  1. For the avoidance of confusion, let's clearly understand that the K3 visa is good for travel to the USA only until it expires in April 2008, when the visa expires.

    When the K3 status expires, as indicated on the I-94, is something completely different.

    The K3 is valid for 2 years from the date of entry... that is why there is a 2009 expiry on the I-94.... also the K3 is a multi entry visa so it is good for travel for the 2 years.... .....

  2. My wife is here on K3 visa & I'm filing the AOS for her now in June-2007.

    Her K3 visa will expire in April-2008 & when she entered the country in Jan-2007, the immigration officer stamped Jan-2009 on her I-94.

    Does that mean, her status will remain legal after her K3 visa expire because of Jan-2009 date on her I-94?

    what if we don't hear anything from USCIS by the time her I-94 expires? in Jan-2009

    what would be our options then?

    what would she has to do to remain Legal in the country?

    I'll appreciate any help

    Sorry guys for asking in-complete question...YES, i'm filing for AOS for my spouse & not sure what my wife's address to put under part2 in form I-864

    US address or her overseas address?

    & one more question...

    Also, in form I-864 under Part 5. Sponsor's household size in Line A. I put 1 for my wife & in Line C. Do I have to write 1 again for my wife or not...we are just 2 people. If I write 1 in line C. then in line H. my household size would be 3 instead of 2

    hopefullly, it'll make sense...

  6. I'm going to file AOS for my K3 visa holder wife. my question is about "biometrics" does it has to be done before we submit the I-485 or after?

    If before then, what number should we call to make an appointment?

    &

    If it has to be done After submiting I-485, then are they gonna give us the location, date & time to go for biometrics?

    or do we have to call them to make an appointment?

    do we have to make 2 seprate money orders for 325.00 & 70.00 or one for 395.00

  7. Check YES and Question 9 is for any additional immigrants that you are sponsoring like wife's children.

    In out case I was solo sponsor using no assets, and co-sponsor so we used the simpler I-864EZ form (Check it out).

    OK, I got it, thanks for the reply...few more questions:

    Can I still Use I-864EZ eventhough I'm self-employed?

    &

    my 2006 tax return is above poverty line

    my 2005 tax return was below poverty line

    & I don't have 2004 tax return cuz simply I didn't work

    or, I'll be better off filing regular I-864? incase If I need co-sponsor....

  8. I'm filling AOS for my spouse who is here on K3 visa & I'm the only sponsor. my question is: On form I-864 in Part 2, where it says:

    Information on the Principal immigrant. I'm assuming, I have to put my spouse information. right?

    & in part 3, question 8: where it says:

    I am sponsoring the principal immigrant named in part 2 above & which box should I check YES or NO?

    & Do I need to put anything in question 9 under part 3

    help will be appreciated...

  9. My spouse is here on K3 visa & I'm applying for adjustment of status. On form I-485 under part 2, where it says:

    I am applying for an adjustment of status to permanent resident status because:which option should I pick? a, b or c?

    Also on Part 1 what should I write on A# (if any) should I write the A# was given to her on I-94 when she entered the country or leave that blank?

    anyhelp will be greatly appreciated!

  10. My wife received the K3 visa last May 2006. She'll be coming to US at the end of this year. before she got the k3 visa, I-130 was approved & they asked me to fill I-864 form & pay the $380.00

    My question is, do I need to fill I-864 form & pay the fee?

    someome told me once she is here, i need to do the following

    Adjustment of status:

    Change of status:

    Work permit:

    Social Security Number:

    I'm really confused at this point...any help will be appreciated!

  11. It happened in pakistan...

    1st: they paid the visa fee at the AMERICAN EXPRESS BANK LTD

    2nd: AMERICAN EXPRESS BANK LTD mailed the DS-156, DS-157, & her Passport to Conslate in Islamabad for review

    3rd: Conslate returned both applications & passport & gave her Interview date

    but later found out those two questions weren't marked, just left blank...I'm sure conslate must have seen them & yet they gave her interview date...don't know whats gonna happen.

  12. My friend submited Hand-written DS-156 for his mom for B2 Visit Visa & made a copy for his own record & later found out that he didn't answer Questions 35 & 36 which were supposed to be NO...but the conslate gave her next month's Interview date.

    My question is...

    Is that gonna create a problem for her during the interview?

    or

    she can simply say, his son forgot to answer those questions?

    any idea?

  13. Since both I-129F & I-130 were approved now Wait & see which application reaches the conslate 1st...most likely it'll be I-129F for K3 visa...

    if its I-129F, then go for K3 visa

    if its I-130, then go for Immigrant Visa

    soon your spouse will receive the Instructions from conslate either for K3 or Immigrant visa...Inthe mean time, start preparing for supporting documents such as, tax return, bank statements, pay stub etc...
