I know it is confusing. I have already decided not to change anything on my birth certificate (we have to get a lawyer, go to court, which is very expensive and then wait for couple of months). I just hope they will not take a look at her date of marriage.

If you need clarification about whether your mom was married or not I would suggest is getting a CENOMAR from NSO, this will show your mom to be single if she was never married.
As for your birth certificate I don't know that I would bother doing anything with it.

Thank you for your response. That's what I told my mom to get her cenomar and a marriage certificate (that would say not married) at NSO. I won't send the paperwork not unless everything is clear and good on her end. I hope this won't be a challenge coz what matters is to proof that I am her daughter.

Hello everyone! I'm new here and I hope somebody can share their answers on my case.
I'm in the process of petitioning only my mom. I grew up with my mom and never had my father all my life. My father has his own family now. My mom said that she was never married to my dad and that she's single. However, on my birth certificate (NSO), it has a DATE OF MARRIAGE, the informant name is my mother's name using my father's last name but she signed it as her single name. On the I-130 form, her marital status I checked Single (knowing that she was never married). What actions do I need to take? Do we need to correct it thru local civil registrar's office and then have it forwarded to NSO? Does somebody have the same situation as mine? How did you do it? I really need your help!

I have a question about my birth certificate (one of the documents needed to prove relationship). I grew up with my mom and she's single. My father has his own family now. My mother and father were never married to each other. But on my birth certificate (NSO) it has a DATE OF MARRIAGE. On the I-130 form, I selected my mom's marital status as Single. Would that be a problem on my application to petition my mother? Please help! Has anybody been into my situation? I need your advise before I submit the paperwork.

I agree with some of the guys here that marriage is not the next step, well it could be. But a lot of fraud like going into marriage and then divorce after AOS.
You really have to establish the genuine relationship not just through chats or calls and I know you visited her once (which I think made the CO that it's not enough). My then fiance, visited me twice and then came back the 3rd time to pick me up. While he was here, we really spent time together (took a lot of photos), spent time with each other's families and friends, and went on vacations. Even if he wasn't here, I spent time with his side of his family (took photos too and was included in my documents). He sent me snail mails. I know we all have a lot of expenses to manage, but some embassies are really hard to please, but in this kind of situation, you really have to invest on time and money.
I believe you can make an appeal, and in the mean time get to spend more time together physically. Save, visit and travel together. And hopefully by then, you guys will be approved. You gotta go to these trials, never give up and fight for your relationship.
