  1. Dude.. you should NEVER file single if you are married. That's the opposite of law abiding. True, one could get away because the IRS cannot verify every single return, but an eagle-eyed CO at the embassy can raise a stink, and justifiably so.

    Not wanting to complicate does not mean taking an unlawful route.

    I wouldn't sign and submit a paper saying "I am telling the truth" where it simply is not. If you are filing as "Single" but in reality you are not, how does that work?

    Your papers may have fallen through the cracks or you simply got lucky.

  2. If your brother files Married filing Jointly, then he will need to obtain an ITIN for his wife. If your brother files Married filing Separately, then he simply needs to write "NRA". If the tax program he uses to efile does not allow to enter NRA in place of the SSN, he may need to paper file.

    You can only file as HOH if you have qualifying dependents, such as children. A spouse is never considered a dependent, and cannot be used as the basis for filing HOH.

    What is NRA and where would he write that? Also, after mailing the paper, can he just make a copy of the return and his wife take it to the Embassy, or is there a "confirmation letter" or something of the sort from IRS to prove that the taxes were indeed filed.

  3. Hello guys,

    My brother got married last March (2014) and two weeks away from her Interview for IR-1 visa. Now the local consulate in Bangladesh is asking for 2014 tax returns.

    Now when he tries to file tax return, whether married filing separate or joint, its asking for his wife's Social Security Number. But of course she does not have an SSN yet and he can't really file as "Single"

    How do one go about solving this issue?

  4. How much longer will you receive it? Does it meet the requirement? Can you prove it will continue and that it meets the requirement? Workers comp is generally a temporary form of income, so if it is your only income source, then they may want to see a co-sponsor, and I recommend using one.

    There is no guarantee on how much longer I will recieve it, it all depends on when I will get a job.

    HOWEVER, I have an award letter from the from Virginia Workers Compensation that requires my employer to pay me for at least another 5 1/2 years (or until I find a job making the same or more money that I was prior to my injury)

    Also, should I just volunteer and add a co-sponsor, does it hurt my case? And which form do I need to fill out?
