  1. My wife has entered the U.S as a K1 visa holder. We have met the first obligation of the requirement, which is to get married before the 90 days. We are now preparing for the application for the Adjustment of Status [Permanent Residency-Green Card]. We are currently in the process of completing the I-131 form for the Application for Travel Document. My wife has no plans on leaving the U.S but in case of emergency she would have to return.

    Form: I-131

Q1: On Part 2: Application type, we are confused on which box we need to mark off “1A or 1D?” Also, could you provide information on what the difference is?

Note: My wife is not a U.S resident. She recently entered the U.S.

    • 1.A: I am a permanent resident or conditional resident of the United States and I am applying for a reentry permit.
    • 1.D: I am applying for an Advance Parole Document to allow me to return to the United States after temporary foreign travel.

Q2: In Part 3. Processing Information.

We do not have a specific date for travel. What information would have to annotate in the box?

Q3: In Part 4. Information about purpose of travel.

Does she have to annotate “for emergency” or does she have to provide detail information regarding her leave?

Q4: I just want to confirm that because I am filing form I-485 with the I-131 form, there will be no extra fee for filing I-131. Is this correct?

  2. My fiancé took her overseas medical examination on 7 June 2016 and expires on 7 December 2016. She is planning on arriving to the states in November 2016. Once she arrives in the states and we get married, we will immediately collect all appropriate documents and submit for the US residency card [Green Card]. By the time that we submit the packet for the Green Card in November 2016, to include her medical examination, her medical documents will have been expired. Will she have to take another physical or as long as the packet was submitted before the expiration date of her physical still be valid?

  3. Hello,

In early July 2016, my fiancé received her K1 visa, which is valid for 6 months. Her visa expiration date is set for 7 December 2016. She is planning on arriving to the states in early October 2016. As soon as she arrives we are planning for the wedding and immediately submit all the necessary documents to apply for the US Residency card (Green Card). My main concern is her visa expiration date. Even though we have met the requirement of getting married within the 90 days of her arrival into the US and the documents for the Green Card have been submitted, will she have to return back to her country because her K1 visa has expired or can we apply for an extension for her visa to allow her to stay in the US until the Green Card paper work has been processed?

    Please assist.
