and get married? Amsterdam does not require residency from the USC (tho your fiance probably has it) and they are known to be quite fast with the visa processing. It might be worth looking into.

    I have a visitor visa to stay for 6 months. If I enter the States, get married, my husband petitions for I130 while I am there, can I stay there until my visa expires and then go back to Italy and wait over there for the interview date?

    I just would like to spend more time there with him and our son, without being in trouble. I will definately go back to my country to issue the K3, but I just wonder if I can spend some time while it's still pending over there with him. Or I have to leave right before he petitions for it?

  18. Members of the US military do not lose US domicile while in the service. Your fiance should send the I-129F petition to the service center with jurisdiction over the last residence he lived in. Or he can use his parents' address. He can even ask for an expedite if he is to be deployed somewhere.

    If your husband send the I-129F petition now, chances are you will have a K-1 visa within 8 months.

    When we started our visa process we decided on using my husbands parents address also, because he is also military, and moves frequently. All my stuff went to their address and have never had a problem, even after we got stationed in Germany. I simply flew back for my AOS interview.

  19. Hi everybody,

    my fiance who is in the Navy had a last minute change of orders so instead of coming to stay with me and our 8 months old son in Italy he we'll have to fly back to the States in less than a month. We didn't marry yet cause we didn't have any rush but now we do if we want to stay together and in italy it takes too long.

    He doesn't have a residence in the States yet, only the address where he was born and where his mom lives. Do we have to use that address or do we have to wait until he gets one? Or better yet can we ship the I129f to the States anyway via Dhl? If so what address should I put?

    I have another option I have a 6 months visitor visa still valid on my expired passport. What if my son and I join him in the States, get married and the petition for K3. How long can I stay there until I have to go back to Italy for the interview?

    DCF is not a possibility, our Rome embassy won't process requests for US citizens who are not residents of Italy and we are notmarried yet anyway.

    PLease help!!
