  1. Hi, All,

    On 7/7 we got the Welcome notice! It was our 14 months (being married) anniversary!

    I was an F1 student.

    And we have never received PIW letter. We did get RFE for marital evidence.

    After receiving my latest RFE for new medical exam, less than 2 weeks, I got the approval!

    It was quite a long wait... My lawyer said she has never seen any case that F1 status got married and didn't need to interview for AOS. But I guess it does exist!

    Hope anyone is still under this long and painful wait will soon get great news too!

    My case has been transferred to SF office:

    5/27 Sent out RFE: evidence of marriage, we gave them all the evidences that normally are presented during the interview.

    (We haven't gotten our interview yet. We were notified that we have potential interview waiver.)

    6/19 RFE for I-485: medical evaluation expired

    6/23 my husband received I-130 approved (says it doesn't mean my status adjustment is approved)

    So...hopefully after I send out the medical evaluation, I'll get my I-485 approved soon!

    very unusual case...

    I have never received a potential interview waiver letter. But today we got RFE from SF office saying they are processing our case for NBC. And if after REF, they still think we need an interview, they'll transfer our case back to NYC.

    Our congresswoman office staff told us before that we got potential interview waiver (even we have never gotten the letter stating that).

    So I guess we really got PIW.

    However, I wonder if anyone got similar situation?

    RFE asking for marital evidences such ask credit card statement, lease, tax refund...etc.

    We don't have a lease because we got married after I signed the renewal. And it costs $300 for adding a new person on the lease. We decided to wait till the next year lease. But they sold out building, and we've never gotten the renewal lease. We like it without a lease, so we can move to a bigger place anytime when we are ready.

    Do we submit photo album too? We put together a very nice photo album for the interview...but if we are sending it to SF office, I don't think we'll get it back :(

    Please help! If anyone has similar or same situation, please help telling us what evidences you sent~ and what's the result? Still got interview or got the GC after RFE?

    (So anxious...rather just go to the interview...)

    Hey~ Haha~ happy anniversaries! my lawyer told me that since my I 765 was sent with i485, the office should be just NBC.

  8. if you are an interview waiver case, your case being transferred to San Francisco was not an error. If the USCIS staff knew what they were doing they would have told you it wasn't an error. Interview waiver cases can be (and are) processed at any office in the country. They are sent to offices where their caseload is lower. It's good news though - your approval shouldn't be too far away.

    Thank you for telling me this~ I was freaking out when the officer told me the case was transferred to SF by accident, and was sent back to NBC after that. She told me NBC will send the case back to NY and they'll call me in for an interview...

    I told the officer that the staff from our congresswoman's office told us our case is an interview waiver case. (I was under F-1 student visa when we got married.) And she insisted that there's no way I would get interview waiver. So...we'll see...

    But at least now I know it won't be far away!

    Today is our 1 year anniversary! (time seriously flies!!! didn't feel like it's been so long in marriage, but definitely feel very long waiting for GC >"< )

    Few weeks ago I went for an infopss. The officer told me that our case was transferred by accident to San Francisco!

    (We live in New York...)

    And on Monday I got the respond for my care inquiry (I-130), they said my case now is being processed. Within 90 days, I should be hearing an result or other actions required.

    I just sent out the renewal for I-765 and I-131 on Tuesday.

    I really hope that I can get GC soon!

  10. His license expires in august when his ead expires but hoping that he will get greencard and we will renew license then

    I just recieved the interview waiver letter yesterday on the mail... It's kind of strange I just got it considering I applied for a process inquiry like a week ago because the field office was WAY behind... Also, they sent it to our old address, and he last official process on my uscis was a change of address letter...

    I got my waiver letter yesterday, dated February 25th... I'll probably apply for an extension to paperwork, just to be on the safe side... When did you get your letter?

  11. USCIS really does some strange things and you just happen to have fallen underneath their cracks. Normally as a prior F1 to an adjustment applicant, you should have been interviewed not even remotely be a "potential interview waiver" candidate person like someone who entered on a K1 visa or a minor derivative on a I-485 application. Considering you even filed since May you should've had your interview by now no matter what backlog your local USCIS office must've had. You'll have to schedule an info pass at your local office to really sort his stuff out.

    yea..I've tried to do infopass, but New York City field office has been very booked. I couldn't get a spot at all :(

    My friend filed at the end of last August, and she was interviewed and already received her GC!

    She came in the B1/B2!

    I feel like it's just luck...

    My case got so mysterious these days...Here's the story...

    I didn't receive PIW (potential interview waiver) letter.

    My husband contacted our congresswoman because it's been so long and no update for our case at all...

    1. On 2/18/2014 Immigration Services Officer replied the congresswoman's email saying that my case is identified as a "possible interview waiver" case.

    In the email, the ISO says "The interview waiver cases are being shipped to the local USCIS field offices or adjudication based on field office capacity and not necessarily office of jurisdiction."

    2 .On 2/23/2014, my lawyer emailed me saying that she called and my case is currently in the NYC filed office. She asked that I can either do infopass to get more info or just wait for the interview notice.

    So, I showed my lawyer the letter from the congresswoman...And my lawyer said "They do not know what they are talking about. 100% you need interview. no way of waiver as it is the law. disregard the letter."

    3. I called again today to USCIS, got transferred to Tier 2 (she called me back) just now. She said there's no record that my case is PIW, and no record shows that my case is in NYC field office (which my lawyer said it is).

    Tier 2 lady did mention that since the email is from the ISO of the Congressional Unit, the information might be more accurate than whatever in the USCIS customer service computer system...

    But the Tier 2 lady said that my case is definitely not in NYC field office...

    WHO IS TELLING THE TRUTH? lol OMG...

  13. Yep my husband just got his license and he is pending aos, no green card, but he did have to show his ead card before they gave him a license.

    Hi~ what's the expiration date on his driver license?

    My lawyer told me that the expiration date will be the expiration date of the EAD card...

    My EAD will expire in this August...I don't want to spend $85 for few months of renewal...

    I was under F1 student visa (during OPT) and got married on May 7, 2014.

    My case was received by Nebraska Service Center on May 30, 2014.

    I did the Biometrics on 6/30/2014, and my EAD card was approved on 8/11/2014.

    (My OPT expires on 7/30/2014.)

    I haven't heard back from USCIS for any update...

    I wonder if there's anyone here has similar situation as mine?

  15. Your processing time normally goes on your NOA1 and your field office, so if you look at this link it will tell you if youre out of processing time or not. https://egov.uscis.gov/cris/processTimesDisplayInit.do

    Ha~ funny thing is, my case is at Nebraska service center. BUT THEY DON'T PROCESS FAMILY BASED I485!

    Tricky, right?

    So there's no way to know my so called "normal case processing timeline."

    Didnt realise you were a F1 adjuster. I don't know the rules on that visa, but it seems you probably will have to have an interview and that your lawyer might be right after all. There is a forum on here for F1 AOS, they might be able to advise you to the next step. Sorry :(

  16. Sorry to say, but if I were you, I would be looking for another lawyer. The majority of K1 to AOS receive the dreaded NPIW letter. If USCIS sees reason to doubt your marriage then they will schedule an interview, otherwise you receive the NPIW. If you're not adjusting from a K1 visa then your situation is different from a lot of ours. The majority of people in this forum are adjusting from K1 visa.

    yea, I realized that. I didn't know most of the PIW cases are K1 based. I don't understand why though...

  17. You need to submit a service request, probably a did not receive, though out of processing date would work as well with your NOA...

    I tried to submit a service request for I485, it says my case is still within processing timeline.

    And my husband did submit a service request for I130, they said Nebraska center is busy so they haven't gotten time to process the case...

    SINCE MAY 2014... really? no time? that busy? sigh...

    And what on earth my I485 is still within the processing timeline?
