  1. I have been told at embassy that it is over a year long process before I can travel back to my home country.

    I actually have valid fiance visa. First petition didn`t work out. What I am asking is weather a waiver would work out if I visit on this visa, but we don`t use it? Because, as I said - I have to come back to my home country, and if we get married, I won`t be able to do that for 2 years.

    Have you actually got your Visa, your time line shows that you received your NOA2 in 2006, if you have your visa is it still valid....

    It would be unusual for a 2006 NOA2 and or visa issued as a result of a two + year old approved petition to still be valid ....

    Why would you not be able to return home for 2 years???

    Marry, file to adjust status, and file for AP (I-131) with AOS. Typically it takes less than 90 days to get AP, you can then use AP to take care of things back home.

    I am searching for certain information and was hoping someone here can help me.

    I am thinking of traveling to USA on my fiance visa to meet with my fiance but I don`t have all things solved in my home country so I will need to get back before we get the chance to get married. I just want to spend time with her now. So then I would be applying for another fiance visa right away after I am back to my home country. The question is - will government make me any problems about that. I have read somewhere that waiver is needed if you apply for 2nd fiance visa within two years. So was wondering if anybody here had experience - is that waiver hard to get?

  4. of course it's a shame, but unfortunately that's not an argument

    it's a shame we have to spend money on making our homes secure because some people are thieves, but they are, so we do

    it's a shame we need costly and lengthy trials because some people don't tell the whole truth even when they've sworn to, but they don't, so we do

    likewise, it's a shame we all have to wait so long, and the procedure is so difficult, but some people try to cheat, and so we all suffer

    the USCIS has NO WAY to know the cheaters from the sincere, other than the procedures they have in place, so the best thing we can do at present is get through those procedures as smoothly as possible

    while, of course, agitating for change in any way we see fit, but then I think that's any right-thinking person's duty, about all manner of things, just anyway ;)

    also, it's not 'allowed in the whole world'; many countries have strict immigration/visiting policies, so I'm not sure what you're getting at there

    Are you saying that denying someone a visitors visa just because there is a K1 in the process makes sense?

    The same person could maybe get a visitor`s visa if not being processed K1.

    I am just pointing out how ironic the situation is.

    And what does matter if many other countries don`t allow importing fiances? That doesn`t mean they are right for doing so.

    And as far as lying goes - yes it is not the good thing to do. Not good at all - in any situation in life.

    And I won`t go to embassy and lie thanks to good people who helped me here.

    But don`t judge me here for thinking about the option and asking about it. I am desperate in the situation that I am in where I haven`t seen my fiance for over one year.

    And whoever looks down of me because mentioning the idea of telling the lie could try imagine how would they feel being separated for over a year without seeing each other - by the time I get K1 it will be year and a half and even more.

    I already went through this procedure once with the same girl, but I had to go home before we got married - so I know how to play by rules, believe me.

    I am going through this for the second time.

    don't despair and don't give up! people have given you sound advice here. and i like this last bit laura said. all of us who are further into the process have been where you are, more or less. keep at it, keep your desire alive, keep your relationship strong and do all you can to overcome distance and separation. you know... skype, msn, yahoo, phones, emails... whatever helps!

    what stage are you at this time around? got NOA1? NOA2? any RFEs? you might be closer than you think! I remember reading someone's post a while ago that Zagreb embassy was pretty fast. hope same happens to you!

  6. I don`t feel that it is OK to lie about anything. It is just that I would like to see my fiance sooner. I don`t have any intention of staying in USA illegally. That`s why I am going for a fiance visa.

    It is just this whole birocracy thing that doesn`t make any sense...

    And stepping over human rights.

    But that's just the way it is.

    As I said before, you can attempt to visit her but you must show strong strong ties to your country. A letter from your employer stating you will be returning home on such and such date, property that you own, bank statements, etc, etc.

    Even then, it comes down to whoever is on the other side of the counter. They could deny you and you are out the flight money.

    It's hard to be apart, she can come visit you though...why don't you try doing that if possible?

    Don't do anything that could mess up your chances of being with her in the long run. It's not forever, it's only a few months to a year...hopefully much less and then you'll be together the right and legal way.

  7. We'd all like to see our fiance's sooner. But we should play by the rules.

    The bureaucracy thing does make sense. USCIS had to tighten things up to help keep the US safe. As much as I don't like waiting, I appreciate that efforts are being made to keep our country free from terrorists, etc.

    Finally, no one is stepping on our human rights. It is a privilege for us to be allowed to bring in a non-US fiance or spouse. The US is NOT obligated to permit this. But they do, and they have rules in place for it, so I'm prepared to live with that if it gives me the end result that I want.

    Julezabelle, I don`t see how denying a tourist visa to me or any of people in similar situation is making US any safer. In regular circumstances I would be allowed a tourist visa - but the very fact I have a fiance there is resulting with denial.

    How is that helping US to stay any safer from terrorists?

    You are right - US is not obligated to permit this. But I think in 21.century it would be a shame if it was not allowed.

    It is allowed in the whole world. So how it would be if US as one of the most civilized countries haven`t allowed it?

    It is kind of sad and ironic that with all that progress and development and civilization today in the 21.st century people can`t see each other when they want to. But have to wait for months. Don`t you agree?

  8. Thank you guys for the help. As I said - before the fiance visa I tried to get a tourist one, but as soon as they have found out that I want to go visit my fiance they denied me a visa saying I should go for a fiance visa and not a tourist visa.

    What if I had a tourist visa from before. Would they let me enter USA at the airport - knowing that I am in the middle of process of fiance visa?

  9. Btw, couple of months ago I tried to get a tourist visa before we applied for a fiance visa, and I was denied because I mentioned I have a girlfriend in USA so they were afraid of my illegal stay.

    The only way I see I could get it is to lie not mentioning my fiance at all but saying I am coming because of something else. But I am wondering if they have records me where they can see I do have a fiance there.

    It is all so complicated, and I just want to see my girl while waiting for his long :(

    I was wondering if anyone has experience with that? Can one travel on tourist visa while being processed?

    Probably it is hard to get a tourist visa if mentioning that one has a fiance in USA. So , what if one lies at embassy about that and they discover it. Can it have an influence on the fiance visa that is being processed?

    Let`s assume I manage to get a tourist visa though. Will they let me across the border with it since I am in the middle of process of getting the fiance one...

    Does anyone have experience with anything like that?

    Any help is welcomed.

    On the form itself it says that it is a field for USCIS use only.

    It is for the same fiancee. Do we need a letter requesting a waiver?

    I would if I were you take a second look at the G-325A as well as the I-129F Part B, Q#9

    If you read the IMBRA law it appears that you do not. There is some question as to whether the USCIS is adjudicating properly.

    My reading is similar. I would say you need the waiver letter because USCIS is not adjudicating as the law is written.

    Second chances are allowed, even with a different fiance(e) within two years but require a letter requesting a waiver.

    It is for the same fiancee. Do we need a letter requesting a waiver?
