Let your mom put in their I130 forms and when she gets her citizenship certificate she submits a copy ensuring she sends the her case #, Beneficiaries names, and date of births and they will bring it forward. Don't wait for five years, submit now and by the time she gets her citizenship time will run off.

    Does the form I130 goes also for my brother that is married? Also my other question is can I petition my 2 siblings and let my mom do the petition as well and we will just have to wait which petition will be approved faster or uscis would not allow this. I am just concern if something happens to my mom and the petition is still on the process because she is not really that good health wise.

    why wait until she gets citizenship for the single one? she can file for him now, LPR can file for unmarried children regardless their age

    what country are you from? the wait is very long, so she should start filing now for the unmarried ones

    Thank you I didn't know that she can file immediately for the unmarried one. How about my brother that is already married do I need to wait for her to become a us citizen?

  3. My mom will be coming to the US and she has some medications she takes in the Philippines. The medications are for her high blood pressure, eye drops and allergies. Is she allowed to bring them and just bring a written letter from her doctor? How about the over the counter does it need a note from the doctor as well? Also, can she bring 1 year worth of medications or it has some limits. Thank you.

    What did you answer on your I-864 about tax filing? You should have answered YES and included IRS transcripts (preferred) or copies of your entire joint return including any supporting documents.

    I did answer yes and included transcripts from the IRS. My mom told me that the consul look at it but didn't take it. He only took the affidavit of support of my co sponsor and his IRS transcript. I am thinking of just writing the letter but instead of saying I didn't file I will just state there that I was unemployed from the last 4 years but my husband filed taxes jointly with me. Do you think they will accept it? I cannot say I didn't file because my husband filed jointly with me even if I don't have an income.

  5. My mom's visa is under administrative review because the consul needs a letter from me - Signed letter of explanation and legal basis for not filing Income Tax Returns. My question is even if I filed jointly with my husband this doesn't count? My mom brought our last 3 years income tax from the irs during the interview but the consul did not take it. I am unemployed for the last 4 years because I am watching our baby. Also, if someone here has the same issue like mine would you be kind enough to give your two cents. About the letter they want is there a specific format for this? Thank you and I appreciate all your help.

  6. I hope someone who already passed this stage will share their advise or experience. My question is will my mom received any packet or documents from the embassy before her medical or interview appointment? If yes what kind of documents will she receive. Correct me if I am wrong but I remembered during my K visa processes I received a packet before my interview. Also, will the interview letter emailed to me by NVC considered an original document if my mom prints it out? (I forwarded the email attachment to her) or I need to send the letter that NVC sent to me through mail? Thank you all and I appreciate all your help.

  7. Finally I received an email from NVC regarding my mom's visa interview which is on January 19 of next year. My question is can I schedule her to do the medical exam on Jan. 16? The reason is I do not want her to stay in the hotel for 1 week which is very costly and If I do not let her stay in the hotel she needs to fly back to Cebu which is also cost more. Can someone please share their experience without being sarcastic, I really need some input with this. Thank you.

  8. If I am not mistaken your wife should fill out Form I864 even if she doesn't have an income and you as the joint sponsor should fill out Form I864A. In part 1 of Form I864 let your wife check the 1.a that states she is the petitioner. For your part in Form I864A, you have to check part 2 1.c that state you are not the intending immigrant but you are the spouse of the petitioner. You cannot be the petitioner for your mother in law because you are not her immediate relative only your wife. Hope I was able to help.

  9. I really need some good advise regarding my dilemma. I received my mom's original NBI and police clearance yesterday but when I look at it she forgot to sign it. I want to send it back to the PH again but it will take another 3-4 days to arrive their and here in the US back. My brother suggested that I can just scan it and send it to them and let my mom sign it and return it to me through email since NVC only needs the photocopy. Is this okay? or my mom needs to sign the original doc. Thank you.

  10. The last portion of the DS260 it was asking for the NVC number and passport number... Are they asking for the beneficiary's passport number or the petitioner? Also in DS260 the petitioner is allowed to fill out the online form right? because I am the one who filled it out on behalf of my mom. Thank you all for all the info's I am almost there because of all the help provided by kind people in this website.

  11. In the DS260 form it asked for my mom's occupation. My mom in the PH hasn't been working for several years so I choose "HOMEMAKER". But the next question below it makes me confused because it was asking "In which occupation do you intend to work in the US? I petition my mom through IR5 visa not working so in my mind I need to choose "HOMEMAKER" as the answer again. Is this correct? If not can someone please explain it to me. Thank you.

  12. It doesn't make sense for the petitioner's husband fill out I-864A if there is a joint sponsor. If there is a joint sponsor, then that means the petitioner's household income is not considered. So what's the point of counting income from household members if the household income doesn't matter?

    newacct, i am thinking the same way.... hope someone can really give me the best route to take.... i cannot start my affidavit of support because of this confusion

  13. a. A "joint sponsor" would fill out an I-864. A "household member" of yours would fill out an I-864A so that their income can be counted in your household. Your father in law is probably not your household member.

    b. If you filed Married Filing Jointly with your husband, then that's your tax return. You need to provide the "total income" line from your tax return for those years. Your husband does not have to fill out an I-864A if you are not including his income in your household income (and there is no point to include his income anyway since there is a joint sponsor).

    c. If the joint sponsor's own income is not enough, he can include his spouse's income by having her fill out an I-864A.

    I thank you for your reply. Regarding the tax return I am a bit confuse because if I put the total income for those years it will appear that I earned an income even though it is not mine it's from my husband. (Forgive me but I am not knowledgeable when it comes to this.)In my mind I didn't have a job so I should put 0. But I guess the way you say it sounds like my husbands income tax return is mine as well since we file jointly, is this correct? Lastly, my joint sponsor's income is enough so which means his wife doesn't need to fill out an I-864? But how will this work when I put the total income of my joint sponsor, where will I find the separate total income he made for certain years without including the amount his wife made.
