  1. First of all, many thanks to all of your who responded to my previous questions!

My wife, a U.S. citizen, is sponsoring my green card application and I have a question about I-864 (Affidavit of Support).

We just filed a joint tax return for 2014 and our income level meets the threshold requirement. (I was a student on an F-1 visa with authorized summer work for 2014 and my wife worked part-time in 2014.) However, neither of us worked in the U.S. for 2012 or 2013, so our income in those previous years is $0.

I will be graduating from grad school in May and I already have a job (same company I worked for the summer of 2014). My salary should cover the minimum threshold. My wife is currently not working and does not intend to work any time soon.

In this case, do we need an additional sponsor for I-864? Or do we qualify the income requirement? What I am concerned about are 1. our income in 2012 and 2013 were $0, and 2. our work is not continuous and all I can show for 2015 income is the offer letter I have signed for my job to start in June 2015.

Thank you so much for your support.

P.S. We initially wanted my father-in-law to support us by becoming an independent sponsor but we learned he would not be able to do so for a personal reason. I don't have a different sponsor in mind and are wondering whether we can still complete I-864 on our own.

  2. Hi Everyone,

A quick question about Part 5 (Sponsor's Household Size) of I-864. My wife (a U.S. citizen) is sponsoring my green card, but our combined income isn't sufficient to meet the minimum threshold, so her father is the joint sponsor in our case.

As per kind suggestions from many of you, I now know that my wife needs to fill out her I-864 and her father a separate I-864. On my wife's father's I-864, his household size should be 3 (i.e., himself, his wife, and his daughter who is my wife's younger sister), but Question 5-8 (Household Size) would add up to "4", because Question 5-1 is "1" (which is me), and the simple addition of Questions 5-1 through 5-7 as instructed would become "4".

Is it really ok that the Answer to 5-8 (Household size) is "4" with me included? Or, somehow we should make Question 5-8 "3" because his real household size is 3?

Thank you so much for your help. (And I am sorry if my explanation isn't clear. Please let me know if you find it confusing and I can try to clarify.)

  3. I have a question about how to fill I-864. My wife is a U.S. citizen who is sponsoring my green card application, but her income level does not meet the minimum threshold because she has been a student. We are thinking of asking her dad (who does not reside with us) to become a sponsor.

In this case, should my wife fill in the I-864 at all, or is it only her father who needs to fill it in?

    Thank you for your support.
