  1. @fellaamazing Thanks so much for the information! Did you bring a letter from your manager or anything stating you had to go back to work or had limited vacation days to stay in Montreal?

    Also, sidenote, it says in your timeline you went through Detroit Tunnel for POE-did you drive back to the States? Was it longer at Customs/Immigration?

  2. His employer couldn't do anything about this, because it was a family based petition, and the job transfer was within his company. 2 separate issues.

    @falcngrl-even in the packet 4 we got from the consulate says the exception may be made if the applicant holds a non-immigrant visa in the US. but the issue is that nothing seems to be guaranteed. And even though it says everywhere that it will take 3 days processing and 5 days to DHL passport and all, I see people are waiting for at least 2-3 weeks, even more for their stuff. No one has any timeline.

    I'm just thinking that adjusting status might be better for peace of mind...

  3. Anyone who can help me with this. My spouse has just got an interview date for December 1st. Yay! But he is on non-immigrant L1 visa and working in the United States. I've read that Montreal Consulate has varied times when it comes to getting the passport and visa documents back. We are worried that he will be stuck in Canada indefinitely, with his job on the line. Can anyone tell me if it is possible to request to get the passport/visa back urgently and picked up at the Consulate?

  4. I have filed an I-130 for my husband and now we are about to start the I-864 forms. I am a stay at home mom and my husband is the sole earner. We are actually living in America, he is on an L-1 visa (we decided to not do adjustment of status because we had already paid the NVC fees before he was offered this job/got his L-1 visa). He has only been here working for the past 2 months.

    My question is, do we have to have a joint sponsor? Since we won't be filing taxes until next year, we don't have evidence so I can't use his income to prove financial support? Or can we use pay stubs, a letter from employer, bank statements, and then not use a joint sponsor?

  5. Hi! I began a petition for my husband's immigration while we were living abroad in 2013. June 2014 USCIS approved our I-130 petition. We began the NVC processing. I paid the fee for affidavit of support fees and we were about to start the next step for IV application processing fees, gathering documents/evidence to send to NVC when my husband's company decided to transfer him to America. As of January 2015 my husband is now on L-1 visa status through is employer and living in U.S.

    What is our next step in our case?

    Do we apply for Adjustment of Status, and which forms will we need to send? Or can we continue with our process through NVC?

    How do we inform NVC and USCIS of adjustment of Status?

    Detailed help will be much appreciated as I'm totally confused!
