    I tried 3 times. Twice through an attorney, once through a congressman. Every time got a rejection. 

    The case finally got approved in June 2023 through a normal processing times.


     The good thing is once it moved to NVC it’s been moving along. 

    Hopefully your case gets approved soon as well. 

    Ohh nice ! Is there like a number you call or a form you fill for expediting ?

  3. Not sure if I should open a new topic for this new question but still a question on I130. Let me know if I need to create a new topic:

     

    Question on parents name change:

    For my mum she changed her middle name and last name after marriage. Also her last name before marriage is spelled incorrectly on her marriage certificate. Correct name and spelling is on her Indian passport.

    For my dad, his name did not change however there are spelling mistakes for his middle name and last name on his birth certificate which are corrected on his Indian passport.

     

    There is this court process in India called name change gazette, which they have gone through representing their previous names used (spelled incorrectly or prior to marriage in case of my mum) and their current name as per their passport. Is this acceptable for I130 application, or is there something else I need to have them provide for the name change. ?

  4. My parents have visited the US multiple times on B1/B2 Visitor visa over the last 15 years, never overstayed. Based on that context, trying to understand how to answer these questions on I130 online application under the 'Your Beneficiary' --> 'Immigration Information' section:

    Q. Was the beneficiary EVER in the United States

    A. Yes

     

    Q. What was the beneficiary's date of Arrival ?

    A. should this be the last time the beneficiary came to the US ? or should this be left blank ?

    Q. When does the beneficiary's authorized stay expire ?
    A. the beneficiary is not in the United states at the moment, so should this be left blank ? or should this be answered in the context of last time the beneficiary came to the US ?

    My parents live in India, they have a 10 year visitor visa and they frequently visit. I am now planning to bring them here permanently so prepping to file I130. My questions

    1. If I file I130 can they travel to US on their visitor visa while I130 is pending? 

    2. If I file I130 and it gets approved, it may be many months before their interview actually happens, can they travel to US on visitor visa between their I130 being approved and IR5 interview  ?

    3. Can I file I130 while they are here on visitor visa, but not file I485 AOS ? That way their IR5 process can start, and when they go back within a few months they are closer to their IR5 interview at a consulate in India

    4. If I485 AOS is recommended while they are here, how long is the time line for I485 with advance parole and work authorization ? They need to be back in India at the end of Q2 2022.

    I am a USC and planning to apply GC for my parents who live in India. I have the following questions

    1) does the form I130 have anything to do with public charge ? is this form going to change on 24th Feb ?

    2) Once I130 is approved, what is next ? the uscis website says , "You will be notified by USCIS if your Form I-130 petition is approved or denied. If it is approved and your parent is outside the United States, he or she will be notified to go to the local U.S. consulate to complete visa processing." I am sure it is not that simple. are there better instructions ?

    3) After I130 is approved how much time do we have to complete Visa processing, can it be after a few years ? or is there a timeline ?

    4) While I130 is pending, can they travel to the US on their visitor visa ?

    I went to the Mexican Consulate today to apply for a visa (no appointment, ~30 min wait) and was told by the visa officer that as a citizen/passport holder of a country that waves tourist visas for entry to Mexico I would not need to apply for a visa, even under the expired green card / I-797 NoA circumstances.  Obviously I will need to travel with this documentation to regain entry to the US. 

     

    Hope this is helpful information for others.

    Those are two different things it won’t affect the I-130. My parents have never been to the US. When yours are in the states you should be able to apply to adjust their status I believe it’s I-485. Check with Emma first to see if you can do so. Some people bring their parents to the states then adjust this could be considered as visa fraud. 

    Dont want to do that. So wont be applying while they are in states. However wanted to understand the visitor visa situation as visitor is a immigrant visa and by applying I130 the intent to immigrate is clear, so not sure.

    Wow, that sounds so easy, as compared to the I130 when my spouse filed for me. Another question, do your parents have a visitor visa ? what happens to the visitor visa after filing I130 ? can they visit while I130 is pending ?

  10. @peacan thanks for your response. Which is the next form ? I693 ? Also would you mind sharing what documents you sent ? Based on USCIS website, they asked for USC naturalization certificate, USC birth certificate showing parents names, parents marriage certificate. Parents are not divorced previously as well as no name changes so dont need any of that proof. Is there more ?

    When I had this issue, i had the extension letter, expired GC, and no wet ink stamp. My flight was Mumbai Frankfurt Denver, I was not allowed to board, and I was told all flights through europe have this problem, the airport agents specifically told me to go via gulf or direct to states. However, if you have a wet ink stamp, your situation may be different, I am not really sure what happens with the wet ink stamp.

    Correct NOAs. I wouldnt say as back as J1 but GC and forward. Upto you, I am glad I carried my ROC extension letter coz the officer did ask for it. If you have a new 10 year GC you probably would not need anything. I did not, so I took the entire kitchen sink :)

    I took all my original GC receipts, ROC receipts and N400 receipts, my expired GC as well, (I did not receive the new one). So the officer checked my old GC and asked for the ROC receipt and also asked for the passport I551 wet ink stamp. Better safe than sorry.

    Mine did not either, it will most likely be a combo, so TAKE YOUR SPOUSE ALONG. In my case they said they dont need my wife at the start but then the officer called her in at the end of the interview as she had to sign a document which took like 15 secs. 

  15. My N400 was approved 2 weeks ago, at the same time the I751 was approved too. The online status for I751 said card is being produced but never received the card before my oath ceremony. At the oath ceremony they did ask me for the new card, I said I never received it, and showed them the I751 approval letter with the old card. The officer at the ceremony took a few mins and then said that works.  Good luck to everyone who is still waiting.
