  1. Hi,

    My employer informed me that they filed the PERM application electronically today. I fall under the EB-2 category and under "rest of the world". Normally, the visa dates are "current", however for the past few months they have retrogressed to beginning 2014. What's more interesting is that they've only retrogressed for EB2, for EB3 they're still "current". From my research online, it seems that they're expecting the visa dates to go back to "current" at the beginning of 2017.

    Does that mean that I will have to wait an additional ~2 years when PERM gets approved in order to continue my green card process? Would it have been a better idea for me to wait until January next year or so and only then file the PERM? What are my options now?

    Yes, I do have an I20. I did ask my international student advisor but he said he was not sure - he thought I could not. However, I told him I did exactly the same thing the last time I renewed my F1.

    In fact, last time I did it (in 2013), it went like this: I graduated, then received my OPT. I went back home that Summer and renewed my F1 visa successfully even though I did not even have a job offer at the time. I'm still on that visa right now, that's the one that's expiring. So I'm not sure why it wouldn't work this time, just wanted to see if anyone else has any experience of being rejected while on OPT or right before graduating.

  3. I currently have an F1 visa that is valid until August 2015. My graduation date is in June 2015, I will be graduating with a masters degree. I am also about to receive my OPT card (already got the notice in the mail). I have been working for some time now (both with my Bachelor's OPT and masters with CPT) and have proof of current employment. I have had F1 visas from 2009 until today, in 2 year increments (so I am currently on my 3rd F1 visa, will be applying for fourth).


    Now, I know I can legally stay in the country as long as my OPT is valid, but I would like to travel outside the US and have the ability to come back. I am originally from Serbia, so I'd like to go back home too, sometimes.


    Question: can I go back home in e.g. May this year and renew my F1 for another two years?

  4. Hi, I'm 25 years old, from Serbia, been living in the US for some time now. I hold a bachelor's degree from a US university (public ivy league) and will soon be finishing my Masters of Science in IT management. I have almost 7 years of software development experience (5 of which are working for a Serbian company, 2 of which are working for two Fortune 500 US companies while on F-1 OPT/CPT).

    My question is: am I eligible for EB-2? If so, can anyone guess what my chances of getting it are?
