    How do I apply for voluntary departure? Just write a letter to DHS (and what address do I post it to) asking for it, if it's prior to any removal hearings?

    Why can't I just fly out of the country and (as immigration obviously will know when I leave) have abandoned the entire immigration application, if it is after receiving a Notice to Appear and before attending any hearings? Will they stop me at the airport?

  2. Not sure where to post this, so apologies if it's the wrong place.

    I am adjusting status from a B2 visitor visa to permanent resident. The Adam Walsh Act applies in my case. I have sent off an AWA Waiver petition, but if this is denied, I'm wondering what happens? What advance notification do I receive before they begin deportation proceedings? If I'm denied, I'm just wondering how far in advance I get to know this so I can leave before USCIS does anything else. That includes a hearing, etc.

When you apply for adjustment of status the petition from your relative proving your eligibility to obtain permanent residency (I-130) and your application to apply for permanent residency (I-485) will be processed together not separately. I think that the confusion is arising from the fact that it seems that you separated the forms and therefore you consider them to be two separate processes. If they've already scheduled an appointment it means that they have gathered all the information that the officer will need to review your case and make a decision on both forms at the same time. If you are granted permanent residency by default it means that you qualify to be petitioned by your relative, therefore, I-130 was approved. Usually you will notice an update shortly after the interview.

  4. That is not uncommon. If your interview goes well, you will see the the updated status with both i130 n i485 approved. So now it all depends on the interview.

    Ah okay that makes sense. Does that mean they've already run the background checks on the sponor/s listed in the I-130? They did send me an RFE for one of the sponsor forms a lot earlier (which is all solved now and isn't holding anything up) so I assume they have.

    I'm not sure if the sponsor forms were in the I-130 packet or the I-485.

  5. I have a question; when does the I-130 get approved? I've not gotten any notification on it whatsoever after the initial one that they've received it. Is the fact that my I-485 interview has been schedule a sign that they've approved the I-130, or will they do so after the interview?

    I am adjusting from a B2 visa through marriage to a US citizen. I received the NOA for the I-130 in the first week of June, then it was updated again in the first week of July, and I've not heard anything since. My I-485 interview is on the 3rd of August, so in exactly a week.

I talked to a tier 1 person and he told me that USCIS commonly takes 30-40 days to process an RFE response before mailing you notification that they've done so, and it's only been 30 or so days in my case, so he can't tell me anything more unless it's been over 60 days. Just have to hope it made it there and if I don't get any notification within this month, I'll chase it up. I did get 87 days total to give a response, so I've got some time.

    And then I just received my notice for my I-485 interview today!! So excited. Do they stamp your passport AT the interview if they approve you, or later? I have to travel a good 5hr round trip to my nearest USCIS office so I hope I don't have to go a second time..

I'm considering finding a way to contact USCIS and make sure they received my response to the RFE...it was just missing signatures on the I-864A form, received on the 6th of June and I sent it back the next day so they certainly should have received it. No update online though, and I don't want to wait out the 87 days only to find out it got lost in the mail...

    Thoughts? Where should I go to contact them?

  9. About an hour after I did my biometrics (on the 2nd of June), I got an email that they'd sent out an RFE for my I-485. Letter arrived yesterday, turns out I missed a signature on the sponsor/household member agreement (I-864A) form, so thankfully something easily fixed! I'm posting it back first thing Monday and hopefully once they receive it, things can get moving again.

I finally received NOA1 for My AOS, EAD and AP but the NOA i received for AOS I-485 is weird instead of saying Case was received it says YOU FINGER PRINT FEE WAS RECEIVED And when i checked my Husband's Bank Account the money is still in Their. Does anyone encountered this? I just wanna make sure the Case Number they sent me belongs to my Name.

    Mine's like this too. Case is received for all of the others, but for my I-485, it just says that the fingerprint fee was received. I can't say if they've taken the money out or not since I used a money order though.
