  1. Don't worry about the naysayers, but some critical advice: don't get her pregnant or you will really be up ###### creek without a paddle. I've seen time and time again here people not realize that then the income requirements will go up and if you are struggling with them as it is, that will only make it much more difficult.

    You cannot be more right my kind sir. Yes, I received this advice from a few other friends as well. And no, I have no intentions of getting her pregnant and I will definitely be as careful as I can so that it does not happen. Thank you.

  2. I understood she was doing it, but the way it was worded in that post sounds like its not something SHE CHOSE to do but something HE is MAKING her do. Choosing to strip is one thing. Most strippers I've known do it because it's a power trip and the money is fantastic. But being forced to do it by your currently illegal alien husband is another story. So i was hoping he meant she was choosing to do it, despite having a torn ligament in her foot.

    If I had my life together or did something extra maybe, I do not know what, maybe I could have graduated and I would be earning now. But I ended up losing my whole life plans and my wife is now forced to work (NOT BY ME, BY THE SITUATION) to feed the family. I have been trying to get an employment but frankly, not many want to hire an illegal immigrant. When I said I make her do it, I am not making her take her clothes off on a webcam or a club while I stand near her, holding a gun at her head. Have some sense. I meant, maybe I could have done something that changed all this!

    I also said, she has poor physical health and cannot go EVERY DAY! She can manage 2 days a week as of now. So, the math goes like this: $150*2=$300. For a month, $1200. For a year, 1200*12=14400. That is still short by $5600. Plus, we never know how long she can keep doing this and what happens. She gets sick very easily. This is an estimation of what income we could have given she does this REGULARLY for the next month, which is highly unlikely!

    She is also not a jobless uneducated person. She is 1 year from finishing her degree and her university randomly decides that she does not deserv to get FAFSA anymore. The university's claim: the rules for granting independence has changed and she has to prove it more now than before. Just additional information.

    So, given this, I just feel bad that I did not do enough to make her happier than what she already is. THAT IS WHAT I MEAN! Not that I force her to do it.

    For the rest of you guys who are just trying to make me feel like I am NOT doing anything to get a green card, you are wrong. I have NOTHING to do. My wife has been struggling to make sure we are happy and have what we need. I cannot get employment anywhere, yes. But I cannot do any of the jobs that require me to know Spanish because, I am from India. I did get to do some jobs on the side for a guy for a little while, but then he asked me to stop. If there is something I can do, I would do it. I am posting in this forum and trying to figure this out because I want to try to do something about it! I want to be able to work legally. But it is getting tougher financially and I am not able to hold on. I cannot go back home because I have huge student loans to settle, which will take take at least 3 times as longer to do so from India. I do not have that much time to settle it. My family's house is a security for the loan. If I fail to pay or if I don't start repaying by August this year, the house will be a property of the bank.

    I hope there is enough information on this reply. If anyone thinks any of these sentences sound too stupid to be true, please believe me, I am not that stupid. Ask me what it means before judging and shouting. Thank you.

    She could easily go everyday. But we don't have a car, she gets physically sick due to the walking and dancing, and I feel horrible making her do this even if she doesn't complaint much about it. But yes, with experience, you can make $200-$500 a day, as far as the stripers I have seen in the fancier clubs.

    As for camming, she makes $400-$500 a month. That is kind of the best you can expect out off it.

  4. I am sorry I did not mean to say any. I meant to say not enough income. Really sorry about that. She made near $10,000 last year. We need $20,000 to be over 125% poverty line. Sorry about that. Was typing on phone and misspoke.

    Edit: god there are lot of technical errors in my previous post. Looks like my brain went retarded for a second there. She has been camming for a year and stripping for 2 weeks. She stripped for a month before in a different club and made just near $300 the whole time. She is now making $150 at least a day. As I already said, her poor ankle and hands make her an average dancer and cannot get a lot of money, but this is feeding the family. Since she is new and the city is not so fast, she is having a tough time with that. If she made a lot, I am sure she will report it to IRS because we need it. She paid taxes on the money she earned by camming. I am sorry for such a misleading reply. These are all the facts and not spoken in a hurry or without thoughts.

    So why do people keep suggesting this to him?

    Yes, he first mentioned something about co-sponsor not living with him, but after he was told that was not necessary . . . he still came back and said there was no such person.

    I believe him . . . and would not continue to suggest to him that he find a co-sponsor.

    The real tragedy here is that the couple did not think this through before they were married.

    A marriage license should really involve more criteria than it currently does.

    I am not being rude guys. Just confirming the facts. Here is more information:

    My wife works as a webcam model and a stripper, has been for over a year now. That does not generate any income for her.

    She is in a job interview at a supermarket as I type this. She already attended and interview for another job on Friday. Waiting for those results.

    She has a broken ligament in her ankle and a broken pinkie finger in her left hand. So she cannot waitress or carry anything.

    We did not get married for a green card. We got married for love and not thinking anything else. I had no intentions of getting a green card when I got married, because I was and thought I would be in school and get my master's in computers. So now, I am forced to get a green card or something.

    So now, I have a doubt. As so many have suggested that my wife needs a job, if she does get the two jobs she is trying for now, when can I apply for a green card using these 2 incomes? Because, I hear that you need the tax returns as proof. Which is not until next year same time. Is that right? Or can we get like 2 months of paychecks and apply? Do you guys think a letter of intent from the employer is needed/can help?

  6. First of all you need to file the I-130 and I-485 so you can get a GC. You are married to an USC so the over-stay will be forgiven. The only problem is that you cannot leave the US until you get the GC. Your wife will file the I-864 affidavit of support no matter whether she makes enough money or not. If she is below the 125% of the poverty level, she will need to file a co-sponsor that meets the 125% above the poverty level for their family size plus you. As stated above any LPR or USC can be a co-sponsor.

    In regards to your point #4 the I-765 is not a visa it is EAD. You can file for the EAD when you file the I-485. You can also file the I-131 for advance parole (AP) so you can travel, but due to your over-stay leaving the US is more of a risk than for most people with AP, but that is something you will have to decide.

    You are out-of-status and deportable, but you would have to encounter the CBP within the US for that to happen, so avoid the Southern border as the CBP has a presence within 100 miles and can stop you to check your immigration status.

    Thank you Dave. That was helpful. But the problem is, no friend of mine is ready to co-sponsor me. They either do not have the income or the mental readiness to do it for me. They are scared of the consequences, little there is. I tried explaining the situation and the consequences they would face (which is literally nothing) by co-sponsoring me, but they have their reasons why they do not want to help me out.

  7. Can you not return back to school for option 3? Also anyone with legal and sufficient source of employment in US can be a sponsor so it doesn't have to be family.

    I cannot, because we do not have money to pay for school. Also, it will take 2 years for me to return to the same school and if I am to go to any other school, I will have to leave the country, go back to my home country, apply for F1 visa, and do all of those procedures again like a new incoming student. I really believe I can get a nice paying job with my Bachelor's and I already have a few offers, but unable to join due to lack of work authorization.

    About the joint sponsor, yes. I am aware but I have no friends ready to help me out with that.

  8. Your wife will have to obtain a job meeting the 125% poverty requirements for your household and/or you will have to obtain a sponsor. The sponsor can be any US citizen or LPR who meets the financial requirements for their family size plus you and whose income is legally obtained from a US source and they live in the US. They do not have to live with you nor even in the same state.

    Thank you Belinda. Yes, I am aware of the joint sponsor and him/her not having to live with us at all. But we are not able to find anyone willing to do it and my wife absolutely has no prospects of earning $20,000 a year, given she does not have even a Bachelor's degree. I already have a Bachelor's and it is easy for me to get legal employment which pays over $50,000, but no authorization. I already have people ready to hire me if I provide proof of work authorization at $60,000+ a year. Me earning legally can be used as the sponsor is possible, I believe? I really am hoping to just do that but I do not know how to acquire work authorization :(

  9. Hello guys,

    This is my situation. I came to the US on F1 status to do my Master's in computer science. I married an American Citizen on the 14th of November, 2014. I then failed out of school and lost my F1 status. That means, I am out of status right now.

    Here are the options I considered and why they have not worked out for me:

    1. Green Card: My wife is not in college either due to financial aid problems. She is not in school and has no degree. So, she cannot get a job or an income. For me to get a green card, I need my wife to be earning at least 125% of the poverty line of the year (which is near $20,000 a year). The alternate to my wife not earning is any of her family members working. Her dad is dead and her mom does not work at all. Any other family member she has are not ready to sponsor me and cannot even if they were, because they are not a part of my wife's tax returns or living in the same household (one of which HAS TO BE MET in order for the family members to sponsor me). We are not able to find any friends who make that money and are green card holders who are ready to sponsor us. So, we cannot do that either. So essentially, we do not have a sponsor or required income in order to apply for a green card.

    2. Spouse Visa: Spouse visa requires everything a green card requires. So for the same reasons as mentioned in point 1, spouse visa is not possible either.

    3. H1B Visa: No company is ready to sponsor me for a H1B straightaway without an OPT or CPT or some kind of work authorization. I cannot get any of this because all of this requires the help of the college which I am not a student of anymore.

    4. I-765 Visa: This is an EAD or work authorization visa, which requires a LOT of conditions to be met, which I do not meet. Also, this has to be a side application along with a lot of options. The only one I am eligible to apply is the I-881 form but the requirements they have to apply for that and apply for I-765 visa still does not meet my present situation.

    The companies I talk to want me to show SOME kind of work authorization so I can work here, which I do not have. If anyone could please let me know what to do about this situation of mine, I would be really glad guys. I am really low on cash and have to start some kind of employment for the survival of the small family I am responsible for. Someone, PLEASE provide me with some kind of assistance or leads on this situation. What can I apply for that I would get approved of? What can I do to get work authorization? Who can help me out in this? Can an organization get involved in this? Please help me out.
